No. 04-98-1652ORDINANCE NO.4-98-1652 A ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO RECREATION; AMENDING SECTION 2-26.3 OF THE CODE OF ORDINANCE BY CREATING A RECREATION AND CULTURAL AFFAIRS BOARD; SETTING FORTH GUIDELINES BY WHICH BOARD SHALL BE GOVEREND;PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the CityofSouthMiami believe that emphasizing and providing necessary support to the Recreational and Cultural Affairs are important elements of community building and improving of the quality oflifeforthe whole community. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That Section 2-26.3 of the Code of Ordinance is hereby amended as follows: Sec.2-26.3.Recreation and Cultural Affairs Board. (a)Creation;composition.Thereisherebycreateda recreation and cultural affairs board for the city. Said Board shall consist of at least nine (9) members. Appointment and the terms of membership.The Members of saidboardshallbeappointedbytheMayorwiththe advice and consent of the Commission.One member shall bea representative ofChamberSouthandonemembera representative of Alliance for Youth,Inc.Three membersshallbeappointedforathreeyearterm;three membersShallbeappointedforatwoyearterm;all other members shallbe appointed forone year term; Appointees shall thereafter serve for a period of two (2)years or until their successor is appointed, whichever comes later. (b)Chairman and vice-chairman.The members shall promptly meet and select a chairman and vice-chairman by a majority vote of the board. (c)Quorum.Aquorumformeetingsoftheboardshallbea majority ofthemembersoftheboard. (d)Duties.Thedutiesoftheboardshallbeas follows: (1)Meetings shall beheldona bi-monthly basis oras needed. (2)study the leisure timeand recreational needs ofthe City residents,including,butnotlimited to:(a)make recommendations,onthe development ofa master plan for parks and recreational facilities;(b)Provide directions and guidance in setting policies andgoals for recreational and athletic programs;(c)assist the cityadministrationinidentifyingfundingsourcesfor recreational opportunities;and (d)providefor public hearings.(e)An administrative staff representative shall be appointed bytheCity Manager,including a Secretary to Board,who shall be responsible for proceedings,intheformof minutes,which shall be regularly submitted to the City Commission forits consideration. Section 2.Ifany section,clause,sentence,orphrase ofthis ordinance isforanyreasonheldinvalidor unconstitutional bya court of competent jurisdiction,the hold shall not affect the validity of the remaining portions of this ordinance. Section 3.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.This ordinance shall take effect immediately at the time of its passage.
