Res No 095-15-14434RESOLUTION NO.095-15-14434 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the City Manager to sell the "surplus"items. WHEREAS,Section 2-4.7 titled:"Surplus city-owned property"of the City of South MiamiCode of Ordinances states that all personal property owned by the Cityshall not besold unless and untilitis declared to be surplus property by resolution of the City Commission;and WHEREAS,the City Manager is recommending that the attached list of personal property items be classified as "surplus"because said property serves no useful function for any activity or in any location within the City and should be sold to the highest bidder by way of a City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances;and NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOF SOUTH MIAMI,FLORIDA THAT; Section 1.The personal property described in the attached list of property is "surplus" andCity Manager is hereby authorized to dispose of the items in accordance with the procedure set forth in section 2-4.7of the CityCodeof Ordinances,including sale at public auction. Section 2.Severability.Ifany section,clause,sentence,or phrase of this resolution is foranyreasonheld invalid or unconstitutional byacourtof competent jurisdiction,thisholding shall not affect the validityof the remaining portions ofthis resolution. Any personal property that is classified obsolete,orno longer economical or efficient to keep,or that serves no useful function for any activity orin any location within the City,needs to be declared as "surplus"by the City Commission per Section 2-4.7 of the Code of Ordinances.
