A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE
ACCEPTANCE OF A SOUTH FLORIDA COMMUNITY URBAN
RESOURCES PARTNERSHIP (SFCURP)GRANT IN THE AMOUNT
OF $13,875;AUTHORIZING THE CITY MANAGER TO EXECUTE
APPLICABLE CONTRACTS AND DOCUMENTS;AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS,the SFCURP Programservestoassisturban communities in improving and
protectingtheirnaturalresourcesandenvironmentbyofferinggrantawardsandtechnical
assistance;and
WHEREAS,the grant program offerstheCity of SouthMiamithe opportunity to continue
theimportantenvironmentalrestorationbegunatFuchsParkwiththeWetlandsRestorationProject;
WHEREAS,theCity of SouthMiamihasbeenawarded $13,875 fortheFuchsPark
Environmental Enhancement Project,thereby allowing theCityto eradicate 33 Australian pines;
replacingtheAustralianpineswithnative vegetation;continuingaWetlandsRestorationProject,
and establishing an environmental education projectatthePark.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI:
Section 1.The City Manager is authorized to accept an SFCURP Grant inthe
amount of $13,875.
Section 2.TheCity Manager is authorized to execute contracts and documents
applicable tothe acceptance of the Grant.
Section 3.This resolution shalltake effect immediately upon arrival.

BACKGROUND AND ANALYSIS
The City of South Miami submitted an application tothe SOUTH FLORIDA COMMUNITY
URBAN RESOURCES PARTNERSHIP (SFCURP)toeradicate33 Australian pines;replace
theAustralianpineswithnativevegetation;continueaWetlandsRestorationProject,and
establish an environmental education projectatthePark.
TheCitywasawardedagrantfor$13,875fortheseactivities.Thegrantrequiresamatch of
eithercashorin-kindservicesinthesameamountasthegrant($13,875).Wewillbeableto
matchthegrantamountbyrecordingthetimeitwilltakecity staff toremoveandreplacethe
treesandperformotheractivitiesrelatedtothisgrant;therefore,theprojectwillnotcosttheCity
additional funds.
TheattachedresolutionwouldallowtheCityManagertoexecutethecontractsanddocuments
necessarytomoveforwardwiththisimportant endeavor.

GRANT MEMORANDUM OF AGREEMENT
This agreement,made and entered intothisthe day of ,20_

PARTNERSHIP,INC.,hereinaftercalledthe"SFCURP,Inc."and Citv of South Miami,hereinaftercalled
theSub-grantee(Sub-recipient).
WITNESSETH
WHEREAS,the SFCURP,Inc.desires to increase the principles of urban andcommunity forestry
bygrantingfundstotheSub-grantee(Sub-recipient)forthepurposeasoutlinedinGrantProjectNumber
99-26includedhereinas Exhibit "A"andbyreferencemadeaparthereof:
WHEREAS,theSFCURP,Inc.andtheSub-grantee (Sub-recipient)are of theopinionthatthe
citizens of the State of Florida wouldbenefit from the implementation of urban and community forestry
Projectsthat improve our communities natural resources andassistwithecosystem restoration;
WHEREAS,theSFCURP,Inc.hasawardedthe Sub-grantee (Sub-recipient)a South Florida
Community-Urban Resources Partnership(SFCURP)grantforthe specific Projectsetforthinthe
SFCURPGrantProject Number 99-26hereinafterthe "Project";
WHEREAS,theSub-grantee(Sub-recipient)byResolutionNo.,dated
,hasindicateditssupport of thegrantProjectandauthorizedits officers to
execute this Agreement onitsbehalf;
WHEREAS,thepartiesheretomutuallyrecognizethebenefits of suchaProjectasdescribedin
theSFCURP Grant Project and theneedfor entering intoan agreement designating and setting forth the
responsibilities of each party;
NOW THEREFORE,forandin consideration of the mutual benefits that flow eachto the other
hereinandinExhibit "2",the Grant Maintenance Memorandum of Agreement,the parties covenantand
agreeas follows:
1.Failure bytheSub-grantee (Sub-recipient)tosignandreturnthis agreement by February 28.
2001 shall constitute forfeiture of the award.
2.TheEffective Date of this agreement is ,20.
3.The Sub-grantee (Sub-recipient)shall complete the Project twelve (12)months of agreement
date contained herein as set forth inthe South Florida Community-Urban Resources Partnership Grant
Project Number 99-26 approved bythe SFCURP,during whichtimethe grant shall continue in effect.
The criteria for the Project isset forth therein.The final date bywhichsuch criteria mustbemet for
completion of this agreement istwelve(12)months from Effective Date.

