AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA RELATING TO THE
STATUS OF WOMEN;AMENDING SECTION 2-26.1 OF THE CODE
OF ORDINANCE BY CHANGING THE NAME COMMITTEE ON THE
STATUS OF WOMEN TO THE COMMISSION FOR WOMEN;
PROVIDING FOR SEVERABILITY,ORDINANCES IN CONFLICT,
AND AN EFFECTIVE DATE.
WHEREAS,thestatus of womeninthiscommunity warrants attentionand
improvement;and
WHEREAS,the Mayor andCityCommissiondesiretocreatea Commission for
women.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section 2.26.1 of theCode of Ordinances of theCity of South
Miami,entitled "Commission for Women."
Section 2.26.1.Commission for Women.
(a)Created;composition.ThereisherebycreatedaCity of SouthMiami
Commission for Women.The Commission shall consist of 10 members.
(b)Appointmentandterms ofmembers.Members of the Commission
shallbeappointedbytheMayorasprovidedintheCityCharter.Members of the
Commissionshallbe permanent residentsoremployedin business inthecityfortwoor
moreyears.Each member shallhave demonstrated a commitment toimprovethe
condition of womenthroughcommunityandotherservice.Themembershipshould
reflecttheracialandethnicdiversity of theresidents of theCity of SouthMiami.
(c)Terms ofOffice.Inorderthattheterms of office of allmembers of the
Commissionshallnotexpireatthesametime,theinitialappointmentstothe
Commission shallbeasfollows;5members of the Committee shallbe appointed fora
term of twoyears from date of its first meetingand5 members shallbe appointed tothe
Commissionforaterm of threeyears.Appointedmembersshall thereafter servefora
period of 2yearsoruntiltheirsuccessorisappointed,whichever occurslater.
(d)Chairpersonand vice-chairperson.Thechairpersonandvice-
chairpersonshallbeelectedbythemembers of theCommissionforaterm of oneyear.
AppointmentstofillanyvacancyontheCommissionshallbefortheremainder of the
unexpiredterms.Whenanymember of theCommissionfailstoattendthree(3)
consecutive meetings without an excused absence,heorsheshallbe removed bytheCity
Commission.An "excused absence"shallbedefinedasanabsenceresultingdueto

personal orfamilyillness,death in family,beingout of town because of business,
professional,orother commitments subjecttotheapproval of thechairperson.
(e)Organization oftheCommission.Members of the Commission
forWomen shallelectsuchofficers,inadditiontothechairpersonandavice-chairperson,
as may bedeemednecessary.Six members shallconstitutea quorum necessarytoholda
meetingtotakeanyaction.Membersshallserve without compensation,butshallbe
reimbursedfornecessaryexpenses incurred intheperformance of theirofficialdutiesas
approved by the City Commission.Abudgetshallbeestablished by the City Manager,
assoonaspossible,forpurpose of fundingexpenses.Regularandspecial meetings of
theCommissionshallbescheduled,andnotice of suchmeetingsshallbegiven,as
provideintheCity of SouthMiamiCode of Ordinancesfor meetings of theCity
Commission;provided,however,thatschedulingspecialmeetingsshall require the
writtenrequest of 6Commissionmembers,Minutesshallbekept by city staff of all
meetings.
(f)DutiesandPowers ofthe Commission forWomen.Thepowersand
duties of the Commission shallinclude,butnot limited to,thefollowingduties,
functions,powersandresponsibilities.
(1)Toserveinanadvisorycapacity by making investigations,studies,reports
and recommendations totheCity Commission,the City Managerandheror
hisadministration,andthecommunity,inrespecttoallmatters pertaining
tothestatus of women inSouthMiami,including,but not limited to,the
fairandequaltreatment of women;thosepoliciesand practices which
discriminateagainst women whetherpracticed by publicorprivatepersons,
individuals orcorporations;and,thepublicandprivate employment of
women,the working andlivingconditions of women,thedelivery of public
andprivateservicesto women,andtheeducationandtraining of women
andpublic accommodations forwomen;
(2)Tomakecontinuingstudieswithrecommendationsandreports of allcity
allcityagencies,facilities,boards,servicesandprogramsdealingwithor
affecting women,includingequalfunding of suchfacilities,servicesand
programs;
(3)Tostudy,recommend andreportany needed improvements andchangesto
city codes,boards,ordinances,resolutions,and written andunwritten
policiesandpractices of thecity;
(4)Toappear before anygovernmentalor non-governmental agency topresent
findings and recommendations on behalf of the Commission for Women,
as well ason behalf of theCity with theapproval of the City Commission.
(5)Tosolicit contributions,servicesand financial supportfromother
governmental authorities,privatebusinesses,groups,institutionsandtrust
funds;

(6)Toserveasaliaisonorinformal mediator among thecity Commission,the
city administration,thecity employees andtheusers of cityservicesand
facilities.The Commission for Women may consult with representatives
of these groupsfromtimetotimeas necessary tocarryoutthe
Commission,for Women's duties and functions;and
(7)To perform other duties,functions and services as may be assigned toitby
the City Commission.
Section 2.If anysection,clause,sentence,or phrase of this ordinance isforany
reasonheld invalid or unconstitutional byacourt of competent jurisdiction,the holding
shallnotaffectthevalidity of theremainingportions of thisordinance.
Section 3.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are repealed.
Section 4.This ordinance shalltakeeffect immediately upon approved.

The attached Ordinanceisonfor second readingandpublichearingwas
sponsored by Commissioner Mary Scott Russell.It changes the name of the
Commission on the Status of Women to Commissions For Women.

BACKGROUND
The Commission on the Status of Women was established by Ordinance No.7-
97-1628.Each member has demonstrated a commitment toimprovethe
conditionof women throughcommunityand other service.The membership
reflects the racialand ethnic diversityof the residents of the City of South
Miami.
ANALYSIS
The Commissionon the Status ofWomenispetitioning the CityCommissionto
change the name of the Commission to "Commissions For Women."
Commissioner Russell is the Commission Liaison to this Board.
CONCLUSION
Given the fact that thisisavery active and productive Boarditisthe
Commission's desire to comply with this request.First Reading was heldon
May 18,1999.
