A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA AUTHORIZING
THE CITY MANAGER TO ENTER INTO A MUTUAL AID
AGREEMENT WITH THE CITY OF HALLANDALE POLICE
DEPARTMENT,ON BEHALF OF THE CITY OF SOUTH MIAMI
POLICE DEPARTMENT PURSUANT TO SECTION 23.1225 (3),
FLORIDA STATUTES.
WHEREAS,Chapter 23,FloridaStatutes,the Florida MutualAidAct,
requirestheauthorizationbythegoverningbody of themunicipalitybeforea
MutualAidAgreementmaybeenteredintobytheMayororthe chief executive
officer of themunicipalityon behalf of alawenforcementagency;and
WHEREAS,thereistheexistingand continuing possibility of the
occurrence of lawenforcementproblemsandothernaturalandman-made
conditionswhichareorarelikelytobebeyondthecontrol of theservices,
personnel,equipment or facilities oftheCity of SouthMiami and/or the
aforementioned entity;and
WHEREAS,tomeettheresponsibility of the respective governmentsto
ensure thepublic safety of their citizens by providing adequate levels of police
services,preparation mustbe ensured toprotectthepublicpeaceandsafetyandto
preserve thelivesand property of the people inthelisted jurisdictions;and
NOW,THEREFORE,BEITRESOLVEDBYTHE MAYOR ANDCITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Section1.TheCityManager of theCity of SouthMiamiisauthorizedto
enterintoaMutualAid Agreement inaformacceptabletotheCityAttorney,with
theCity of Hallandale Police Department onbehalf of theCity of SouthMiami
PoliceDepartmentpursuanttoSection23.1225(3),FloridaStatutes.
Section 2.That this resolution be effective immediately after adoption
hereof.

REQUEST
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI,FLORIDA AUTHORIZING THE CITY MANAGER TO ENTER
INTO A MUTUAL AID AGREEMENT WITH THE CITY OF HALLANDALE
POLICE DEPARTMENT,ON BEHALF OF THE CITY OF SOUTH MIAMI POLICE
DEPARTMENT PURSUANT TO SECTION 23.1225 (3),FLORIDA STATUTES.
BACKGROUND AND ANALYSIS
Florida State Statutes (Chapter 23)authorize thegoverning body of municipalitiesto
empower the chief executive officer ofthemunicipalityto enter into agreements for shared
law enforcement servicesintimes of specificneed.
This agreement allowsthePolice Department to draw upon resources in furtherance of the
law enforcement mission,including personnel and equipment,aswellas providing for
reciprocity.
RECOMMENDATION
Approval is recommended.

COMBINED
VOLUNTARY COOPERATION AND OPERATIONAL ASSISTANCE
LAW ENFORCEMENT MUTUAL AID AGREEMENT
WITNESSETH
Whereas,thesubscribinglawenforcementagenciesaresolocatedin relation toeach
otherthatitistotheadvantage of eachtoreceiveandextendmutualaidintheform of
law enforcement servicesand resources to adequately respond to:
(1)Continuing,multi-jurisdictionalcriminalactivity,soasto protect thepublic peace
andsafety,andpreservethelivesandproperty of thecitizens;and,
(2)Intensive situations,including,butnotlimitedto,natural or manmade disasters or
emergencies asdefinedunder Section 252.34,Florida Statutes;and,
Whereas,the South MiamiPoliceDepartmentandtheCity of HallandalePolice
DepartmenthavetheauthorityunderSection 23.12,Florida Statutes,etseq.,The Florida
Mutual Aid Act,toenterintoamutualaidagreementforlaw enforcement servicewhich:
(1)Permitsvoluntary cooperation andassistance of aroutinelawenforcementnature
across jurisdictional lines;and,
(2)Providesforrendering of assistanceinalawenforcementemergency.
Now,therefore,the parties agree asfollows:
Section I.Provisions For Voluntary Cooperation
Each of the aforesaid law enforcement agencieshereby approve and enter intothis
agreementwherebyeach of theagenciesmayrequestand render lawenforcement
assistanceto the other indealingwithanyviolations of Florida Statutes toinclude,butnot
necessarilybelimitedto,investigatinghomicides,sex offenses,robberies,burglaries,
thefts,gambling,motor vehiclethefts,controlledsubstancesviolations,DUI violationsand
withbackupservicesduring patrol activities,schoolresourceofficersonofficialdutyout
of their jurisdiction,school safetyofficersenforcinglawswithin 1000 feet of a school,and
inter-agency task forces and/or joint investigations.
