WHEREAS,the Police Departmentisrequiredto maintain communications andcomputer
equipmentin order to enforce the lawsoftheStateofFlorida to providefor the public'ssafety,disasterrelief
andhomelandsecurity,thereby making our communitysafer,and
WHEREAS,thePolice Department has initiated aprojecttopurchasethelatesttechnology which
offersmore mobility and functionality asrecommendedbytheCity's Information Technology,and
WHEREAS,the majorityof funding forthis request will comefrom Miami-Dade County Byrne-JAG
Grant andFlorida Department ofLawEnforcement Byrne-JAG grant.

ThePolice Department wishestopurchasesix(6)GETACtablets.During
the last9 months the Police Department began researching different options
forpurchasingtabletsandlaptopsbasedon recommendations from Miami-
Dade County InformationTechnology Department (ITD).The CityPolice
Department budgeted $145,000 fromFederalForfeituremoniestoassistin
fundingthepurchaseof new laptop/tabletsforpoliceofficersandwish to
purchase,thefirstsix(6)tablets utilizing the Byrne-JAG grantsand available
fundsfromFY 2015 budget.
The Police Department over the yearshas encountered several obstacles in
initiatinga fully functionalGPStrackingsystemaswell utilizing equipmentto
withstand the rigorsof operating inapolicevehicle.Itwas determined byITD
that numerousGPSproblems were directlyrelated to the useofadifferent
variationsofDelllaptops,therefore,itwas recommended utilizing semi-rugged
or rugged computers wouldimprove the longevity over currently utilized
laptops.
Upon researching the different options available,the Police Department willbe
utilizing theGETAC Fl 10 tablets.This tablet is fully solid state andhasa full
three (3)yearwarranty.The tablets also come equippedwithabuiltinGPS
whichwill resolve the aforementioned issues.The purchase of these tablets
willbemadeby utilizing the current Miami Dade County Hewlett Packard
contract whichoffersthe most competitivepricing.

Background:The Florida Department ofLaw Enforcement by and through its
OfficeofCriminal Justice Grants awarded the Cityof South Miami
$6,642.00 for the project entitled,Byrne Grant Vehicle Burglary.
The Cityof South Miami will be allocating the funds to reduce crime
and improve public safety by.purchasing four(4)tablet computers
for Police Officers.
The City will purchase tablets for use by detectives so they can be
in contact with computer aided dispatch for faster response times
and also have the abilityto access the USA software crime
reporting system.Tablet computers will also supplement in-office,
outdated computers to ensure that detectives can manage the
problem of auto theft and auto burglaryby tracking occurrences
and through the use of statistics.

Problem Identification
The Sou*Miami Police Department is still in theprocessof converting toapaperlesssystemfor
criminal justicereporting.Thedepartmenthasbeenseeking funding tosupportthe purchase of
tabletcomputersforpolice officers.Tablets will enable officers towork more efficiently and
accuratelywhenpreparing reports.Althoughthedepartmenthas been ableto secure some
funding forthe conversion,the police officers are stifl in needofupdated computer equipment for
daily operations.Current computing units areoutof warranty,in needof expensive replacement
parts,andno functioning properly.Because thePolice Department has nothadthefundsfor
updatingmuch needed computing units,grantfundshavebeen identified topurchasethe
equipment.
Project Summary (Scope of Work)
TheSouth Miami PoliceDepartment will utilize FY 2015JAG funds topurchase four(4)tablet
computersforpolice officers.Theequipment will makeitpossibleto access necessarydataata
higherspeed,therefore increasing productivity.Funding will allow theSouth Miami Police
Departmenttocontinueitseffortstoupgradeequipmentusedto manage criminal justice data,
while increasing efficiencyand effectiveness.Inaddition,thetabletswillallow the officersto
reducethetime needed tostore data andrecordkeeping.Moreover,the departmentcan share
information with otherlocallaw enforcement agencies.Inanefforttoimprovethe management
andmaintenanceof criminal justicedata,thedepartment will usethis years JAGfundingto
purchase four (4)tablet computers to be installedinpolicevehicles.
Thisprojectrequestsfederalgrantfundingforalawenforcementor criminal justicetechnology
relatedprojectandmaybesubjecttoreviewandapprovalbythe State Information Technology
(IT)PointofContact.By utilizing fundsforthis project,the subrecipient and implementing agency
agree toconformtoall state and national standards for technologyandinformation sharing
systems that connect to,and/orinterface with stateandnational systems,and/orresideonthe
state Criminal Justice Network(CJNet).These standards include,but are notlimitedto,the FBI
CJISSecurityPolicyandanyrules,regulationsor guidance enactedby the Criminal andJuvenile
Justice Information System (CJJIS)Council under F.S.943.06.

