WHEREAS,Christi Elias'mother lives with herand her mother hasa disability that requires an alteration toMs.Elias'home;and WHEREAS,on April 9,2015 Christi Elias submitted an application fora variance to construct a124squarefoot bathroom addition,toan existing one-story residence within theRS-3 zoning district,which isthe minimum required to accommodate her mother's disabilities;and WHEREAS,application No.PB-15-006 was submitted tothe Planning Board bythe applicant ChristiElias;said application requestingapprovalfora variance from Section 20-3.5(E) toallowa building coverage of 30.7%wherea maximum of 30%isrequired,inordertoconstruct a124squarefoot bathroom addition toanexisting one-story residence located at7830SW57 Court,South Miami,Florida,within theRS-3zoning district;and WHEREAS,the approval of avariance requires a recommendation fromthePlanning Boardandtheapproval of theCity Commission afterapublichearing;and WHEREAS,atitsMay2,2015 meeting,the Planning Board afterapublic hearing voted5 ayes0naysto recommend approval of the variances requested;and WHEREAS,therehasbeenanaffirmativefindingbythe Planning andZoning Department Headastoeach of the following criterion as required by Section 20-5.9(H): 1.The variance is necessary torelieve particular extraordinary conditions relating to a specific property; 2.Denial of the variance wouldresultin hardship totheowner.Hardship results if the restriction of the zoning ordinance,whenappliedtoa particular property,becomes arbitrary, confiscatoryorundulyoppressivebecause of conditions of thepropertythatdistinguishitfrom other properties under similar zoning restrictions; 3.The extraordinary conditions and circumstances do not result fromthe actions of the applicant; 4.The requested variance isthe minimum variance necessary tomake possible the reasonable use of the land,building or structure; 5.Thatthe approval of thevariancewillbe consistent withthegeneralintentand purpose of theLand Development Code,andwillnotbeinjurioustothe neighborhood orotherwise detrimental tothe public welfare;and WHEREAS,even if the circumstances donot strictly fall within the requirements fora variance,thefederalFairHousingAct ("FHA"),42 U.S.C.3601 et_seq.,applies tomunicipalities andprohibitsthemfromimplementinglandusepoliciesthatexcludeorotherwisediscriminate againstprotectedpersons,includingindividualswithdisabilities.Itistheposition of theUnited States Department of Justice that the refuse to make reasonable accommodations in land useand zoningpoliciesandprocedures,wheresuch accommodations maybenecessarytoaffordpersonsor groups of personswithdisabilitieswithanequalopportunitytouseandenjoyhousing,isa Res.No.101-15-14440 violation of theFHA.Asanexample,itistheJustice Department's position thatareasonable accommodation includes a waiver of a setback requirement so that a paved path of travel canbe provided to residents who have mobility impairments.Itisalsothe Justice Department's opinion thata request would onlybe unreasonable if (1),the request imposes an undue burden or expense on the local government or(2)the request would create a fundamental alteration in the zoning scheme.If neither of these conditions exist,therefusaltogranta reasonable accommodation may be unreasonable and a violation of the federal FHA. WHEREAS,the Mayor andCity Commission of the City of South Miami desire to accept the recommendation of the Planning Board. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Therecitalssetforthinthis resolution aretrue,andtheyare supported by competent substantial evidence andtheyare incorporated intothis resolution by reference. Thehomeowners considered otheroptions for the accommodation ofa handicapped- accessible bathroom,including renovating anyofthe existing bathrooms.However,thespace needed will requiremajorrenovationstothe new-built house;therefore,they felt the proposed designis the most adequate option. Staff Observations The applicant is proposing to builda bathroom addition consisting of 124 square feet that will be located on the northwest side of the referenced site.Please refer to the survey andFigure2 for the existing building orientation,which illustrates the existing conditions of the property. (1)The subject site is surrounded on the north,south and west by single family homes zoned RS-3 and to the east by RO-Residential Office uses. (2)The proposed building coverage of 4,148 square feet or30.7%of the existing siteis only exceeding the 3096 maximum building coverage by98 square feet;however,itis not exceeding the maximum allowed impervious coverage of 40%. (3)The applicant's Statement of Hardship states the handicapped-accessible bathroom isa necessity forher mother's careinorderto mobilize herbyusinga45"x 29"medicallift device. In June 2008 the City Commission amended the Land Development Code to add spedfic criteriaforjudgingvariance requests.LDC Section 20-5.9 (H)now requires that allvariance decisions shall be based onan affirmative findingas to each of the followingcriterion: 1.Thevarianceisnecessary to relieve particular extraordinaryconditionsrelating to a specific property; The requested handicapped-accessible bathroom additionwill allow the applicant to accommodate her disabled mother in her home. 2.Denial of the variancewouldresultinhardship to the owner.Hardship resultsif the restriction of the zoningordinance,when applied to aparticular property,becomes arbitrary,confiscatoryor unduly oppressivebecause of conditions of the property that distinguish itfrom other properties under similarzoning restrictions;, Adenial of the variance wouldbea hardship ontheownerby preventing the propertyfrombeinghabitablebythe applicant's disabledmother. 3.The extraordinary conditions and circumstances do not result from the actions of the applicant; The propertyhadbeenbuiltpriortotheneedof accommodation oftheproperty owner's disabled mother. 4.The requested varianceis the minimumvariancenecessary to make possible the reasonable use of the land,buildingor structure; The granting of the requested varianceisthe smallest possibleandtheonlyone necessary to allow for the reasonable use of the structure. 5.That the approval of the variancewill be consistent with the general intent and purpose of the Land Development Code,andwill not be injurious to the neighborhood or otherwise detrimental to the public welfare. The approval of thevarianceis consistent withtheCity's objective topreserve the character of the designated structureandneighboringstructuresandwillhave no impact to surrounding properties.
