A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI,FLORIDA,RELATING TO 2002 LEGISLATIVE PRIORITIES;
APPROVING LEGISLATIVE PRIORITIES;DIRECTING CITY MANAGER TO
FORWARD LEGISLATIVE PRIORITIES TO APPROPRIATE ENTITIES;
PROVIDING AN EFFECTIVE DATE.
WHEREAS,theMayorandCityCommission of theCity of SouthMiamihaveidentified
Stormwater DrainageImprovements.WaterDistributionSystem Improvements.DanteFascellPark
Improvements.Acquisition of theHammockHouse Property,ContinuedfundingforthePARE Program.
Senior Citizen Services,Acquisition of an Emergency Mobile Command Center and Renovations tothe
EmergencyOperationsCenter,andthe USl PedestrianOverpassasprioritiesforthecurrentyear;and
WHEREAS,theFloridaLegislaturewillbemeetingshortlytopreparethe State's budget;and
WHEREAS,the Mayor andCity Commission desiretoseekfunding through theLegislative
processto accomplish theidentifiedimprovements;and
WHEREAS,FloridastatuterequiresthatallentitiesrequestingStatefundingholdapublic
hearingbeforeabody of dulyelectedpublicofficialsbeforeafundingrequestcanbesubmittedtothe
Legislature.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA;
Section I.The following legislative priorities havebeen approved for forwarding to
theFlorida Legislature:Stormwater Drainage Improvements.Water Distribution System Improvements.
DanteFascellPark Improvements.Acquisition of theHammockHouse Property,Continued fundingfor
thePARE Program,Senior Citizen Services,Acquisition of an Emergency Mobile Command Center and
Renovations tothe Emergency Operations Center,andthe USl Pedestrian Overpass.
Section 2.The City Manager's office is hereby directed to forward Legislative Priorities
attached as Exhibit "A"to appropriate entities.
Section 3.This resolution shalltakeeffect immediately upon approval.

BACKGROUND AND ANALYSIS
AnewFloridaStatuterequiresthatallagenciessubmittingfundingrequeststotheFloridaLegislature
holdapublichearingtodiscussitslegislativeandfundingprioritiesfortheLegislativeSession.Our
fundingprioritiesfortheupcomingsessionareasfollows:Stormwater DrainageImprovements.Water
DistributionSystem Improvements,DanteFascellParkImprovements,Acquisition of theHammock
HouseProperty,Continued fundingforthePAREProgram,SeniorCitizenServices,Acquisition of an

Background and Justification
Thepurposeof this appropriations request isto receive the necessary funding to upgrade the City-of
South Miami's stormwaterdrainagesysteminorderto eliminate or significantly reducepollutant
loading to water bodies from the direct discharge of stormwater runoffandprevent local flooding
eventsbyprovidedrainagesystem citywide.
RecentrequirementsmandatedbytheFederalandState Government haveaffectedthe
environmentalandfloodprotection responsibilities ofallmunicipalandlocalgovernments,
including theCity of South Miami.Themost critical oftheserecentrequirementsisthe
EnvironmentalProtection Agency's National PollutionDischargeElimination System (NPDES)
ProgramandFlorida's implementation of this programviaSection 403.0885 ofFlorida Statutes.
InordertoevaluatetheCity'scompliancewiththeserequirements,theCity of SouthMiami
commissionedacomprehensiveengineeringstudytoidentifyanddetailprioritystormwaterdrainage
projects.Thecomprehensive engineering study,the basis fortheCity of South Miami Stormwater
CapitalImprovementsProgram,foundthattheCitycontains32 municipally-owned stormwater
outfallswhichdischarge untreated stormwaterintowaterwaysthatflowintoBiscayneBayanddo
notcomplywith NPDES programstandards;andlocalizedfloodingeventsoccurintheCityat
significantexpensetocitizens.ThestudyprioritizedtheprojectsnecessarytoupgradetheCity's
stormwater drainagesystemtocomplywithallapplicableFederal,Stateandlocallawand estimated
thetotalcapitalcost of theupgradeat$1,700,000.
Appropriation Request
The funding of these additional critical components of this environmental project is clearly beyond
the City's financial ability and will require assistance from the State.With $1,700,000,the City will
beabletoperformthemuch-needed service fortheproject.