Mobile Hardwarecontract with Hewlett-Packard Company (HP)fordesktopcomputers,

Conditions of agreement requiring compliance by units oflocal government (subgrant recipients),
implementing agencies,and state agencies upon signed acceptance ofthe subgrant award appear in
this section.Upon approval ofthis subgrant,the approved applicationand the following terms of
conditions will become binding.Failuretocomplywithprovisionsofthis agreement will result In
requiredcorrectiveactionuptoandincludingproject costs beingdisallowedandterminationofthe
project,as specified \n item 19 ofthis section.
1.All Subgrant Recipients must comply with the financial and administrative requirements set
forth in the current edition of the U.S.Department of Justice,Office of Justice Programs
(OJP)Financial Guide (Financial Guide)(www.oip.usdoi.gov/financialquide/index.html and
the Edward Byrne Memorial Justice Assistance Grant (JAG)program guidance

2.Requirements for Contractors of Subgrant Recipients
Thesubgrantrecipient assures the compliance ofall contractors with theapplicable provisions of
Title I oftheOmnibusCrimeControlandSafe Streets Actof 1988,as amended (42U.S.C.3711
et seq.at www.qDo.aov/fdsvsA:theprovisionsof the current editionoftheOfficeof Justice
Programs Financial Guide (www.oip.usdoi.gov/financialquide/index.htm):andallother applicable
federaland state laws,orders,circulars,orregulations.

Allowable Costs
a.Allowance for costs incurred under the subgrant shall be determined according tothe general
principles and standards for selected cost items set forth inthe Office of Justice Programs
Financial Guide,U.S.Department ofJustice Common Rulefor State And Local Governments
andfederal OMB Circular A-87,"Cost Principles for State,Localand Indian Tribal
Governments/1 orOMB Circular A-21,"Cost Principles for Educational institutions."
b.All procedures employed intheuseof federal funds for any procurement shall be according
toU.S.DepartmentofJusticeCommonRuleforStateandLocalGovernments,orOMB
Circular A-110,or OMB Circular A-102,and Florida lawtobe eligible for reimbursement.
Reports
a.Project Performance Reports
(1)Reporting Time Frames:The subgrant recipient shall submit Quarterly Project
•PerformanceReportstothe Florida Department ofLawEnforcement,hereafterknownas
the Department,within fifteen (15)daysaftertheendofthe reporting period.In addition,
ifthesubgrantaward period isextendedbeyondthe "original0 project period,additional
QuarterlyProjectPerformanceReportsshallbesubmitted.
Failure tosubmit Quarterly Performance Reports thatare complete,accurate,andtimely
mayresultinsanctions,asspecifiedinitem 19,Performanceof Agreement Provisions.
(2)ReportContents:PerformanceReports must include aresponseto all objectives included
in your subgrant Adetailedresponseis required inthe narrative portion foryes/no
performance objectives.The narrative mustalsoreflecton accomplishments forthe
quarterandidentifyproblemswith project implementationandaddressactionsbeing
takentoresolvethe problems.Additional information maybe required ifnecessaryto
comply withfederalreporting requirements.
(3)Submission:PerformanceReportsmaybe submitted by the Project Director,Application
Manager,or Performance Contacts.
b.Financial Reports
(1)ProjectExpenditure Reports
(a)The subgrant recipientshallhaveachoiceofsubmittingeitheraMonthlyora
QuarterlyProjectExpenditureReportto the Department ProjectExpenditure
Reportsareduethirty(30)daysaftertheendofthe reporting period,inaddition,if
the subgrant awardperiodis extended,additional ProjectExpenditureReportsshall
be submitted.
(b)Allproject expenditures for reimbursement of subgrant recipient costs shallbe
submitted ontheProjectExpenditureReportFormsprescribedandprovidedbythe
Officeof Criminal JusticeGrants(OCJG)throughtheSIMON(Subgrant information
Management ON-line)
(c)AllProject Expenditure Reports shallbe submitted in sufficient detailforproper pre-
audit and post-audit.
(d)Beforethe "final"ProjectExpenditureReportwillbe processed,thesubgrant
recipient must submit to the Department all outstanding project reportsand must.
have satisfied all special conditions.Failureto comply with the above provisions
shall result in forfeiture of reimbursement.
(e)Reports are to be submitted even when no reimbursement is being requested.