TheProjecttobeperformedbytheSub-grantee(Sub-recipient)shallbesubjectto periodic inspections
bytheSFCURP,Inc and/or theSFCURP Federal Support Team and/or their assignees.The Sub-grantee
(Sub-recipient)shallnotchangeordeviatefromthe Project withoutwritten approval bythe SFCURP,Inc.
4.The Sub-grantee(Sub-recipient)hasestimatedtheProjectcosttobe$27.750.00asshownon
thegrantProject budget sheetattachedas Exhibit "B".TheSFCURP,Inc.agreestoreimbursetotheSub-
grantee (Sub-recipient)the total sum of $13.875.00 orfifty percent (50%)of the final approved Project
costs,whichever isless(the"Grant Amount").TheGrant Amount is limited toonlythoseitemswhich
aredirectlyrelatedtothisProjectasdescribedinExhibits"A"and"B".Projectcosts incurred priorto
the Effective Date of this agreement are ineligible for reimbursement.To assisttheSub-grantee (Sub-
recipient)with theinitialthree(3)months of implementation,theSFCURP,Inc.maymakeanadvance
of nomorethan25percent of thegrant award.The Sub-grantee (Sub-recipient)mustrequesttheadvance
paymentinwritingusingformsprovided by the SFCURP,Inc.Fundsprovidedasanadvancepayment
mustbeplacedinanon-interestbearingaccount.Onlyoneadvancepaymentwillbemade,thereafter,
disbursements will bemadeona reimbursement basis.Nomorethan75percent of theGrant Amount
willbepaidtotheSub-grantee(Sub-recipient)priortoCertification of AcceptancebytheSFCURP,Inc.
Thefinal payment shallnotbemadeuntilCertification of Acceptance isreceivedfromtheSFCURP,Inc.
Forinstalledplantmaterials,a sixty (60)daygrow-in-periodwillberequiredafterProject completion.
Certification of Acceptance bythe SFCURP,Inc.mayberequested sixty (60)daysafterProject
completion.Uponreceipt of theCertification of Acceptance,theSub-grantee (Sub-recipient)maysubmit
an invoice forfinalpayment.
(a)Twoormoreverbalquotes are required forall purchases,expendituresexceeding
$1,000.00andupto$5,500.00.A minimum of threewrittenquotesoraformalbid
processisrequiredforall purchases/expenditures exceeding $5,500.00 andnot
greaterthan $15,000.00.Sealedbidsarerequiredforallpurchases exceeding
$15,000.00.Justificationmustbeprovidedforasolesource award orforanaward
toa vendor otherthanthevendor submitting the lowest bidorquote.
(b)Billsforfees or'other compensationforservicesorexpensesshallbesubmittedin
detail sufficient foraproperpre-auditandpost-auditthereof,andbillsfortravel
expenses specifically authorizedbythis Agreement shallbesubmittedandpaidin
accordance withtheratesspecifiedinSection 112.061,Florida Statutes.
(c)Records of costsincurredunderterms of this Agreement shallbemaintainedand
made available uponrequesttotheSFCURP,Inc.atalltimes during the period of
this Agreement andfor thiee years afterfinalpaymentismade.Copies of these
documents and records shall be furnished tothe SFCURP,Inc.upon request.
Records of costsincurredincludeallrecords of thecosts of theSub-grantee(Sub-
recipient)and subcontractors considerednecessarybythe SFCURP,Inc.fora
properaudit of theProject.
(d)Apersonor affiliate whohasbeenplacedontheconvictedvendorlistfollowing
a conviction forapublicentitycrimemaynotsubmitabidon contract to provide
anygoodsorservicestoapublicentity,maynotsubmitabidona contract with