Background and Justification
The City ofSouth Miami isan established community intheheartofurban Miami-Dade County.
The majority of theCitywas developed priortothe 1960s,whensurroundingcommercialand
residentialdensitieswerelowandinhabitantsreliedupontheirownpropertytoprovidedrinking
waterthrough shallow wells andto filter wastewater through septic tanks,often located nexttoeach
other.Since thattime,however,thesurrounding landscape has dramatically changed.The City of
South Miami isnowthecenter of a very denseandpopulatedurbancore.Higherdensityandthe
presence ofmore intensive landuseshave severely taxed thenaturalenvironment's ability toprovide
cleandrinkingwaterandfilter wastewater.Asaresult,inhabitantsnowturntolocalgovernmentfor
theprovision of drinkingwaterandwastewatercollectiontoensurepublichealthandtosafeguard
theenvironment.Inaddition,thesepartsofthe City ofSouthMiamidonothave fire hydrants.
Withoutfire protection,itisverydifficultforthelocalFire Department tosavelivesand protect
propertiesduringroutine fire calls.
Themajority of theCity of SouthMiamiwasdevelopedpriorto the construction of Miami-Dade
County'swaterandsewersystem.Consequendy,manyoftheCity'sresidential neighborhoods still
relyupon wells toprovidefordrinkingwaterneeds.Unfortunately,thesignificantstress put onthe
aquiferbyurbanizationhasresultedindeterioratingwater quality.Providing high-quality municipal
waterandfire protection are of utmostimportanceforourresidents.
Appropriation Request
Potable drinking waterand fire protection continue tobetheCity's most pressing needs.
Ourrecent citywide studyshowedthatwecouldbringourresidentialareason-linewithCountv
waterforapproximately$2,000,000.

Background and Justification
The City-ofSouth Miami hasmadea significant commitmenttopreservingandenhancingits
recreationalresources.TheCity,with assistance fromseveralfundingsources,isrenovatingeach of
its parks,whichhadsufferedfrom neglect for several decades.Substantial improvements are
planned for Fuchs Park,which -because ofits location along RedRoad (SW 57n Avenue)near
Kendall Drive —serves thousands of residents and visitors each week.
This legislative requestwould allow for substantial renovations to take place,including improving
theinadequate drainage systeminthepark'sparkinglotandtenniscourts;purchasingADA-
accessible playground equipmentand picnic tables;resurfacing thetennisandhandballcourts;
demolishing the existing substandard restrooms and constructing newones;making the playground
equipment and pavilions wheelchair-accessible;resurfacing the exercise path/walkway that travels
throughoutthepark,and replacing or repairing the individual exercise stationsalongthepath.
ThisappropriationsrequesthasbeensubmittedtotheDepartment of EnvironmentalProtectionfor
rankingintheFloridaRecreationDevelopmentAssistanceProgram.

Background and Justification
TheCitv of SouthMiamihasmadea significant commitmentto preserving andenhancingitsrecreational
resources.Inordertoexpand recreational opportunitiesforourresidents,theCityintendstopurchasea1 \U
acre parcel located at 7800 SW 59th Avenue.The parcel -known as Hammock House -is lushly landscaped
andis located ina growing urban area.Hammock Houseisa natural woodedareawithdozensoffruit trees
and exotic plants.Thepurposeofthisprojectisto purchase thepropertyand recreate a natural hardwood
hammock.Thepropertycontainsasmall building thattheCityintendstouseasaNatureCenter.
The propertyisregisteredwiththeNational Audubon Societyasawildliferefuge,andtheownerof
thepropertv receives frequent visitors.A geologist/biologist has studied thepropertyandhas determined
thatitcontainsatotal of about300native tropical hardwoodtreesandshrubs of 96differentspecies.There
arealso approximately 50native species of vines,wildflowers,palms,cycads,and ferns.Residentsofthe
refuge include raccoons,opossums,squirrels,snakes,various species ofbirdsand butterflies.
Thepurchaseofthisparcel will serve several important function?,including:
•providingrecreationalopportunitiestothousandsof residents and visitors;
•allowingthe development of nature trails fornaturestudy,abutterflyfarm,adwarffruit-tree
demonstration area,andwildlifedisplayrooms;
•presentingoneofthefewnaturalareasinthecenterofMiami-Dade County-,and
•enhancingthe liveability andcharacter of anareawhereresidentsandvisitorscanexperienceanattractive
andfunctionalmix of living,working,shopping,andrecreational activities.

