WHEREAS,Application No.PB-01-019 was submitted to the Planning and Zoning Board by
the City of South Miami,said application requesting approval of a variance from Section 20-3.5 (c)(3)and
Section 20-3.5 (e)ofthe Land Development Code to allow the height ofthe Murray Park Recreation Center
to be 35'8"where a maximum height of25 feet is allowed,on property specifically located at 6701 SW 58
Place,SouthMiami,Florida;and
WHEREAS,the City's proposed Murray Park Recreation Center building will be a two
story multipurpose building which will include a full sized regulation high school basketball court,
which requires an unobstructed ceiling height of 25 feet,which will result in the roof of the
Recreation Center having a building height of 35'8";and
WHEREAS,Murray Park is located within the "PR"Parks and Recreation which permits
various maximum building heights,depending on the surrounding zoning districts;at this subject
location,a maximum of 25 feet would be permitted,resulting in the subject height variance
request;and
WHEREAS,the approval ofa variance requires a recommendation from the Planning Board and
the approval of the City Commission after a public hearing;and
WHEREAS,on October 30,2001 the Planning Board,after public hearing,voted 7to0to
recommend approval ofthe variance request;and
WHEREAS,the Mayor and City Commission ofthe City of South Miami desire to accept the
recommendation of thePlanningBoard.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1:That the subject application submitted by the City of South Miami,requesting approval ofa
variance from Section 20-3.5 (c)(3)and Section 20-3.5 (e)of the Land Development Code to allow the
height ofthe Murray Park Recreation Center to be 35'8"where a maximum height of25 feet is allowed,
on property specifically located at 6701 SW 58th Place,South Miami,Florida,is hereby approved.

Section 2.That the approval of the subject variance is based upon the following findings:
a.The requirement ofa 25-foot height limit is an exceptional hardship which would
prevent the construction of the gymnasium/basketball court in the Murray Park
Recreational Center.The citizens of South Miami would be denied theuseofa
valuable community asset.
b.The variance requested is the lowest possible height which would allow
construction of the proposed gymnasium and would have minimal impact on
surrounding properties.
c.The variance request is a unique situation that would not be applicable to any other
properties inthe immediate vicinity.
Section 3.This resolution shall be effective immediately after the adoption hereof.

SUMMARY OF REQUEST
The applicant,theCityofSouth Miami,is proposing the construction ofa recreation centerat
MurrayParkaspartofaPhaseII Building program.The Recreation Centerbuildingwillbeatwo
story multipurpose buildingwhichwill include a full sized gymnasium/basketball court.A
regulation high school basketball court will result inaroof height of35 feet.Murray Parkis
located withinthe "PR"ParksandRecreation Zoning District.ThePR district permits various
maximumbuildingheights,dependingonthesurroundingzoningdistricts;atthissubject

BACKGROUND &ANALYSIS
The"PR"zoningdistrictpermitstheconstruction of arecreationcenter.TheLandDevelopment
Codelimitstheheight of abuildinginthisdistricttothe most restrictive heightlimitsetforthfor
adjacentsurroundingzoningdistricts.MurrayParkissurroundedbyfourzoningdistricts:PI-
PublicInstitutionaltotheeast;LOLowIntensityOfficetothesouth;RM18-Low DensityMulti-
Familytothewest;andRS-4-SingleFamilyResidentialtothenorth.Themostrestrictedheight
limit of thesurroundingdistrictsisthemaximum25footheight of theRS-4zone,andtherefore
appliestothislocation.The City's applicationreferencesthenationalstandardsforaregulation
highschoolbasketballcourt,whichisan unobstructed height of 25feet.Duetothedimensions
ofthecourt,theplacement of thebleacherseating,andspaceneededfortheroofdeck
assembly,theroofheightwillneedtobe 10 feetabovethe unobstructed courtheight of 25feet.

motion was adopted bya vote of7 ayes and 0 nays.
The Planning Board amended their approval motion to add a request that the City Commission
address resident Mercedes Asher's concerns about the barricade at SW 66 Street and SW 58
Place-and also to address a permanent solution to the above-referenced streets.The motion was
made'by Mr.Mann and seconded by Ms.Yates.The motion was adopted by a vote of 7ayes and
0 nays.
RECOMMENDATION
Itis recommended thatthevariancerequestbe approved.

(A)Expiration of Variance Approvals.A variance approved pursuantto
Section 20-5.5 shall lapse after six (6)month if no substantial
construction orchange of usehastaken place in accordance with
the request for such variance and if the city commission hasnot
specified a longer approval period for goodcause shown.
(B)Extension of Variance Approvals.Four (4)affirmative votes of the
city commission may grant an extensiontoa previously approved
variance if a proper and timely request is made bythe applicant
prior tothe expiration of the six (6)month period.
(C)Hardship Statement.All applications for a variance shall include
a letter of intent indicating the specific nature of the hardship
upon which the request is based.

include a current property survey prepared by a registered
surveyor.