(f)The report mustbe electronically signedbythesubgrant recipient or implementing
agency'sChief Financial Officer ortheChief Financial Officerdesignee.
(2)Financial Closeout Audit
(a)The Financial CloseoutAudit shall besubmittedtothe Department within forty-five
(45)daysofthe subgrant expirationdate.
(b)The Financial CloseoutAuditmust be electronically signedbythesubgrantrecipient
orimplementing agency's Chief Financial OfficerortheChief Financial Officer
designee.
(3)Project Generated Income (PGI)
(a)Ifapplicable,thesubgrantrecipientshallsubmitQuarterly PGI Earningsand
ExpendituresReportstotheDepartment within thirty(30)daysaftertheendofthe
reportingperiod covering subgrantproject generated income and expenditures
during the previousquarter.If anyPGIremains unspent afterthe subgrant ends,the
subgrant recipient must continuesubmittingquarterlyPGIreportsuntilallfundsare
expended.(See Item 11,Program Income.)
(b)PGIEarningsandExpendituresreports must beelectronicallysignedbythesubgrant
recipientorimplementingagency'schief financial officerorthechief financial officer's
designee.
a Other Reports
The subgrant recipientshallreporttotheUniformCrime Report and other reports as may be
reasonably required by the Department.
5.Fiscal Control and Fund Accounting Procedures
a.Ail expenditures and cost accountingoffundsshall conform totheOfficeofJustice
Programs Financial Guide,the Common Rule,andOMBCirculars A-21,A-87,and A-110,
or A-102 as applicable,in their entirety.
b.The subgrant recipientisrequiredto establish andmaintain adequate accounting systems
andfinancialrecordsandtoaccurately account forfundsawardedtothem.As asubgrant
recipient,you must havea financial management systeminplacethatisabletorecordand
report onthereceipt,obligation,andexpenditureofgrantfunds.An adequate accounting
system fora subgrant recipient must be able to accommodate afondand account structure
to separately trackreceipts,expenditures,assets,and liabilities forawards,programs,and
subgrant recipients.
c.All funds .spent onthis project shall bedisbursed according to provisions ofthe project
budget as approved by the Department
d.All fundsnotspentinaccordance with thisagreementshallbesubjecttorepaymentbythe
subgrant recipient
6.Payment Contingent on Appropriation and Available Funds
TheStateof Florida's performance and obligation topay under this agreement is contingent upon
anannua!appropriation bythe Florida Legislature.Furthermore,the obligation oftheStateof
Florida toreimbursesubgrantrecipientsfor incurred costs (s subjectto available federal funds.
7.Obligation of Subgrant Recipient Funds
Subgrantfundsshallnotunderanycircumstancesbeobligated prior tothe effective date,or
subsequent to the termination date,ofthesubgrantaward period.Onlyproject costs incurred on
oraftertheeffectivedate,andonor prior tothe termination dateofthesubgrant recipient's