Background and Justification
The City ofSouth Miami haslongbeencommittedto juvenile crimepreventionthroughits
operationofitsafterschool program,atutoringandmentoringprogramwhichhas invaluably
servedtheschoolchildren of theCitvofSouthMiamisince 1970.During thistime,the program's
tutors,mentors and volunteers haveenabledthousands of at-risk children toachievepositiveself-
expression,interpersonal skills and academic competence and avoid criminal behavior.
In 1998,the City7 of South Miami expanded its juvenile crimepreventioneffortsbycreatingthe
PreventionthroughAcademicand Recreational Excellence (PARE)program.PARE strives to
"pare"thenumberofSouth Miami children entering the juvenile justice system by (1)increasing the
number of schoolchildren servedby The After School Home and (2)reachingadditional schoolchildren
throughformal recreation programs.
Withhelpfroma2000State Legislative appropriation,PAREwasabletoexpandto3locationsand
serve approximately 250South Miami schoolchildren.Agreat majority of thechildrenresideinan
areaoftheCityknownasLeePark.LeeParkisanurbanresidential neighborhood comprised of a
predominantly minoritypopulationwhich experiences many of thesocioeconomicproblems
associatedwiththeurban/inner-cityenvironment,includingcrime,drugs,single-parent families,
truancy andahighdrop-outrate.Asa result,PARE serves thehighestcategoryofat-risk children.
Ninetypercent (90%)of theenrolledchildren live in Federally-assisted and HUD housing.Eighty-
five percent (85%)havealearning disability-,reading deficitorattentiondisorder.
What'smore,earherthissummer,theCityofSouth Miami wasawardedthe prestigious All-America
City Award bytheNational Civic League.Thishonoris bestowed upononly 10 cities each year,and
isbasedonacommunity's ability tounitetheefforts of itsstaff,elected leaders,nonprofits,business
community-andresidentsinordertoovercomemajor challenges.PAREwas singled outbythe
National Civic League judging panel asa program thatother communities should emulate;the
success ofPAREisoneofthe primary reasons why South Miami isan All-America City.
PAREhas significantly reduced the number of children entering the juvenile justice system,but
unfortunately,the program didnot receive funding during the State 2001 Legislative Session.
Personnelcutshavehadtobe made.The City hopesthattheprogramcanonce again helpgreat
numbersofchildreninneed,modernizeprogrammingandprovideabroaderarray of services.The
Cityhasmadea significant commitmentto realize this hope.
The Legislative RequestwouldenablePAREto (1)serveanadditional200students;(2)modernize
programming;and (3)provideabroaderarrayof services.
Most juveniles are adjudicated throughtheState system atgreatexpensetoFlorida taxpayers.
PAREhasdemonstratedits ability to significandy reducethenumberofSouthMiami
schoolchildrenenteringthe juvenile justice system.Statefundingwillenableagreaternumber of
childrentobeservedandwillenhancetheoverall quality of sendee,therebyfurtherreducingthe
number of childrenenteringtheStatesystemandtheassociatedcosts.

The City is requesting a $200,000 appropriation tocontinuetoprovide critically neededstaffingand
programming forits Prevention through Academic and Recreational Excellence (PARE)Program.

Background and Justification
Our Senior Center houses 96 low-income,predominantly-minority seniors,and hundreds more live
in the City of South Miami.All seniors benefit from a variety of activities that address their special
physical and emotional needs.Lin fortunately,the City has not been able to provide a number of
programs crucial to seniors'needs.With this funding,the City would be able to offer seniors several
crucial components.
•Lunch is currendy offered to them each Monday -Friday.For many seniors,this is the only
meal they receive during the day.The City also would like to be able to offer them a healthy
breakfast.
•Additionally,a full-time Social Worker can help seniors copewiththeir emotional needs.
•The acquisition ofa 24-passenger bus and the services ofa licensed bus driver will facilitate the
transferofseniorstotheSeniorCenterand will allowustobeabletotaketheelderlytodotheir
groceries andseetheirdoctors.
•Exercise classes and assistance with personal grooming and haircuts are essentials that we can be
providetothe seniors at little cost.
Idle seniors often lose the will to Hve,and these important basics would help the City-to help our
seniorscontinuetheir days withhealthand dignity.

The City is requesting a $250,000 appropriation to provide critically needed staffing,transportation,
and programming for its Senior Citizens Center.The provision of these services ultimately yields
large savings in Medicare,Medicaid,welfare and food stamps.