(E)Neighborhood Concurrence.All applications foravariance shall be

the subject property.The applicant shall obtain and submit the

owners,indicating their awareness of and concurrencewiththe
proposed variance request.
(F)Proposed Site Plan Required.A site plan shallbe required showing
all proposed buildings and setbacks and any other features
relating to the variance request.
(G)Permitted Variance Requests.Applications for variances shallbe
restricted to only the following:
(1)Yard setbacks
(2)Lot size
(3)Lot coverage
(4)Building height
(5)Fences and walls
(6)Impervious coverage
(7)Off-street parking
(8)Open space

(h)The board shall review and make recommendations on all
applications for variances from the requirements of this Code for
yard setbacks,lot size,lot coverage,building height,fences and
walls,impervious coverage,off-street parking,open space,signs
and landscaping.Recommendations for a variance shall be made only
when necessary to relieve particular hardships or extraordinary
conditions relating to a specific property,and when the strict
application of a particular regulation would result in peculiar
and exceptional hardship upon the owner of such property as
distinguished from reasons of convenience,profit or caprice.

Project Overview
Throughaseries of public 'workshops'andTownHallmeetings,City staff andneighborhood
interestgroups formulated amasterplandefiningthelongterm development of MurrayPark.When
completed,MurrayParkwillfunctionasamultipurposecenterofferingawidevariety ofrecreational
and support servicestotheMurrayPark community andthe community-at-large.
TheMurrayParkPhase2 component of themasterplanwilldeliveraRecreationCentercomprised
of anenclosedairconditionedgymnasiumintegralwithatwostoreymultipurposebuildingwhich
housesartsandcraftsspace,acomputerlab,afitnessexerciseroom,andavariety of administrative
offices and support functions.
Justification for Change/Statement of Hardship
TheCity of South Miami's Official Zoning Map identifies MurrayParkasa PR-Parks and
Recreationzonedpiece of property.Itis surrounded byfourdistinctlydifferentzoning districts
including Pl-Public/Institutional totheeast,LO-Low Intensity Officetothe south,RM18-Low
DensityMulti-Familytothewest,andRS4-SingleFamilyResidentialtothenorth.
The South Miami Land Development Code limits the height ofany building erected onaPR zoned
propertytothat associated withthemost restricted adjacent zoningdistrict.Themost restricted
zoning district adjacent to Murray Park isthe RS4-Single Family Residential tothe north.In this
district,buildingheightislimitedto 25'.
Note:houses in this particular RS4 zone typically have a pitched roof.When pitched roofs are used,
the SMLDC defines the maximum allowable height as "the vertical distance from grade to...the
average height between the high and low points ofa pitched roof."This means that the actual height
ofa pitched roofmeasured from grade to the ridge line exceeds 25'.
Nothing in the South Miami Land Development Code prohibits the construction ofa Recreation
Building on a PR-Parks and Recreation zoned piece of property.The Recreation Building proposed
for Murray Park includes a regulation in-door highschool basketball court.The minimum
unobstructed height for this type of court environment,as defined in the National Federation of State
High School Associations'Court&Field Diagram Guide,is 25'.
The minimum required court dimensions are 84*long x50'wide.Add to these dimensions a10'open
cu-culation/overrun space on all four sides,and the overall gymnasium footprint increases to 104'x
70.Bleacher seating for this project increases the gymnasium width to approximately 80'This 80'
gymnasium width requires along span roof framing structure that is approximately 5'deep This
combined with the roof deck assembly and aniinimum roof parapet,will add an additional 10'ofheightabovethe25'unobstructed court height;placing the top of parapet at approximately 35'above
Conclusion
The Murray Park master plan development is organized around an aggressive building program
offering awide variety of recreational and support services to the Murray Park Community and the
commumty-at-large.The Phase 2 building program represents the culmination of an intense
collaborative effort of city staff and neighborhood interest groups.A key component of the phase
2 building program is the regulation in-door highschool basketball court.In order to realize this
valuable community asset,the City must grant avariance from the 25'maximum height limit
imposed on the Murray Park Recreation Center;and permit aheight of 35'-8'\

Mr.Carlson gave a detailed presentation of the Recreation Center project,emphasizing that
the variance requested herein is essential in order to comply with national standards for a
regulation high school basketball court,which is an unobstructed height of 25 feet.Due to
the dimensions ofthe court,the placement bleacher seating,andspace needed fortheroof
deck assembly,the roof height will need tobe 10 feet above the unobstructed court height
of 25 feet.
ResidentMercedesAsheraddressedtheBoardonthesubject of the barricaded streetwhere
she resides,which is adjacent tothe Murray Park Multipurpose Center project.Since Ms.
Asher's subject constitutes a separate issue from the proposal discussed bythe Board at
this meeting,staff and Board recommended to Ms.Asher that she appear before the Cit£
Commission with her request to install a "No Outlet"sign at SW 66th Street and SW 58"*
Place.
