A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE
STORMWATER USER FEE RATES AND SETTING THE FEE RATES.
WHEREAS,the Mayor andCityCommission of theCity of South Miami
established a Stormwater Utilityin October 2000forthe furtherance of stormwater
management goals throughout theCity;and,
WHEREAS,Florida Statues section403requirestheCitytoestablishafeerate
sufficienttoplan,staff,construct,operate andmaintainthelocal stormwater management
system;and,
WHEREAS,the Mayor andCityCommission approve the City Manager's
recommendation tokeepthe stormwater UserFeeRate of $3.00 per Equivalent
ResidentialUnit (ERU)permonth,andanOutfall Monitoring Fee of $1,000.00 per
subject property withanoutfallperyear.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Section 1.The Mayor andCityCommissionherebysetsthe Stormwater User
Fee rate at $3.00 per ERU per month.
Section 2.TheMayorandCityCommissionherebysetsthe Stormwater
OutfallMonitoringFeerateat$1,000.00persubjectpropertywithaprivateoutfallper
year.
Section 3.This resolution shall be effective October 2001 and be enforced
,2001.

STORMWATER USER FEE
RATES
REQUEST
The attached resolution would set billing ratesforthe Stormwater User Fee Trust Fund under the
City's Stormwater Utility which was created in October 2000.
BACKGROUND
Currently,eachresidentandbusinessownerisassessed "stormwater userfees"originally
establishedbytheMiami-DadeCountyStormwaterUtility.Thesefees,requiredbyFlorida
Statutes,areessentialtoplan,staff,construct,operateand maintain alocal stormwater
management system.Inasmuch,this revenue sourceissetasideforsuchactivitiesasstormdrain
cleaning,newdrainagesystem construction,andvariouswaterqualityinitiativesrequiredunder
the National Pollutant Discharge Elimination System (NPDES).
RECOMMENDATIONS
TheCityCommissionapprovedafeerateof$3.00perERU(equivalentresidentialunit)per
month forFiscalYear 2000/2001.This translates to $36.00 per year fora typical residential
household;commercial sitesare assessed feesbasedupon their impervious area.
Itisrecommendedtokeepthefeerateatthepreviouslyapprovedrate of $3.00perERU,an
amountwellbelowtheindustryaveragerate of $3.24perERU.It should alsobenotedthatthe
Countyhasincreasedtheirfeeratefrom$2.50to$3.00perERU.
Likewise,itisproposedtomaintainthe"outfall"(drainagesystemsthatdischargerainwaterto
canalsormunicipalstormdrains)at$1,000.00peryear.These stormwater outfallsrepresentan
unconstrainedpotentialsourceforpollutionfromuntreatedstormwaterrunoff,andmust
therefore be monitored by the City for NPDES compliance.

Thisoutfall monitoring feecouldbeavoided if thesubjectsites decided to eliminate theoutfalls,
andnoticeswillbesenttoeachsitegivingthemtheopportunitytomodifytheirdrainagesystems
before any feesare assessed.A list of sites with known outfalls is attached for reference.
Approval of the attached resolution is therefore recommended.