Section II.Provisions For Operational Assistance
Each of theaforesaidlawenforcementagencieshereby approve and enter intothis
agreement whereby each of the agencies may request and render law enforcement
assistance tothe other toinclude,butnot necessarily belimitedto,dealing with civil
disturbances,law enforcement emergencies,large protest demonstrations,aircraft
disasters,fires,hurricanes,tornadoes or other weather-related crises,sporting events,
concerts,parades,escapes from detention facilities,andincidents requiring utilization of
specializedunits (such asbombdisposalunitsorspecialweaponsand tactics units).
Section III.Procedure For Requesting Assistance
Inthe event thatapartytothisagreementisinneed of assistanceassetforth above,an
authorizedrepresentative of theagencyrequestingassistanceshall notify theagencyhead
orhis/herdesigneefrom whom such assistance isrequested.Theagencyheador
authorizedagencyrepresentativewhose assistance issoughtshallevaluatethesituation
andthe agency's availableresources,consult with his/hersupervisors if necessaryandwill
respondinamannerhe/shedeems appropriate.
Theagencyheadin whose jurisdictionassistanceisbeingrenderedmaydeterminewhois
authorizedtolendassistanceinhis/herjurisdiction,for how longsuchassistanceis
authorizedandfor what purposesuchauthorityisgranted.This authority maybegranted
eitherverballyorinwritingasthe particular situationdictates.
Shoulda sworn law enforcement officerbeinanothersubscribed agency's jurisdiction for
matters of aroutinenature,suchastraveling through the jurisdiction onroutinebusiness,
attendinga meeting orgoingtoorfrom work,ortransportingaprisoner,anda violation
of Florida Statutes occursinthepresence of saidparty,representinghis/her respective
agency,he/sheshallbe empowered torender enforcement assistanceandactinaccordance
with law.Should enforcement actionbe taken,saidpartyshall notify theagencyhaving
normaljurisdictionand upon thelatter's arrival,turnthesituation over to them and offer
anyassistance requested including,but not limited to,a follow-up written report
documenting the event andtheactionstaken.This provision soprescribedinthis
paragraphis not intendedtograntgeneralauthorityto conduct investigations,serve
warrantsand/orsubpoenasortorespond without requestto emergencies alreadybeing
addressedbythe agency of normaljurisdiction,butisintendedtoaddress critical,life-
threateningorpublicsafetysituations,preventbodilyinjurytocitizens,orsecure
apprehension ofcriminals whom thelawenforcementofficermayencounter.
The agency head's decision in these matters shallbe final.
Section IV.Command And Supervisory Responsibility
Thepersonneland equipment thatareassignedbytheassistingagencyheadshallbeunder
theimmediate command of asupervisingofficerdesignatedbytheassisting agency head.
Suchsupervising officer shallbeunderthedirectsupervisionand command of theagency
headorhis/herdesignee oftheagencyrequestingassistance.
CONFLICTS:Whenever anofficer,deputy sheriff orotherappointeeisrendering
assistancepursuanttothisagreement,theofficer,deputy sheriff or appointee shallabide
byandbesubjectto the rulesandregulations,personnelpolicies,generalordersand
standardoperatingprocedures of his/her own employingagency.If anysuchrule,
regulation,personnel policy,generalorderorstandard operating procedure is
contradicted,contravened or otherwise in conflict with adirectorder of a superior officer
of therequestingagency,then suchrule,regulation,personnelpolicy,generalorderor
procedureshall control andshallsupersedethedirectorder.
HANDLING COMPLAINTS:Wheneverthereiscausetobelievethatacomplainthas
arisenasaresult of a cooperative effort asitmaypertaintothis agreement,the agency
headorhis/her designee of the requesting agency shallbe responsible forthe
documentation of said complaint toascertainataminimum:
1.The identity ofthecomplainant.
2.An address where thecomplainingpartycanbe contacted.
3.The specificallegation.
4.The identity ofthe employees accused without regardastoagencyaffiliation.
If itisdeterminedthattheaccusedisanemployee of theassistingagency,theabove
information,with allpertinent documentation gatheredduringthereceiptandprocessing
of thecomplaint,shallbeforwarded without delaytotheagencyheadorhis/herdesignee
of theassisting agency for administrative review.The requesting agency may conduct a
review of thecomplainttodetermine if any factual basisforthecomplaintexists and/or
whether any of the employees of therequestingagency violated any of their agency's
policiesorprocedures.
Section V.Liability
Eachpartyengaginginany mutual cooperation andassistance,pursuanttothisagreement,
agreestoassumeresponsibilityfortheacts,omissions,or conduct of suchparty's own
employees whileengagedinrenderingsuchaidpursuanttothis agreement,subjecttothe
provisions of Section 768.28,FloridaStatutes,whereapplicable.
