WHEREAS,onOctober19,1993,theCityCommissionadoptedOrdinanceNo.19-93- 1545,known as the "Hometown District Overlay Ordinance,"creating Section 20-7.6 inthe SouthMiamiLand Development Code;and WHEREAS,inSection20-7.6,theCityCommissioncreatedaHometownDistrict Parking Committee consisting of fourprivatecitizens,the Mayor andCityCommission;and WHEREAS,onMay21,1996,duetopossibleconflictswiththeSunshineLaw,theCity Commission approved Ordinance No.8-96-1608,changingthe Committee's membership to includeonlyfour private citizensandtheMayor;and WHEREAS,theCityhasgreatlybenefitedfromtheinputand recommendations of the Hometown District Parking Committee members;and WHEREAS,manycitizenshaveexpressedinterestin joining theHometownDistrict Parking Committee;and WHEREAS,the Mayor andCityCommission find thatitisinthepublicinterestto expandtheHometownDistrictParkingCommittee,allowinggreatercitizeninputand participation;and WHEREAS,the Mayor andCityCommissionfindthattheCommitteeisbestservedbv equal representation of residents,downtownpropertyownersand tenants/merchants. BACKGROUND &ANALYSIS In1993,attheinitial adoption of theHometownDistrict Overlay Ordinance,theCityCommission createdtheHometownDistrictParkingCommittee,whichwastobecomposed of fourprivatecitizens, theMayorandCityCommission.InMayof1996,thecomposition of theCommitteewaschangedto includefourprivatecitizensandtheMayor.Therevisionwasmadeduetopossibleconflictswiththe SunshineLaw,whicharosefromincludingtheentireCity Commission ontheCommittee. TheproposedordinancewouldincreasetheCommittee'smembershipbysix,providingforatotalof tenprivatecitizensandtheMayor,allowinggreatercitizeninputand participation.The ordinance was approved at the 1st reading and presented to the Planning Board on March 9,1999.The Planning Board afterconductingpublichearing recommended approval(6-1)ofthe ordinance withsome modifications.The modifications recommended bythe Planning Boardare incorporated in the ordinance for 2"reading with additional provisions underlined and provisions removed as double strickthrough.TheBoardrecommendedanequalrepresentationof residents,downtown property ownersandtenants/merchants.TheBoard further recommendedthattheCommittee membership be limited to six citizen membersand the Mavor. (B)Required Parking.Within the Hometown District,the following adjustments to the number of parking spaces required by Section 20-4.4 (B)ofthe Code are provided: (1)On-street spaces adjacent to a lot shall count toward the parking requirements for that lot;a partial space longer than eleven (11)feet shall count as a full space. (2)Where arcades are optional,buildings with arcades shall receive an additional five (5) percent reduction inthe required numberof spaces. (3)In addition to the above,one ofthe following may apply: (a)Two-story buildings shall receive a fifteen (15)percent reduction in the required number of spaces. (b)Buildings of two (2)or more stories with uses from two (2)ofthe three (3)use categories provided hereinunder "Permitted Uses,"each use constituting no less than thirty (30)percent ofthe gross floor area,shall receive a thirty (30)percent reduction inthe required numberof spaces.