apublicentityfortheconstructionor repair of apublicbuildingorpublic work,
maynotsubmitbidsonleases of real propertytoapublicentity,maynotbe
awardedorperform work asa contractor,supplier,subcontractor,orconsultant
undera contract withanypublicentity,and maynot transact businesswithany
publicentityinexcess of thethresholdamountprovidedinSection287.017,for
DemonstratedorSiteSpecific Projects,foraperiod of 36months from thedate of
being placedon the convicted vendor list.
5.The Sub-grantee(Sub-recipient)agreestomaintainplantmaterialsestablishedasapart
of theProjectforaperiod of threeyearsandenterintoanagreement which designatesandsetsforththe
dutiesand responsibilities of thepartiesin maintaining theProject.
6.The Sub-grantee(Sub-recipient)agreestosubmittotheSFCURP,Inc.aninterimreport
onProjectaccomplishmentswithinsixmonths of Effective DateandafinalreportsummarizingProject
accomplishmentsasa prerequisite tofinalacceptancebytheSFCURP,Inc.Failure tosubmita required
reportor submission of anunsatisfactoryreportis sufficient groundsfortermination of thisagreement
accordingtotheprovisions of Section7(b).The Sub-grantee (Sub-recipient)uponProjectcompletion
shall submitanewsreleaseto local newspapermediahighlightingthesuccesses of the Project.
7.This Agreement maybe terminated underanyone of the following conditions:
(a)By theSFCURP,Inc.,unilaterally,for refusal bytheSub-grantee(Sub-recipient)toallow
publicaccesstoalldocuments,papers,letters,orothermaterialsubjecttoChapter 119,
F.S.andmadeorreceivedbytheSub-grantee (Sub-recipient)inconjunctionwiththis
Agreement.
(b)By theSFCURP,Inc.,if theSub-grantee(Sub-recipient)failstoperformitsdutiesunder
this Agreement,following thirty (30)calendardays written noticebytheSFCURP,Inc.
(c)By eitherpartyfollowing sixty (60)calendar dayswrittennotice.
(d)By both parties followingthecompleteexecutionbyboth parties of anagreementto
terminate this.Agreement.
(e)Notice toSub-grantee(Sub-recipient):The SFCURP,Inc.shallconsiderthe employment
by anySub-grantee(Sub-recipient)of unauthorizedaliensaviolation of section 274A(e)
of the Immigration and Nationalization Act.Such violation shallbecauseforunilateral
cancellation of thisagreement.
8.Notwithstandinganyprovision of thisAgreementtothecontrarybutsubjectto Subparagraph
7(b),intheeventthisAgreementis terminated beforethe SFCURP,Inc.has paid the Sub-grantee (Sub-
recipient)the entire Grant Amount,thenthe SFCURP,Inc.agrees topaythe Sub-grantee (Sub-recipient)
the entire Grant amount,ifthe Project has been completed.Ifthe Project has not been completed,the
SFCURP,Inc.shall paytothe Sub-grantee (Sub-recipient)a percentage of the Grant amount equal tothe
percentage of theProject'scompletion.

9.Extension of a contract for contractual services shall bein writing for a single period only
notto exceed six (6)months andshallbesubjecttothesametermsand conditions setforthintheinitial
contract.There shallbe only one extension of acontractunlessthefailureto meet thecriteriasetforth
inthe contract forcompletion of the contract isduetoeventsbeyondthe control of the Contractor.If
initially competitively procured,contracts for contractual services maybe renewed ona yearly basis for
nomorethantwo(2)years,orfora period nolongerthantheoriginal contract,whichever period is
longer.Renewal of acontractfor contractual servicesshallbeinwritingandshallbe subject tothesame
terms and conditions set forth inthe initial contract.Renewals shall be contingent upon satisfactory
performanceevaluationsbytheSFCURP,Inc.
10.AsapplicableunderFloridaStatute768.28,theSub-grantee (Sub-recipient)covenantsand
agrees thatit will holdharmlesstheSFCURP,Inc.andall of theSFCURP,Inc.'s officers,agentsand
employeesfromanyclaim,action,neglectoromissionbythe Sub-grantee (Sub-recipient)during the
performance of theAgreement,whetherdirector indirect,andwhetheranypersonorpropertytowhich
theSFCURP,Inc.'sorsaid parties maybesubject,exceptthatneithertheSub-grantee (Sub-recipient)
norany of itssub-contractorswillbeliableunderthis paragraph fordamagesarisingout of injuryor
damagetopersonsorpropertydirectlycausedorresultingfromthesolenegligence of the SFCURP,Inc.
orany of its officers,agentsor employees.
Notwithstanding anyverbiagewithinthis paragraph (10),theCity of West PalmBeachdoesnow
waveitsrighttosovereign immunity asprovidedbyFloridaStature768.28.
11.TheSub-grantee(Sub-recipient)certifiesthatneitheritorits principals ispresently debarred,
suspended,proposedfordebarment,declared ineligible,orvoluntarilyexcludedfor participation inthis
grantprogram by anyFederal department oragency.
12.ThisAgreement,togetherwithanyMaintenanceAgreement,if executed,embodiestheentire
agreementandunderstanding between thepartiesheretoandtherearenootheragreementsor
understandings,oral orwritten,with reference tothesubject matter hereofthat are not superseded hereby.
13.This Agreement maynotbeassignedor transferred bytheSub-grantee (Sub-recipient)or
SFCURP,Inc.,inwholeorin part withoutthe prior expressed writtenconsent of theother party.
14.ThisAgreement,regardless of whereexecuted,shallbegovernedbyand construed in
accordance withthelaws of theState of Florida.VenueshalllieinPalmBeachCounty,Florida.
15.Allnotices,demands,requestsorotherinstrumentsshallbegivenbydepositingthesamein
the U.S.Mail,postage prepaid,registered or certified with return receipt requested,orby telex (FAX)or
telegram:

