BACKGROUND: The applicant, GRST SoMi Investors, LLC , owners of the property located 5958 South Dixie Highway requested the review and approval of a Unity of Title for the above-mentioned property (See Figure 1 for location) with the following legal description: Lots 1, 2, 3 and 11, and the Northea sterly 35 feet of Lot 4, Block 2, Solovoff Subdivision, according to the plat thereof as recorded in Plot Book 7, Pag e 11, Public Records of Miami- Dade County, Florida ; Having 30,845 sq/ft more or less; Property address: 5958 South Dixi e Highwa y, Miami, Florida 33143; Folio Number: 09-4036-029-0080 Figure 1 7230 5885 Subject Prop er ty ,.. (.It ~ -I • J! ! 6850 5901 I (0) • -I I • ------ 5950 5900 5875 S GRST SoMi Investors, llC Unity of Title -5958 S Dixie Hwy July 7,2015 Page 2 of 2 The owner submitted a unity of title request in preparation for a new mixed-use development project that would encompass all of the property which was formerly occupied by the "New Chinatown" restaurant and retail uses. As listed on the attached boundary survey, the site consists of Lots 1, 2 3 and 11, and the northeasterly 35 feet of Lot 4, Block 2 of the Solovoff Subdivision. The property was platted in 1921 and consists of several abutting Lots within Block 2 of the Amended Plat of the Solovoff Subdivision. In 1946 the existing building was constructed across the various abutting lots on the property; however, an official unity of title has not been recorded for such property. Therefore, the applicant supplied this request to the City to meet the code requirements for unifying property and development. During staff review, no unity of title was found in the city's records, hence the acceptance of this application to memorialize and record this unity of title with the appropriate legal instrument. The said property is located in the Specialty Retail (SR) zoning district and within the Hometown District Overlay (HD-OV). Pursuant to Section 20-7.30(A)(1) ofthe Hometown District Overlay, if the development project is to be built on two or more abutting platted lots then a unity of title is required. Additionally, Section 20-5.16(C) of the City's land development code requires that the City Commission review and approve the unity of title. The Planning & Zoning Department and the City Attorney have reviewed the attached document as to form and content. Approval of the unity of title does not imply approval of the development project. All development on this site shall comply with the requirements of the City's land development code. RECOMMENDATION: Staff recommends that the Commission approve the attached resolution approving the unity of title for the property located at 5958 South Dixie Highway. Covcnant Running with the Land. This Unity of Title on the part of the Owner shall constitute a covenant running with the land and shall be recorded, at the Owner's expense, in the public records of Miami-Dade County, Florida and shall remain in full force and effect and be binding upon the undersigned Owner, and its heirs, successors and assigns and upon all mortgagees or lessees until such time as the same is modified or released. These restrictions during their lifetime shall be for the benefit of, and limitation upon, all present and future owners of the real property and for the public welfare. Term. This Unity of Title is to run with the land and shall be binding on all parties and all persons claiming under it for a period of thirty (30) years from the date this Unity of Title is recorded after which time it shall be extended automatically for successive periods of ten (10) years each, unless an instrument signed by the, then, owner( s) of the Property has been recorded agreeing to change the covenant in whole, or in part, provided that the Unity of Title has first been modified or released by resolution passed and adopted by the City Commission, after a public hearing, and executed by the City Manager and the City Clerk. Modification, Amendment, Release. This Unity of Title may be modified, amended or released as to the land herein described, or any portion thereof, by a written instrument executed by the, then, owner(s) of all of the Property, including joinders by all mortgagees, if any, provided that the same is also approved by resolution passed and adopted by the City Commission, after a public hearing, and executed by the City Manager and the City Clerk. A release will be executed when the Property is made to conform with applicable zoning regulations and the use or structure which caused the need for this Unity of Title is removed from the premises and there is no further reason to maintain the Unity of Title on the public records. The release of the Unity of Title is contingent upon the cessation of the conditions and/or criteria which originally required the execution of the Unity of Title and the cessation of any condition or criteria that occurs after the approval of the Unity of Title and which condition and/or criteria requires a Unity of Title. Enforcement. Enforcement shall be by action against any parties or person violating, or attempting to violate, any covenants. This enforcement provision shall be in addition to any other remedies available at law, in equity or both. Authorization for the Citv to Withhold Permits and Inspections. In the event of any non-compliance with any of the terms of this Unity of Title, the City is hereby authorized, in addition to any other remedies available, to withhold any further permits, and refuse to make any inspections or grant any approvals, until such time as the Property is in compliance. Election of Remedies. All rights, remedies and privileges granted herein shall be deemed to be cumulative and the exercise of anyone or more shall neither be deemed to constitute an election of remedies, nor shall it preclude the party exercising the same from exercising such other additional rights, remedies or privileges.