Section VI.Powers,Privileges,Immunities And Costs
A.Employees of theSouthMiamiPoliceDepartmentandtheCity of Hallandale Police
Departmentwhenactually engaging inmutualcooperationand assistance outside of
theirjurisdictionallimitsbutinsidethisstate,undertheterms of thisagreement,shall,
pursuanttotheprovisions of Section23.127(1),Florida Statutes,havethesame
powers,duties,rights,privileges andimmunitiesas if theemployeewasperforming
dutiesinsidethe employee's politicalsubdivisioninwhichnormallyemployed.
B.Eachpartyagreesto furnish necessary personnel,equipment,resourcesand facilities
andtorenderservicestoeachotherpartytotheagreementassetforthabove;
provided,however,thatnoparty shall be required todeplete unreasonably its own
personnel,equipment,resources,facilities,andservicesin furnishing suchaid.
CA political subdivision that furnishes equipment pursuant tothis agreement mustbear
thecost of lossordamagetothatequipmentandmustpayany expense incurredinthe
operationandmaintenance ofthatequipment.
D.Theagency furnishing aid pursuant tothisagreementshallcompensateits
appointees/employees during thetimesuchaidis rendered and shall defraytheactual
travelandmaintenanceexpenses of itsemployeeswhile they arerenderingsuchaid,
including anyamountspaidordueforcompensationduetopersonalinjuryordeath
whilesuch employees areengagedinrenderingsuchaid.However,therequesting
agencymaycompensatetheassistingagencyduringthetime of therendering of such
aidandshalldefraytheactualtravelandmaintenance expenses of such employees
whiletheyare rendering suchaid,includinganyamountspaidordueforcompensation
asaresult of personalinjuryordeathwhilesuchemployeesarerenderingaidpursuant
tothis agreement.
E.Theprivilegesandimmunitiesfrom liability,exemption fromlaws,ordinancesand
rules,andall pension,insurance,relief disability,workers'compensation,salary,death

andother benefits that apply tothe activity ofan employee ofan agency when
performing the employee's duties within the territorial limits ofthe employee's agency
apply to the employee tothe same degree,manner,and extent while engaged inthe
performance ofthe employee's duties extraterritorially under the provisions of this
mutual aid agreement.The provisions of this section shall apply with equal effect to
paid,volunteer,andauxiliaryemployees.
F.Nothing herein shall prevent the requesting agency from requesting supplemental
appropriations from the governing authority having budgeting jurisdiction to reimburse
the assisting agency forany actual costsor expenses incurred bythe assisting agency
performinghereunder.
G.Nothing inthis agreement is intended oristobe construed as any transfer or
contracting away ofthe powers or functions of one party hereto tothe other.
Section VII.Liability Insurance
Each party shall provide satisfactory proofof liability insurance byoneor more ofthe
means specified in Section 768.28(15)(a),Florida Statutes,inan amount which is,inthe
judgment ofthe governing body ofthat party,at least adequate tocovertheriskto which
that party may be exposed.Should the insurance coverage,however provided,of any
party be canceled or undergo material change,that party shall notify all parties to this
agreement of such change within ten (10)days of receipt of notice or actual knowledge of
such change.
SECTION Vin.FORFEITURE
A.Intheeventan agency seizesanyreal property,vessel,motor vehicle,aircraft,
currency orotherpropertypursuanttotheFloridaContrabandForfeitureActduring
the performance of this agreement,the agency requesting assistance inthe .case of
requested operational assistance andthe seizing agency inthecase of voluntary
cooperation shall be responsible for maintaining any forfeiture actionpursuantto
Chapter932,FloridaStatutes.The agency pursuing the forfeiture actionshallhave
the exclusive righttocontrolandthe responsibility tomaintainthepropertyin
accordancewithChapter932,FloridaStatutes,to include,butnotbelimitedto,the
completediscretiontobringtheactionordismisstheaction.
B.Allproceedsfrom forfeited propertyseizedasaresult of orinaccordancewiththis
agreementshallbedividedequallybetweentheparties,lessthecostsassociatedwith
theforfeiture action as per prior written agreement.
Section IX.Effective Date
Thisagreementshalltakeeffectuponexecutionandapprovalbythehereinafternamed
officialsandshall continue infullforceandeffectuntil January 1,2006.Under no
circumstancesmaythisagreementberenewed,amended,orextendedexceptinwriting.
Section X.Cancellation
Anypartymaycancelitsparticipationinthisagreementupondelivery of writtennoticeto
theotherpartyorparties.Cancellation willbeatthedirection of any subscribing party.
In witness whereof,the parties hereto cause these presents tobe signed onthe date
specified.
