23-98-1671 ORDINANCE NO. AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,DELETING SECTION 4-3,SEIZURE AND FORFEITURE OF ILLICIT LIQUORS, STILLING APPARATUS,ETC.OF THE CODE OF ORDIN ANCES OF THE CITY OF SOUTH MIAMI,FLORIDA,RELAT ING TO THE SEIZURE AND FORFEITURE OF ILLICIT LIQUORS,STILLING APPARATUS,ETC;PROVIDING FOR SEVERABILITY;ORDINANCES IN CONFLICT AND PROVID ING FOR AN EFFECTIVE DATE, WHEREAS,Section 4-3,Seizure and Forfeiture of Illicit Liquors,Stilling Apparatus,etc.ofthe Code of Ordinances provides for seizure and forfeiture of certain personal property involvedinspecificillicitliquoractivities;and WHEREAS,currentstatestatuteprovidesforspecific proceduresgoverningthistypeofseizureandthedisposalof proceeds of same;and WHEREAS,the City Commission has expressed their desire to have the City's Code of Ordinances brought up-to-date by deleting obsolete material,andby adding legislation whichhasbeen adopted andnot yet incorporated inthemost current official Codeof Ordinances;and NOW,THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:Section4-3oftheCityCodeof Ordinances currently reads as follows: Sec.4-3.Seizureand forfeiture ofillicit liquors, stilling apparatus,etc. Any vehicle,vessel,aircraftoranyanimalused inthe transportation orremoval of,orforthe deposit or concealment ofany illicit liquor stillorstilling apparatus orany mash,wort, wash,orother fermented liquids capable ofbeing distilled or manufactured into an alcoholic bev erage containing more than one percent of alcohol by weight orany alcoholic beverage,commonly knownand referred toas "moonshine whiskey",where seizedbyamunicipalpoliceofficer within the corporate limitsofthecityshallbe forfeited,as provided for by the general state law,and allsums received therefrom shall go into the general oper ating fundofthecity. Section 2:TheCityCommissionherebydeletesSection4-3in its entirety. Page 2of Ordinance No.23-98-1671 -2- Section 3:If any section,clause,sentence,or phrase of this ordinance is for any reason held invalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect the validity of the remaining portions of this ordinance. Section 4:All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5:The ordinance be effective immediately after the adoption hereof.