Background and Justification
TheCity of SouthMiamihaslimited access inborrowing emergency equipmentforcatastrophic events.
Therefore,weareaskingforapprovalforprojectsthatwebelievewilloverallassisttheCity of SouthMiamito
betterrespondto emergencies and/or catastrophic events.Thisresponse will assistnotonlythe residents of
SouthMiamibutalsotheresidentsinsurrounding communities suchasunincorporated Miami-Dade County,
West Miami,CoralGables,the University of Miami,and Sweetwater.Thisalsowouldassistusinrespondingto
disastersin other areas of theState of Floridathatrequestourhelp.
SinceHurricaneAndrewin1992,Miami-DadeCountyhasexperiencednumeroushurricanes,tropicalstorms,
tropical depressions,unnamedstorms,and several situations involving civil unrest.Thewesternandsouthern
portionsofthisCountyhave experienced heavy to severe flooding,heavy winddamage,andnumerouspower
outagesrangingfrom10minutestoaslongas48hours.Often,theCity of SouthMiamihasbeen called onto
aidourneighboring communities in times of natural andman-made distress.Froma logistical and geographic
pointof view,theSouth Miami City Hall/Police Complex is centrally locatedasfaras Miami-Dade Countyis
concerned.This allows ourPoliceDepartmenttorespond effectively and efficiently during emergencv
situations.AsmuchaswewouldliketorelyonassistancefromMiami-DadeCounty,itis apparent thatwhen
multiplecatastrophiceventsoccureach year,theCity of SouthMiamihasaresponsibilitytoitsresidentsandto
neighboringcommunitiestobewellpreparedandprovidethebestservice available.

TheCity of SouthMiamiisproposingthepurchase of an Emergency Mobile Command Center.This will
addresstheissue of havinganon-siteincidentcommandcenter available toimmediatelyassessaffectedareas
duringcatastrophicevents.The Emergency Mobile CommandCenterisaconvertedmobilehomesetto
standardspecifications of thepolicedepartment.Theoutsideoftheunitwillbeclearlymarkedandinclude full
emergency response lighting,equipment,and generators.Theinterior will havea command/meeting area,full
communicationssystemswhichincludespoliceandpublicworksradiosystems,asatellitedishcommunications
system,acopy machine,a fax machine,a television/VCR,a computer,telephone service,anAM/FM radio,
officesuppliesand supplies foraprotracted event.
Inaddition,tobetter facilitate andexpeditethe handling of emergency situations,theCityofSouth Miami
proposesupgradingthe Emergency Operations Center housedintheCityHallComplexbyenhancingits
communicationsandsecurity capabilities.Theproposedupgradesincludeapowergenerator;acrisishotline
link-up;additionaltelephonesand telephone lines;TVs;computers;andconcommitant electrical upgrades.

Background and Justification
TheCity of South Miami'scommercialdistrict,onceasmall,mostlyretail sector cateringprimarilytoits
residents,hasbecomeavibrant,youthful,mixed-usedowntownattractingbothlocalsandvisitors.Replete
with entertainment venues,restaurants,andspecialtyshops,thisrejuvenated downtown promisestosustain
itsgrowthintothe foreseeable future.This popularity,however,hasplacedastrainontheCity's ability to
accommodatetheincreaseinpedestrianand vehicular activity.Accordingly,theCityofSouth Miami has
focused attention onalleviatingvehicularcongestionwithinthe downtown andneighboringresidential
districts bypromotingmasstransportationandconvenient pedestrian movementasviable alternatives.
TheSouth Miami MetrorailStationisan existing masstransportationhubincluding access toMetrorailand
Miami-Dade buses.Thistransportation terminal alsocontainsa five-level parking garage.The garage is
currentlyunderutilizedandcouldbetappedasan additional sourceofparkingfortheoverburdened
downtown.Unfortunately,Dixie Highway's six-lane north/south roadwayimpedestheCityfrom fully
utilizing boththestationandtheparking garage.Pedestrians areforcedto quickly negotiate a lengthy
crosswalk.TheCityofSouthMiami believes thatapedesmanoverpass will safely and effectively mitigate the
physical and psychological barrier created by SR5/US1.Additionally,the City hopesto increase accessibility
tothe Metrorail,makingthismodeofpublictransportationasafeandconvenientalternative to driving.
Appropriation Request
Toaddressthisissue,theCitycommissionedalocalarchitecturefirmtoprepareastudyinconjunctionwith
the Metro-Dade Transit Agency (MDTA),the Metropolitan Planning Organization (MPO).andthe Florida
Department of Transportation (FDOT).The study shows thatthe entire project can be completed for
approximately $6,228,355.The City has been successful in obtaining 31.5 million from MDTA and
53,115,178 fromtheCounty Incentive Grant Program (CIGP)administered byFDOT.We respectfully
request thatthe Legislature support the funding assigned tous via the County Incentive Grant Program and
thatthe Legislature allocate $1,614,177,thereby bringing this much-needed project to fruition.