16.Time is of theessence of thisagreement.
17.Thiscontract,whichdisbursesgrantsandaids appropriations,issubjecttotherequirements
of Section216.347,FloridaStatutes,andtheSub-grantee(Sub-recipient)isthereforenotallowedto
expendanyfundsreceivedthroughthiscontractforthe purpose of lobbyingthe Florida Legislature,the
SFCURP,Inc.,theJudicialBranch,oranyotherstateagency.Thiscontract,whichdisburses grants and
aids appropriations,issubjecttotherequirements of Section 216.349,FloridaStatutes,which are:
(a)The SFCURP,Inc.andtheComptrollerbeforedisbursinganyfunds must independently
ensurethattheproposed expenditure isin accordance with alllegalandregulatory
requirements andthatthiscontract specifically prohibitstheuse of fundsforthepurpose
of lobbying theLegislature,theSFCURP,Inc.,theJudicialBranch,oranystateagency.
(b)If theSub-grantee(Sub-recipient)isalocal government agency,nonprofit organization,
or not-for-profit organizationit shall:(I)foramounts$25,000orless,haveitsheadattest
thatithas complied withgrantprovisions,(ii)foramountsgreaterthan$25,000butnot
morethan $100,000 haveagrant-specificauditperformedin accordance withthe rules of
the Auditor Generalorhavea statement prepared by an independent certified public
accountantwhichatteststhatthegrantprovisionshavebeencompliedwith,(iii)for
amountsgreaterthan$100,000,havea grant-specific auditperformedin accordance with
therules of theAuditorGeneral,and(iv)havesuchaudits,statements,or attestations filed
with the SFCURP,Inc.and the Auditor General.
(c)Theintent of this paragraph istoincludelobbying,of applicable federal agencies.
18.If this agreement containsfederalfundinginexcess of $100,000,theSub-grantee(Sub-
recipient)must,priortoagreementexecution,completethe Certification RegardingLobbying form.If
aDisclosure of Lobbying Activities,Standard Form LLL,is required,itmaybeobtainedfromthe
SFCURP,Inc.All disclosure forms asrequiredbythe Certification Lobbying formmustbecompleted
and returned to the SFCURP,Inc.
19.Theundersigned Sub-grantee (Sub-recipient)receiving federal financial assistance underthis

federal agencytoauditthe Sub-grantee's (Sub-recipient's)booksfor compliance withtheabove applicable

