1583,INCREASING PERMIT FEES,ADDING NEW FEES AND
DELETING SOME FEES AND OBSOLETE LANGUAGE FROM THE
SCHEDULE,PROVIDING FOR SEVERABILITY,ORDINANCES IN
CONFLICT,AND AN EFFECTIVE DATE.
WHEREAS,the City's PermitFeeSchedule,includingBuildingPermitFees,
Plumbing PermitFees,Mechanical PermitFees,Electrical PermitFees,Certificate of
Use,CompletionorOccupancyFees,OtherFees,LandUseFeesandPublicWorks
Utilities Fees has been amended on several occasions and it now contains obsolete
language,unenforceable feesandisincompleteinsomeareas and,
WHEREAS,thefees included inthisordinancehave not been increased tokeep
pacewiththecost of enforcingconstructionandland development codesorfeescollected
byother municipalities andthecountyand,
WHEREAS,theMayorandCityCommissiondesiretoadoptanewandmore
equitable Permit FeeSchedule.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.ThatOrdinance 14-90-1454,asamendedbyOrdinances6-92-1501,
17-92-1512A and10-95-1583isamendedbyreplacingthe Permit FeeSchedulewiththe
amended Permit Fee Schedule attached to this Ordinance.
Section2.If any section,clause,sentence,orphrase of thisordinanceisforany
reasonheldinvalidorunconstitutionalbyacourt of competentjurisdiction,theholding
shallnotaffectthevalidity of theremainingportions of thisordinance.
Section3.Allordinancesorparts of ordinancesinconflictwiththeprovisions
of thisordinancearerepealed.
Section4.Thisordinanceshalltakeeffect immediately upon approval.

FEES AND OBSOLETE LANGUAGE FROM THE SCHEDULE,PROVIDING FOR
SEVERABILITY,ORDINANCES IN CONFLICT,ANDAN EFFECTIVE DATE.
BACKGROUND AND ANALYSIS
TheCityperiodicallyreviewsitsfeeschedulesinordertodetermine if appropriateratesare
being charged for City services.The City had initially proposed consideration of adjustments to
General Fees andthe addition of Threshold Inspection Feesand Impact Fees.
Itwasfeltthatthe Planning Board shouldconsiderthe Impact Fees schedule.ThePlanning
Board,however,has not been able to meet and consider these fees.Itis,therefore recommended
thattheImpactFeesbe considered separatelyandthattheGeneralFeesand Threshold Inspection
Feesbe considered bythe Commission atthistime.The Impact Feeswillbe brought forward as
soon asthe Planning Board has considered the matter.
The Building Department review of thecurrentCityFee schedule produced two important
findings:
1.General Fees-The fees charged by South Miami for normal building permits and
inspections are substantially below those charged by other cities and Miami-Dade
Countyandhavenotkeptpacewiththe City's costsin performing theseactivities;
and
2.ThresholdInspectionFees-TheSouthFloridaBuildingCodehasimposedanew
inspection requirement for "threshold inspections"andtheCityfeescheduleneedsto
beamendedtoincludethisnewrequirment.
1.General Building Fees
Sections oftheCity'sPermitFee Schedule havebeen amended several timesoverthe years.The
new proposed Permit Fee Schedule represents a complete overhaul ofthe Schedule including a
simpler format,fee increases and new features meant to bring the permit fees closer to actual
costsincurredbytheCityinprocessingthosepermit applications.
The scarcity ofCountyandState Certified personnel qualified forplanreviewand inspections
has increased thecost of providing these services.The complexity of construction codesthat
have tobe enforced requires theCityto have thebest available individuals.The increased
number of required inspections has also compounded this function and contributed to increased
costs.Additional feesare needed toabsorbthecost of threshold building inspections.
The proposed Schedule increases fees toa scale that is more comparable to fees at other
municipalities and the County,although still lower than most Cities.The chart that follows
compares some random proposed fees with other municipalities.

12.Applications for owner builderbuildingpermitsonpropertiesinzoningdistricts RS-1,RS-2,
RS-3,RS-4,RS-5 andsinglefamilyunitsinthe RT-6 and RT-9 zoningdistrictswillbe exempt
frompermitfeesonceeachcalendaryearfor work havinganestimatedvalue of upto $1000 inthe
following categories:building,roofing,mechanical,electrical,plumbingandanyother
subcategories listedundersections A,B,CandDintheadoptedfee schedule.Staff may require
thepermit applicant tosubmit appropriate documentationas proof of estimatedcost of
construction.If such proof isnot submitted bytheapplicant,staff willestimatethevaluebasedon
currentpricesforthetotalcost of laborand materials.Constructionstartedpriortotheissuance of
apermitwill not be exempt frompermitfees.

(I)TREE REMOVAL PERMIT FEES

(G)REFUNDS,TIME LIMITATIONS AND CANCELLATIONS
The Fees charged pursuant tothisschedule,provided thesameareforapermit required by
Section 301.1 ofthe South Florida Building Code,shallbe refunded bytheBuildingOfficial
subject to the following:
1.Norefundswillbemadeon requests involving:
a)Permit fees of $200 or lessee*
b)PermitsrevokedbytheBuilding Official underauthoritygrantedbytheSouthFlorida
BuildingCode;or
c)Permits canceled by court orderf-or
d)Permits whichhaveexpiredVer
e)Permitsunderwhichworkhas commenced as evidenced byanyrecordedinspection
and/or field inspections;or
f)Theoriginalpermitholderwhenthereisachange of contractor.
2.Afullrefundwillbegrantedfor te apermitholderwho talces outapermitcoveringwork
outsideCity limits,the jurisdictional inspectionarea.
3.Afullrefimd,less$200or50%of thepermitfee,whicheverisgreater,willbegrantedtoa
permitholderwhorequestsarefundinwritingprovidedthat:
a)Awrittenrequestis submitted totheCitypriortothepermit expiration date;and
b)ThatAvalidatedcopy of thepermitbe submitted withsuchrequest.
4.Where a permit has become null and void pursuant to paragraph 3013(a)of theSouth Florida
Building Code,acredit of fifty percent (50%)ofthe permit fee will bo applied toanyre
application feefora permit covering the same project and involving the same plans thatwere
originally submitted provided thatthe complete re application is made within six(6)months of
the expiration dateof tho original permit and provided thatno refund has boon made as
providedinthis scotion.
