AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO
DELETION OF CHAPTER 2,ARTICLE 1,SECTION 2-11 OF
THE SOUTH MIAMI CODE,ELIMINATING THE MUNICIPAL
COURT DEPARTMENT;FUNCTIONS AND DUTIES;PROVIDING
FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN
CONFLICT;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,Chapter 2,Article 1,Section 2-11ofthe City
Codeof Ordinances establishes Municipal court department of
the City of South Miami;and
WHEREAS,the City Commission has expressed their desire
to have the City's Codeof Ordinances brought up-to-date by
deleting obsolete material,and by adding legislation which
has been adopted and not yet incorporated in the most
current official Code of Ordinances.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Chapter 2,Article I,Section 2-11 of the
CityCode of Ordinances,currently reads as follows:
The municipal court department shall be headed by the
municipal judge and associate judge appointed by the city
council.The associate judge to act in the absence of the
muni cipal judge.
The municipal court department shall perform the
following functions:
(a)Shall impose penalties for violating ordinances of
the City of South Miami.
(b)Shall have the power to summon witnesses,issue
warrants for arrested persons upon affidavits duly
affixed,and administer oaths.
(c)Perform all other related functions.(Ord.No.404,
§3,4-1-58)
Section 2.The City Commission hereby amends Chapter
2,Article I,deleting Section 2-11 inits entirety.
Section 3.If any section,clause,sentence,or
phrase of this ordinance isfor any reason held invalid or
unconstitutional by a court of competent jurisdiction,the
holding shall not affect the validity ofthe remaining
portions of this ordinance.
Section 4.All ordinances or parts of ordinances in

conflict withthe provisions ofthisordinancearehereby
repealed.
Section 5.
at the time of its passage
This ordinance shall take effect immediately
