AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI,FLORIDA,RELATING TO THE COMMUNITY SERVICE (CS)
OVERLAY ZONING DISTRICT;AMENDING CHAPTER 20 OF THE CITY OF
SOUTH MIAMI LAND DEVELOPMENT CODE BY REVISING SECTION 20-9.3,
ENTITLED "BOUNDARIES,"IN ORDER TO CLARIFY THAT THE CS OVERLAY
ZONING DISTRICT SHALL BE SHOWN ON THE CITY'S OFFICIAL ZONING
MAP;PROVIDING FOR ORDINANCES IN CONFLICT,SEVERABILITY,AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,thePlanningandZoningDepartmentandthePlanningBoardhaveinitiateda
program to update,clarify,and improve the provisions oftheCity'sLand Development Code;
and
WHEREAS,afterreviewandconsiderationthePlanningandZoningDepartmenthas
recommended amending certain provisions of Section 20-9.3 pertaining tothe boundaries of the
CommunityServiceOverlayZoningDistrict;and
WHEREAS,aspecificamendmenttoSection20-9.3wasincludedintheLandDevelopment
Code Proposed Technical Amendments 99-A document whichwas reviewed bythe Planning
BoardatapublicworkshopheldonOctober 26,1999;and
WHEREAS,on November 9,1999,afterpublichearingregardingtheproposedamendment
toSection20-9.3 of theLandDevelopmentCode,thePlanningBoardvoted7-0totransmitthe
proposedamendmenttotheCityCommission;and
W^HEREAS,theCity Commission desirestoacceptthe recommendations ofthe Planning
Board and enact the aforesaid amendment.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1,That Section 20-9.3,entitled "Boundaries"(Community Service Overlay
District)of theSouth Miami LandDevelopmentCodeishereby amended toreadasfollows:

ThepropertiesintheCommunityService(CS)overlayzoningdistrictshallbedelineatedon
the City's Official Zoning Mapwiththesymbol "CS-OV"andshownasare indicated as
darkenedareasinFigure20-9.1(see attached)-aHd.Thepropertiesarelegallydescribedas
follows:
Section2.Allordinancesorparts of ordinancesinconflictwiththeprovisions of this
ordinance are hereby repealed.

Section3.If anysection,clause,sentence,orphrase of thisordinanceisforanyreasonheld
invalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect the
validity of the remaining portions of thisordinance.
Section 4.This ordinance shall take effect immediately at the time of its passage.

BACKGROUND &ANALYSIS:
TheCommunityService(CS)OverlayZoningDistrictwascreatedin1997inordertoassist
existingcommunity-basedsocialserviceandinstitutionalproviderstoimproveandexpandtheir
facilities inthe community.Theoverlaydistrictis designated on specific sitesbyalegal
descriptionwhichisincludedinSection20-9.3 of theLandDevelopmentCode(LDC).Thesites
are shown ona small map within thetext of theLDC.However,asa special zoning district,the
CS Overlay should alsobe shown onthe City's Official Zoning Map.The attached ordinance
will allow forthe properties intheCSOverlayDistricttobe placed onthe City's OfficialZoning
Map.
This itemwas approved onfirstreadingbytheCity Commission atits November 2,1999,
meeting.The Planning Board atits November 9,1999 meeting recommended approval of the
proposed ordinance