project are eligible for reimbursement.Allpaymentsmustbecompleted within thirty (30)daysof
the end of the subgrant period.
8.Advance Funding
Advance funding maybe provided toa subgrant recipient upona written requestto the
Department.The request mustbe electronically signed bythe subgrant recipient or implementing
agency's Chief Financial Officer ortheChief Financial Officer designee*
9.Trust Funds
a.Theunitof local governmentmustestablishatrustfundinwhichtodepositJAGfunds.
The trustfundmayor may notbeaninterestbearingaccount.
b.Theaccountmayearninterest,butanyearnedinterestmustbeusedfor program purposes
and expended beforethefederalgrant period enddate.Any unexpended interest
remainingatthe end ofthefederalgrant period must besubmittedtotheOfficeofCriminal
Justice Grants for transmittal to the Bureau of Justice Assistance.
10.Travel and Training
The cost of all travelshallbereimbursed according tothesubgrantrecipient'swrittentravel
policy.If the subgrantrecipient does nothaveawrittentravel policy,cost ofalltravel will be
reimbursed accordingto State of Florida TravelGuidelines§112.061,Fla.Stat Anyforeign
travel must obtain prior writtenapproval.
11.Program Income (also known as Project Generated income)
a.All incomegeneratedasa direct resultofasubgrant project shallbedeemed program
income.
b.Any projectthatwillpotentiallyearnPGI must submit anEarningsand Expenditures Report
toreporthow much PGI was earned duringeachquarter.Areport must be submitted each
quarter even ifno PGI was earnedor expended.PGI Earningsand Expenditures reports
must be electronically signed by the subgrant recipient or implementing agency's Chief
Financial Officer or the Chief Financial Officer designee.
c.PGI expenditures requirepriorwrittenapprovalfrom the Office of Criminal Justice Grants.
Programincome must be used forthepurposesofandundertheconditionsapplicableto
the award.If the cost is allowable under the federal grant program,then the cost would be
allowableusingprogramincome.PGIbudget requests mustbe signed bythesubgrant
recipientor implementing agency's ChiefFinancialOfficeror the Chief Financial Officer
designee.
d.Program incomeshouldbeusedasearnedandexpendedassoonas possible.Any
unexpended PGIremainingat the endofthefederalgrantperiod must besubmittedto
OCJG for transmittal to the Bureau of Justice Assistance.
12.Approval of Consultant Contracts
TheDepartmentshallreviewandapprovein writing allconsultantcontracts prior toemployment
ofaconsultantwhen the consultant'srate exceeds $650(excludingtraveland subsistence costs)
per eight-hour day,or$81.25perhour.A detailed justification mustbesubmittedtoand
approvedby FDLE .prior to obligation orexpendituresofsuchfunds.Approvalshallbebased
uponthecontract'scompliancewithrequirements found inthe Financial Guide,theCommon
Ride,andinapplicablestatestatutes.The Department'sapprovalof the subgrantrecipient
agreement does notconstituteapprovalofconsultantcontracts.Ifconsultantsarehiredthrough
a competitive bidding process (not sole source),the $650 threshold does not apply.
13.Property Accountability
a.Thesubgrant recipient agreestouse all non-expendable property for criminal justice
purposes during itsuseful life ordisposeofitpursuantto§274,Fla.Stat.

b.Thesubgrantrecipientshallestablishandadministera system toprotect,preserve,use,
maintain and dispose ofany property furnished toitbytheDepartmentorpurchased
pursuant tothisagreement according to federal property managementstandardsset forth in
theOfficeofJusticePrograms Financial Guide,U.S.DepartmentofJustice Common Rule for
State and Local Governments or the federalOMBCircular A-110 or A-102,as applicable.
Thisobligation continues aslongasthesubgrantrecipientretains the property,
notwithstanding expiration ofthis agreement.
14.Ownership of Data and Creative Material
Ownershipofmaterial,discoveries,inventions,andresultsdeveloped,produced,ordiscovered
subordinatetothis agreement isgovernedbythetermsoftheOfficeofJusticePrograms
Financial Guide(asamended),and the U.S.DepartmentofJusticeCommonRulefor State and
Local Governments,or the federalOMBCircular A-110 or A-102,as applicable.
15.Copyright
The awarding agency reserves aroyalty-free non-exclusive,andirrevocable license to reproduce,
publish,or otherwise use,and authorize others to use,forfederal government purposes:
a.The copyrightin any work developed underanawardorsubaward,and
b.Any rightsofcopyrighttowhichasubgrantrecipientorsubrecipient purchases ownership
with support funded under this grant agreement.
16.Patents
If any program produces patentable items,patentrights,processes,or inventions,in the course
ofwork sponsored by the federalawardorsubawardfunds,such facts must bepromptlyandfully
reported to the awarding agency.
a.Unless there isaprior agreement between the subgrant recipientandthe Department on
dispositionof such items,theDepartmentmay determine whether protectionontheinvention
or discovery willbe sought
b.The Department willalso determine how rightsin the invention or discovery (includingrights
under any patents issued)will be allocated and administered in order to protect the public
interest consistent with "Government Patent Policy"("President's Memorandum for Heads of
Executive Departments andAgencies,"dated August 23,1971,and statement of
Government patent policy,as printedin36Federal Register 16839).
c.Government regulations have been issued inTitle37CFRPart401by the U.S.Department
of Commerce.
17.Publication or Printing of Reports
Thesubgrantrecipientshallsubmitforreviewandapprovalonecopyofany curricula,training
materials,oranyotherwrittenmaterialsthat will bepublished,including web-based materialsand
web sitecontent,throughfundsfromthisgrantatleastthirty(30)days prior tothetargeted
disseminationdate.The subgrantee understands and agrees thatany training materials
developed ordeliveredwithgrantfundingmustadheretotheOJPTrainingGuiding Principles for
Grantees and Subgrantees availableat
www.oiD.usdd.aov/fundina/oiPtrainingguidinQprinciples.htm
Allmaterials publicizing or resulting fromawardactivitiesshallcontainthe following statements:
This projectwassupportedbyAwardNo.awardedbytheBureauofJusticeAssistance,
OfficeofJusticePrograms.Theopinions,findings,andconclusionsorrecommendations
.expressed inthis publication/program/exhibition are those oftheauthorsanddonotnecessarily
reflectthe views of the Department of Justice'7.

