AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO LAND USE;
PROVIDING A 180-DAY MORATORIUM ON ACCEPTANCE AND
REVIEW OF APPLICATIONS,AND ISSUANCE OF DEVELOPMENT
PERMITS,FOR THE INSTALLATION OF TELECOMMUNICATION
TOWERS TO ENABLE THE CITY TO PREPARE AND ADOPT
MINIMUM STANDARDS FOR THE LOCATION AND APPROVAL OF
TELECOMMUNICATION TOWERS;PROVIDING THAT ORDINANCES
IN CONFLICT SHALL NOT BE IN FORCE AND EFFECT DURING THE
TIME PERIOD OF THE MORATORIUM;PROVIDING FOR
SEVERABILITY,ORDINANCES IN CONFLICT,AND AN EFFECTIVE
DATE.
WHEREAS,the Congress ofthe United States adopted the Telecommunications Act
of 1996,providing for federal regulation of wireless telecommunications,a technology of
wireless voice,video and data communications systems,which requires land-based facilities
that impact planning and zoning concerns intheCity of South Miami and throughout the
United States;and,
Whereas,the Mayor and City Commission finds that itisinthe public interest to
regulate the siting of wireless communication towersand antennas within the municipal
boundaries;and,
Whereas,the City has received,and expects to receive additional,requests from
telecommunication service providers tosite wireless telecommunication towers and antennas
withinits municipal boundaries andtheCityis authorized byfederal,stateandlocallawto
regulatethesiting of suchtowersandantennas;and,
Whereas,itisthe intent ofthecity commission to provide reasonable accommodation,
andtopromoteand encourage fairandreasonablecompetition,among telecommunication
serviceproviders,orproviders of functionallyequivalentservices,onaneutralandnon
discriminatory basis;and,
Whereas,the purpose andintent of this moratorium ordinance isto enable theCity
toadoptminimumstandardsforthelocationandinstallation of telecommunication towers
and antennas,for establishing the priority order of useand,further,to encourage theco-
location of facilities,inamannerthatisconsistentwith,andimplements,the City's
comprehensive plan,andis compatible withtheexisting patterns ofdevelopment inthecity;
and,
Whereas,by enacting regulatoryrequirementsand standards,itisthe City's intentto
protectandpromotethehealth,safetyandwelfareofitscitizensandresidents,thetraveling
public,and other persons ina manner thatwill minimize both the number of towers and
antennas,aswellasanyadversevisualimpactandotherpotential damage bythesefacilities,
through encouraging co-location andshareduse ofnewand pre-existing telecommunication
facilities,throughincentives,carefuldesign,engineering,siting,landscapescreeningand
innovative camouflaging techniques.
WHEREAS,thecitycommissionhasdirectedtheCity Manager andtheCityAttorney
toreviewtheCode ofOrdinancesandtoproposeamendmentstoensurethatcityregulations
are consistent withthe provisions of theActinallareas,including butnot limited to
minimum standards for telecommunication service;and,
WHEREAS,on or about August 1,1996,the Federal Communications Commission
promulgatedvoluminousregulationsandstandardsrelatingto telecommunications,including
butnotlimitedtotelephone,cable,wirelesscommunicationservicesandopenvideosystems;
and,
WHEREAS,the staff of thecityrequirestimetostudythe application andfunction
of theActandtheFCC regulations withintheCity of South Miami;and,
WHEREAS,the staff of thecityalsorequirestimetostudyrecent technological
advancesand applications affectingallaspects of communication,including butnotlimited
towireless service,cable services,telephoneservices,openvideo systems,andthe placement
of related facilities;and,
WHEREAS,the development permit moratorium,together withthe directed study,
including the review of the Federal Communication Commission regulations,is consistent
with requirements of theAct;and,
WHEREAS,itisinthe best interests of the citizens of the City of South Miami to
impose the moratorium;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.TheWhereasclausesare incorporated in,andmadeapartof,this
ordinance.
Section2.TheMayorandCityCommission of theCity of SouthMiamihereby
declaresa6-monthdevelopmentpermitmoratoriumonallactionsrelatingto acceptance and
review of applications,and issuance of development permits,forthe installation of
telecommunication towers,toenablethecitytoprepareand adopt minimum standards for
the location and approval of telecommunication towers.The term,"telecommunication
towers,"isdefinedtomeanaguyed monopole,orself-support/latticetower,containingone
or more antennas used inthe provision of wireless communication sen/ice..
Section 3.The moratorium shallbe effective through June 16,1998,unless
extended by the city commission.
Section 4.All ordinances,or resolutions,or parts,in conflict withthis
development permit moratorium shallnotbeinforceand effect during the time period of the
moratorium.
Section 5.If any section,clause,sentence,or phrase of this ordinance isforany
reason held invalid or unconstitutional bya court ofcompetent jurisdiction,the holding shall
not affect the validity of the remaining portions of this ordinance.
Section 6.This ordinance shalltake effect immediately atthe time of its passage.
