No. 07-97-1628ORDINANCE NO.7-97-1628 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE STATUS OF WOMEN;ESTABLISHING THE CITY OF SOUTH MIAMI COMMISSION ONTHESTATUSOF WOMEN;PROVIDINGFOR SEVERABILITY, ORDINANCES IN CONFLICT AND AN EFFECTIVE DATE. WHEREAS,thestatus of womeninthis community warrants attention and improvement;and, WHEREAS,the Mayor and City Commission desire to create a committee onthe status of women. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Section 2-26.1 of the Code of Ordinances of the City of South Miami, entitled "Boxing commission;membership;duties,"is hereby repealed inits entirety and substituted with the following: Section 2-26.1.Committee on the Status of Women. (a)Created;composition.Thereishereby created aCity of South Miami Committee on the Status of Women.The committee shall consist of 10 members. (b)Appointment and terms of members.Members of the committee shallbe appointed bythe mayor asprovidedintheCity Charter.Members of the committee shall be permanent residents or employed in businesses in the city for two or more years.Each member shallhave demonstrated a commitment to improve the condition ofwomen through community andotherservice.The membership should reflect the racial and ethnic diversity of the residents of the City of South Miami. (c)Terms of office.In order that the terms of office of all members of the committee shall not expire atthesametime,the initial appointments tothe committee shallbeasfollows:5members of thecommitteeshallbe appointed foraterm of two yearsfromdate of itsfirstmeetingand5 members shallbe appointed tothe committee foraterm of threeyears.Appointed members shallthereafterservefor aperiod of 2yearsoruntiltheirsuccessorisappointed,whichever occurslater. (d)Chairperson and vice-chairperson.The chairperson and vice-chairperson shall beelectedbythemembers ofthe committee for aterm of one year.Appointmentsto fill anyvacancyonthecommittee shall befortheremainder of theunexpiredterms. Whenanymember of the committee fails to attend three(3)consecutive meetings withoutanexcused absence,heorshe shall beremoved by the city commission.An "excused absence"shall be defined as an absence resulting duetoa personal or family illness,deathinthefamily,beingout of townbecause of business,professional,or other commitments subjecttotheapproval of thechairperson. (e)Organization of the committee.Members of the committee on the status of womenshallelectsuchofficers,in addition tothe chairperson anda vice-chairperson, as may be deemed necessary.Sixmembersshallconstituteaquorumnecessaryto holdameetingandtakeany action.Membersshallserve without compensation,but shallbe reimbursed fornecessary expenses incurredinthe performance of their officialduties,asapproved by thecity commission.A budget shallbeestablished by the city manager,assoonaspossible,forpurpose of funding expenses.Regular and special meetings of the committee shallbe scheduled,and notice of such meetings shall be given,as provided inthe City of South Miami Code of Ordinances for meetings ofthecitycommission;provided,however,thatschedulingspecialmeetings shallrequirethewrittenrequest of 6 committee members.Minutes shallbe kept by city staff of all meetings. (f)Dutiesand Powers oftheCommitteeontheStatus of Women.The powers and duties of the committee shall include,but not be limited to,the following duties, functions,powers and responsibilities: (1)To serve inan advisory capacity by making investigations,studies, reportsand recommendations tothe city commission,the city manager andherorhisadministration,andthe community,in respect toall matters pertaining tothe status of all women in South Miami, including,but not limited to,thefairandequal treatment of women; thosepoliciesandpractices which discriminate against women whether practiced by publicorprivatepersons,individualsorcorporations;and, the public andprivate employment of women,the working and living conditions of women,the delivery of public and private services to women,andtheeducationandtraining of women and public accommodations for women; (2)To make continuing studies with recommendations andreports of all cityagencies,facilities,boards,servicesandprogramsdealing with or affecting women,including equalfunding of such facilities,services andprograms; (3)To study,recommend andreportany needed improvements and changesto city codes,boards,ordinances,resolutions,and written and unwritten policies andpractices of the city; (4)Toappearbeforeanygovernmentalor non-governmental agencyto presentfindingsand recommendations on behalf of the commission of thestatus of women,aswellason behalf of the city with theapproval of the city commission; (5)To solicit contributions,servicesand financial support fromother governmental authorities,private businesses,groups,institutions and trust funds; (6)Toserveasaliaisonorinformalmediator among the city commission, thecity administration,thecityemployeesandtheusers of cityservices and facilities.The commission onthestatus of women may consult with representatives of thesegroupsfromtimetotimeasnecessaryto carry out the commission on the status of women's duties and functions;and, (7)Toperformotherduties,functionsandservicesas may beassignedto it by the city commission. Section2.If anysection,clause,sentence,or phrase of thisordinanceisforany reason heldinvalidor unconstitutional byacourt of competentjurisdiction,theholdingshall not affect the validity of the remaining portions of this ordinance. Section3.All ordinances or parts of ordinances in conflict with theprovisions of this ordinance are hereby repealed. Section4.This ordinance shall takeeffectimmediatelyatthetime of its passage.
