AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE
LAND DEVELOPMENT CODE,AMENDING SECTION 20-7.6 (A),
ENTITLED "HOMETOWN DISTRICT PARKING COMMITTEE";
PROVIDING FOR ADDITIONAL MEMBERS;PROVIDING FOR
SEVERABILITY,ORDINANCES IN CONFLICT,AND AN
EFFECTIVE DATE.
WHEREAS,onOctober19,1993,theCityCommissionadoptedOrdinanceNo.19-93-
1545,known as the "Hometown District Overlay Ordinance,"creating Section 20-7.6 inthe
SouthMiamiLand Development Code;and
WHEREAS,inSection20-7.6,theCityCommissioncreatedaHometownDistrict
Parking Committee consisting of fourprivatecitizens,the Mayor andCityCommission;and
WHEREAS,onMay21,1996,duetopossibleconflictswiththeSunshineLaw,theCity
Commission approved Ordinance No.8-96-1608,changingthe Committee's membership to
includeonlyfour private citizensandtheMayor;and
WHEREAS,theCityhasgreatlybenefitedfromtheinputand recommendations of the
Hometown District Parking Committee members;and
WHEREAS,manycitizenshaveexpressedinterestin joining theHometownDistrict
Parking Committee;and
WHEREAS,the Mayor andCityCommission find thatitisinthepublicinterestto
expandtheHometownDistrictParkingCommittee,allowinggreatercitizeninputand
participation;and
WHEREAS,the Mayor andCityCommissionfindthattheCommitteeisbestservedbv
equal representation of residents,downtownpropertyownersand tenants/merchants.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.Section20-7.6(A)of theSouthMiamiLandDevelopmentCodeisamendedas
follows:
Hometown DistrictParking Committee.ParkingintheHometownDistrictmustbe developed
andmanagedprimarilyasanelement of infrastructurecriticaltoenhancingSouthMiami'stax
basethrougheconomicsuccess of thedistrict.Four(4)Ton (10)Six(6)privatecitizensandthe
MayorshallserveastheHometownDistrictParkingCommitteechargedwithoversight of the
supply,convenience,safety,and management of parking.Thefour(4)ton (10)six(6)private
citizensshallbeappointedtotwo(2)yeartermsbythemayorwiththeadviceandconsent of the

Section 3.All ordinances orparts of ordinancesinconflictwiththeprovisions of this
ordinance are hereby repealed.
Section 4.This ordinance shalltakeeffect immediately atthe time of itspassage.

REQUEST
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF

AMENDING SECTION 20-7.6 (A),ENTITLED "HOMETOWN DISTRICT PARKING

BACKGROUND &ANALYSIS
In1993,attheinitial adoption of theHometownDistrict Overlay Ordinance,theCityCommission
createdtheHometownDistrictParkingCommittee,whichwastobecomposed of fourprivatecitizens,
theMayorandCityCommission.InMayof1996,thecomposition of theCommitteewaschangedto
includefourprivatecitizensandtheMayor.Therevisionwasmadeduetopossibleconflictswiththe
SunshineLaw,whicharosefromincludingtheentireCity Commission ontheCommittee.
TheproposedordinancewouldincreasetheCommittee'smembershipbysix,providingforatotalof
tenprivatecitizensandtheMayor,allowinggreatercitizeninputand participation.The ordinance was
approved at the 1st reading and presented to the Planning Board on March 9,1999.The Planning Board
afterconductingpublichearing recommended approval(6-1)ofthe ordinance withsome
modifications.The modifications recommended bythe Planning Boardare incorporated in the
ordinance for 2"reading with additional provisions underlined and provisions removed as double
strickthrough.TheBoardrecommendedanequalrepresentationof residents,downtown property
ownersandtenants/merchants.TheBoard further recommendedthattheCommittee membership be
limited to six citizen membersand the Mavor.
RECOMMENDATION:Approval as modified.

20-7.6 Parking.
(A)Hometown District Parking Committee.Parking in the Hometown District must be
developed and managed primarily as an element cfinn^stracture critical to enhancing South
Miami's tax base through economic success ofthe district Four (4)private citizens and the
Mayor shall serve as the Hometown District Parking (^mmittee charged with oversight of the
supply,convenience,safety,and management ofparking.The four (4)private citizens shall be
appointed to two (2)year terms by the mayor with the advice and consent of the city
commission and shall include one or more landowners)and one or more tenants)from the
district and one or more residents)of South Miami.The director of building,zoning and
community development shall serve as the executive secretary tothis committee.The
committee shall report to the city commission no less than annually nn thu «tnto nf pairing ™
the Hometown District and shall from time to time make recommendations to the city
commission for changes in the parking system,for the fees paid into the Parking Infrastruc
ture Trust Fund,and for the allocation of trust fund monies.
The mayor shall appoint the chairman ofthe committee.Aquorum shall be five (5)members
and an affirmative vote of a majority ofthe members present shall be required to pass upon
any matter the committee recommends.
(B)Required Parking.Within the Hometown District,the following adjustments to the
number of parking spaces required by Section 20-4.4 (B)ofthe Code are provided:
(1)On-street spaces adjacent to a lot shall count toward the parking requirements for that
lot;a partial space longer than eleven (11)feet shall count as a full space.
(2)Where arcades are optional,buildings with arcades shall receive an additional five (5)
percent reduction inthe required numberof spaces.
(3)In addition to the above,one ofthe following may apply:
(a)Two-story buildings shall receive a fifteen (15)percent reduction in the required
number of spaces.
(b)Buildings of two (2)or more stories with uses from two (2)ofthe three (3)use
categories provided hereinunder "Permitted Uses,"each use constituting no less
than thirty (30)percent ofthe gross floor area,shall receive a thirty (30)percent
reduction inthe required numberof spaces.
(c)Buildingsofthree(3)ormorestories with usesfromeachofthethreeuse
categories provided herein,eachuse constituting nolessthan twenty-five (25)
percent gross floor area,shallreceivea forty-five (45)percent reduction inthe
required number of spaces.

HometownDistrict Parking Committee (HDPC).
a.TheBoard agreed thateveryeffortshouldbemadeto balance allinterests,both residents'and
business owners',preferably those owners representing avariety of sectors from the business
community.
b.The Board discussed the number proposed for the HDPC,noting thatitmay prove tobe an
unwieldy number,yet an adequate number is necessary in order to sufficiently represent all
interests and sectors of the community.
c.The Board concurred that the HDPC should be composed of six private citizens and the
Mayor,havingamix of two tenants from the Hometown District,twoormore landowners,two
or more residents.
9.Motion:Mr.Illas moved approval that HDPC membership be established ata maximum ofsix
private citizensandthe Mayor.Ms.Chimelis secondedthemotion.