20.TheSub-grantee(Sub-recipient)acknowledgesand agrees thatpublicuse of all reports or
other printed material,videos,audio recordings,films and photographs produced as part of this Project
shallnotbe restricted underthecopyrightlaws of theUnited States of America.All products (brochures,
signs,videos,etc.)fundedbytheSouth Florida Community-UrbanResources Partnership grant must
display astatementthatthe material hasbeen prepared usingSouth Florida Community-Urban Resources
Partnership grantfundsreceivedthroughtheFloridaDepartment of AgricultureandConsumerServices-
Division of Forestryand USDA-Forest Service.
21.The Sub-grantee (Sub-recipient)isinformedthata person oraffiliatewhohasbeen placed
ontheconvictedvendorlistfollowingaconvictionforapublicentitycrimemaynotsubmitabidonan
agreement toprovideanygoodsor services toapublicentity,maynotsubmitabidonan agreement with
apublicentityforthe construction or repair of apublicbuildingorpublicwork,maynotsubmitbidson
leases of real property toa public entity,may net be awarded or perform work as a contractor,supplier,
subcontractor,or consultant underan agreement withany public entity,andmaynot transact business with
any publicentityinexcess of the threshold amount provided inSection287.017,Florida Statutes,for
CATEGORYTWO for a period of 36 months from the date of being placed onthe convicted vendor list.

MAINTENANCE MEMORANDUM OF AGREEMENT
This agreement,made and entered into this the day of 20 ,by
and between the SOUTH FLORIDA COMMUNITY-URBAN RESOURCES PARTNERSHIP,INC.,
hereinafter called the "SFCURP,Inc."and Citv of South Miami,hereinafter called the Sub-grantee (Sub-
recipient).
WITNESSETH
WHEREAS,the SFCURP,Inc.desires to increase the general level of knowledge of the principles
of urban and community forestry enhancement of natural resources and ecosystem restoration by granting
funds tothe Sub-grantee (Sub-recipient)for the establishment ofa demonstration tree planting Project as
outlined inthe South Florida Community-Urban Resources Partnership Grant Project Number 99-26 and
Grant Memorandum of Agreement (the "Grant Agreement")attached hereto as Exhibit "1"and by
referencemadeaparthereof;
WHEREAS,the SFCURP,Inc.has awarded the Sub-grantee (Sub-recipient)aSouth Florida
Community-Urban Resources Partnership (SFCURP)grant,more particularly set forth inthe Grant
Agreement;
WHEREAS,the Sub-grantee (Sub-recipient)agreed inthe Grant Agreementto maintain the
Project (as described inthe Grant Project);
WHEREAS,the parties hereto recognize the need for entering into an agreement designating and
setting forth the responsibilities of each party in maintaining the Project;and
WHEREAS,the Sub-grantee (Sub-recipient)by Resolution desires to enter into this Agreement
and authorizes its officers to do so.
NOW THEREFORE,forandin consideration of the mutual benefits that flow eachtothe other
herein and in Exhibit "1",the Grant Memorandum of Agreement,the parties covenant and agree as
follows:
1.The Sub-grantee (Sub-recipient)shall maintain the Project ina responsible manner and with due
care in accordance withthe below listed "Project Standards"for the property atthe following location:

Specifically,the Sub-grantee (Sub-recipient)accepts thebelow listed responsibilities and duties:
(a)Proper watering and proper fertilization of all trees/plants.
(b)Keeping trees/plants asfreeas practicable from disease andharmful insects;
(c)Proper mulching of trees and/or planting beds;Keeping the premises free of weeds;
Mowing and/or cutting grasses tothe proper length;

