A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO
PERMIT FEES;ELECTING NOT TO REQUIRE AND COLLECT
PERMIT FEES FROM PROVIDERS OF COMMUNICATIONS
SERVICES AND ELECTING TO INCREASE LOCAL
COMMUNICATIONS SERVICES TAX;PROVIDING FOR
NOTICE TO THE FLORIDA DEPARTMENT OF REVENUE;
PROVIDING FOR SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS,section 337.40l(3)(c)l.,FloridaStatutes(2000),requireseach
municipalitytomakeanelection regarding thepayment of permitfeesby
providers of communicationsservicesandfurtherrequireseachmunicipalityto
informtheDepartment of RevenueoftheelectionbycertifiedmailbyJuly1,
2001;and,
WHEREAS,amunicipalitymayrequireandcollectpermitfeesfromany
providers of communicationsservicesthatuseoroccupymunicipalroadsor
rights-of-way fortheprovision of communicationsservices.However,toensure
competitiveneutralityamongproviders of communicationsservices,a
municipalitythatelectstoexerciseitsauthoritytorequireandcollectpermitfees
will have an automatic reduction in the rate of the local communications services
taxforthe municipality,as computed undersection202.20(1)and(2),Florida
Statutes(2000),asamended,byarate of 0.12%;and,
WHEREAS,alternativelyamunicipalitymayelectnottorequireand
collectpermitfeesfromanyprovider of communicationsservicesthatusesor
occupiesmunicipalroadsorrights-of-wayfortheprovision of communications
services.If themunicipalityelectsnottorequireandcollectpermitfees,thetotal
rateforthelocal communications servicestaxascomputedundersection
202.20(1)and(2),FloridaStatutes(2000),as amended,forthatmunicipality
maybe increased by ordinance byanamountnotto exceed arate of 0.12%;and,
WHEREAS,section 34,Enrolled CS/CS/SB1878bythe2001 Florida
Legislature further amends section 337.401(3)(c)l.,Florida Statutes (2000),to
statethatthe Department of Revenuemustbe informed of a municipality's
electionby certified mailpostmarkedonorbeforeJuly 16,2001;and,
Additionsshownbyunderlininganddeletionsshownby ovorstriking.
WHEREAS,section 34,Enrolled CS/CS/SB 1878 by the20001Florida
Legislaturefurtherprovidesthat if a municipality electsnottorequireandcollect
permitfeesfromanyprovider of communicationsservicesthatusesoroccupies
municipal roadsor rights-of-way fortheprovision of communications services,
thetotalrateforthelocal communications servicestaxas computed under section
202.20(1)and(2),FloridaStatutes(2000),as amended,forthat municipality may
beincreased by ordinanceorresolution by anamountnottoexceedarate of
0.12%.Thebillfurtherprovides if a municipality electstoincreaseitsrate
effective October 1,2001,the municipality shall inform theDepartment of
Revenue of suchincreasedrate by certified mailpostmarkedonorbeforeJuly16,
2001;and,
WHEREAS,section 337.40l(3)(c)l.,Florida Statutes(2000),further
providesthat if amunicipalitydoesnotmakeanelectionand notify the
Department of Revenue,itis presumed thatthemunicipalityelectsnotto require
andcollectpermitfeesfromany provider of communicationsservicesthatusesor
occupiesmunicipalroadsorrights-of-wayfortheprovision of communications
services,andsuch municipality willbeauthorizedtoincreaseitstaxrate by an
amount not to exceed arate of 0.12%;and,
WHEREAS,whateverelectionthemunicipalitymakes,suchelectionshall
take effect on October 1,2001.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Section1.Intent.Itistheintent of theCity of SouthMiamitomakean
electionundersection 337.40l(3)(c)l.,Florida Statutes(2000),asamended by
section34,Enrolled CS/CS/SB 1878bythe2001FloridaLegislature,regarding
the City's decisiononwhethertorequireandcollectpermitfeesfromany
providers of communications servicesthatuseor occupy municipalroadsor
rights-of-way fortheprovision of communicationsservices.
Section2.Election Not toRequireandCollectPermitFees.TheCity
electsnottorequireandcollectpermitsfeesfromanyprovider of communications
servicesthatusesoroccupiesmunicipalroadsor rights-of-way fortheprovision of
communications services.As providedinsection 337.401 (3)(c)L,FloridaStatutes
(2000),this election shalltake effect October1,2001.
Section 3.Election to Increase Local Communications Services Tax.
Pursuantto section 337.401(3)(c)l.b.,FloridaStatutes(2000),as amended by
section34,Enrolled CS/CS/SB 1878bythe2001FloridaLegislature,theCity
elects to increase its total rate for the local communications services tax as

computed under section 202.20(1)and(2),Florida Statutes (2000),as amended,
by an amount of 0.12%,andthis election shall take effect October 1,2001.
Section 4.Notice tothe Department of Revenue.TheCityClerkis
directed togive notice of theabove elections tothe Depaitment of Revenue by
certified mail by July 16,2001.
Section 5.Severability.If any section,clause,sentence,or phrase of
this resolution isforanyreasonheldinvalidor unconstitutional byacourt of
competent jurisdiction,the holding shallnotaffectthe validity of theremaining
portions of this resolution.
Sectioon 6.Effective date.This resolution shalltake effect immediately
upon approval.
