AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO
DELETION OF CHAPTER 2,ARTICLE 1,SECTION 2-17 OF
THE SOUTH MIAMI CODE,ELIMINATING THE LIBRARY
DEPARTMENT;FUNCTIONS AND DUTIES;PROVIDING FOR
SEVERABILITY;PROVIDING FOR ORDINANCES IN
CONFLICT;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,Chapter 2,Article 1,Section 2-17oftheCity
Codeof Ordinances establishes a library department ofthe
City of South Miami;and
WHEREAS,the City Commission has expressed their desire
tohavethe City's Code of Ordinances brought up-to-date by
deleting obsolete material,and by adding legislation which
has been adopted and not yet incorporated in the most
current official Code of Ordinances.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Chapter 2,Article I,Section 2-17 of the
City Code of Ordinances,currently reads as follows:
The library department,supervised by the city
librarian,shall perform the following functions:
(a)Develop a general library program for the city.
(b)Operate the library facilities of the city.
(c)Maintain and operate all property assigned to the
library department.
(d)Prepare and maintain all records pertaining to the
department,as required by the city manager.
(e)Perform all other related functions,as required.

Section 2.The City Commission hereby amends Chapter
2,Article I,deleting Section 2-17inits entirety.
Section 3.If any section,clause,sentence,or
phraseofthis ordinance isforany reason held invalid or
unconstitutional by a court of competent jurisdiction,the
holding shall not affect the validity ofthe remaining
portions of this ordinance.
Section 4.All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed.