(d)Proper pruning of all trees which includes;(i)removing dead or diseased parts of
trees or (ii)pruning such parts thereofwhich present a hazard;
(e)Removing and replacing dead or diseased trees/plants in their entirety,or removing
and replacing those that fall below original Project Standards.
The Sub-grantee (Sub-recipient)agrees to repair,or remove and replace at its own expense all or
part of the Project that falls below Project Standards.In the event any part or parts of the Project,
including all plants,must be removed and replaced for whatever reason,then they shall be replaced with
the same grade,size and specification as provided in the original plans for the Project.Furthermore,the
Sub-grantee (Sub-recipient)shall keep litter removed from the Project area.The above named functions
to be performed by the Sub-grantee (Sub-recipient)shall be subject to periodic inspections by the
SFCURP,Inc.It is the intent of the parties hereto that except as otherwise provided in paragraphs 2 and
4 hereof,the Sub-grantee (Sub-recipient)shall be the owner of the planting and other installations
included and stipulated inthe grant application comprising the Project.
2.This Agreement mayby terminated under any one of the following conditions:
(a).Bythe SFCURP,Inc.,if the Sub-grantee (Sub-recipient)fails to perform its duties
under this Agreement or for refusal by the Sub-grantee (Sub-recipient)to allow
public access to all documents,papers,letters,or other material subject tothe
provisions of Chapter 119,Florida Statutes and made or secured bythe Sub-
grantee (Sub-recipient)in conjunction with this Agreement following reasonable
written notice.
(b).Byeither party following sixty(60)calendar days written notice.
(c).Byboth parties following the complete execution byboth parties of an agreement
toterminatethisAgreement.
3.The terms of this Agreement commence onthe date of Certification of Acceptance and continue
foraperiod of three(3)years.
4.IntheeventthisAgreementis terminated in accordance with subparagraph 2(a)thentheSub-
grantee (Sub-recipient)shall refund tothe SFCURP,Inc.a pro-rated portion of the grant award based
uponthefollowingschedule:
(a).Ifthis agreement is terminated withinone year of the date in Paragraph 3,75
percent of thegrant award,
(b).If this agreement is terminated during the second year of this agreement,50 percent
of the grant award,
(c).If this agreement is terminated during the third year of this agreement,25 percent
of thegrantaward.
5.As applicable under Florida Statute 768.28,the Sub-grantee (Sub-recipient)Covenants and
agrees thatit shall hold harmless the SFCURP,Inc.andall of the SFCURP,Inc.'s officers,agents and
employees from anyclaim,action,neglect oromissionbythe Sub-grantee (Sub-recipient)during the
performance of the Agreements,whether direct or indirect,and whether any person or property to which

the SFCURP,Inc.or said parties may be subject,except that neither the Sub-grantee (Sub-recipient)nor
any of its sub-contractors shall be liable under this paragraph for damages arising out of injury or damage
to persons or property directly caused or resulting from the sole negligence of the SFCURP,Inc.or any
of itsofficers,agents oremployees.
Notwithstanding any verbiage within this paragraph (5),theCity of West Palm Beach does now
waveitsrighttosovereignimmunityas provided by Florida Stature 768.28.
6.This Agreement,together with the South Florida Community-Urban Resources Partnership,Inc.
Grant Memorandum of Agreement,embodies the entire agreement and understanding between the parties
hereto and there are no other agreements or understandings,oral or written,with reference to the subject
matter hereofthat are not superseded hereby.
7.This Agreement maynotbe assigned or transferred bythe Sub-grantee (Sub-recipient)or
SFCURP,Inc.,inwholeorin part without the expressed written consent of the other party.
8.ThisAgreementshallbe governed byand construed in accordance withthelaws of the State
of Florida.Venue shall likein Palm Beach County,Florida.
9.All notices,demands,requests or other instruments shall begivenby depositing thesameinthe
U.S.Mail,postage prepaid,registered or certified with return receipt requested,orbytelex(FAX)or
telegram:

10.Time is of theessence of thisagreement.
11.Thiscontract,which disbursesgrantsandaids appropriations,issubjecttotherequirements
of Section216.347,FloridaStatutes,andtheSub-grantee(Sub-recipient)isthereforenotallowedto
expendanyfundsreceivedthroughthis contract forthe purpose of lobbyingthe Florida Legislature,the
SFCURP,Inc.,the Judicial Branch,oranyotherstateagencyor federal agencyasitmayapply.

This contract,which disburses grants and aids appropriations,is subject tothe requirements of
Section216.349,FloridaStatutes,which are:
(a)The SFCURP,Inc.and the Comptroller before disbursing any funds must independently
ensure that the proposed expenditure isin accordance with all legal and regulatory
requirements and that this contract specifically prohibits theuse of funds for the purpose
of lobbyingthe Legislature,the SFCURP,Inc.,the Judicial Branch orany state agency.
(b)Ifthe Sub-grantee (Sub-recipient)isa local government agency,non-profit organization,
ornot-for-profit organization it shall:(I)for amounts $25,000orless,haveitshead attest
thatithascompliedwith grant provisions,(ii)for amounts greater than$25,000butnot
morethan $100,000 havea grant-specific audit performed in accordance withthe rules of
theAuditor General or have a statement prepared by an independent certified public
accountant which attests thatthe grant provisions havebeencompliedwith,(iii)for
amounts greater than $100,000 havea grant-specific audit performed in accordance with
