AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,AMENDING CHAPTER 2,
ARTICLE I,SECTION 2-2.1(M)(e)DELETING LANGUAGE
REQUIRING THAT ORDINANCES BE READ IN THEIR ENTIRETY
WHEN PRESENTED AS AGENDA ITEMS;PROVIDING FOR
SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT;AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City Commission has expressed their desire to
have the City's Code of Ordinances brought up-to-date by deleting
obsolete material,and by adding legislation which has been
adopted and not yet incorporated in the most current official
Code of Ordinances.
WHEREAS,the City Administration,in response to the
direction of the City Commission,presents this amendment
revising the code to comply with the City's 1990 Charter
Revisions which removed the requirement that ordinances presented
as agenda items be read in their entirety.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.To amend Article I,SECTION 2-2.1 (M)(e)which
currently reads as follows:
When ordinances or resolutions are presented as agenda
items,the ordinances shallbereadintheir entirety andthe
resolutions shall be read by their titles only.After said
reading,amotion,duly seconded,shallberequiredbeforeany
further consideration may be had onthe proposed ordinances or
resolutions.Proposed ordinances and resolutions may be
introduced ataregular meeting ofthe commission and aformal
vote thereon may betaken.Proposed ordinances acted upon
favorablyshallbe automatically placedforsecondreadingonthe
agendaofthenextregular meeting.Proposed resolutions acted
uponfavorablybyamajorityofthecommissionpresent shall
become effective immediately.
Section 2.If adopted by the City Commission,Article I,
SECTION 2-2.1(M)(e)will be amended by deleting text indicated
below by "strike-through."
When ordinances or resolutions are presented as agenda
items,the ordinances shall be—read in—their—entirety and the

resolutions shall be read by their titles only.After said
reading,a motion,duly seconded,shall be required before any
further consideration may be had on the proposed ordinances or
resolutions.Proposed ordinances and resolutions may be
introduced at a regular meeting of the commission and a formal
vote thereon may be taken.Proposed ordinances acted upon
favorably shall be automatically placed for second reading on the
agenda of the next regular meeting.Proposed resolutions acted
upon favorably by a majority of the commission present shall
become effective immediately.
Section 3.If any section,clause,sentence,or phrase
of this ordinance is for any reason held invalid or
unconstitutional by a court of competent jurisdiction,the
holding shall not affect the validity of the remaining portions
of this ordinance.
Section 4.All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed.
Section 5.This ordinance shall take effect immediately
at the time of its passage.