18.Audit
a.Subgrant recipients thatexpend $500,000 ormoreinayearin federal awardsshallhavea
single or program-specific audit conducted forthatyear.The audit shall be performed in
accordance with thefederal OMB Circular A-133 andother applicable federallaw.The
contract forthis agreement shallbeidentifiedinthe Schedule ofFederalFinancial Assistance
inthe subject audit.The contract shall be identified as federal funds passed through the
Florida Department of Law Enforcement and include the contract number,CFDA number,
award amount,contract period,funds received and disbursed.When applicable,the
subgrant recipient shall submit an annual financial auditthatmeetsthe requirements of
§11.45,Fla.Stat.,"Definitions;duties;authorities;reports;rules.";§215:97,Fla.Stat,
"Florida Single Audit Act";andRulesofthe Auditor General,Chapter 10.550,"Local
Governmental Entity Audits"and Chapter 10.650,"Florida Single Audit Act Audits Nonprofit
andFor-Profit Organizations."
b.A complete audit report that covers any portion ofthe effective datesofthis agreement must
be submitted within 30days after its completion,but nolater than nine.(9)months afterthe
audit period.In ordertobe complete,the submitted reportshall include anymanagement
letters issued separately and management's written responseto all findings,both audit report
.andmanagementletter fincfings.Incomplete audit reports will notbeacceptedbythe
Department
c.Thesubgrant recipient shallhave all audits completed byan Independent Public Accountant I
(IPA).The IPA shall be either aCertifiedPublic Accountant ora Licensed Public Accountant
d.The subgrant recipientshalltakeappropriatecorrectiveaction within six(6)monthsofthe
issue date oftheauditreportin instances ofnoncompliancewithfederallawsand
regulations.i

e.The subgrant recipient shall ensure that audit working papers are made available tothe j
Department,orits designee,upon request for a period of three (3)years from the date the j
audit report is issued,unless extended in writing by the Department j
f.Subgrant recipientsthat expend lessthan$500,000infederalawardsduringafiscalyearare
exempt fromtheauditrequirementsofOMBCircular A-133 forthatfiscalyear.Inthis case,
writtennotification,whichcanbein the formofthe"CertificationofAudit Exemption1'form,
shallbeprovidedto the DepartmentbytheChiefFinancial Officer,or designee,thatthe
subgrant recipientis exempt.ThisnoticeshallbeprovidedtotheDepartmentnolaterthan
March1 following the endofthefiscalyear.
g.Ifthis agreement is closed outwithoutanaudit,the Department reserves the rightto recover
any disallowed costs identifiedinanauditcompletedafter such closeout
h.A scanned copyof the completed auditreportsoralinktotheelectronicauditreportshould

19.Performance of Agreement Provisions
In the event ofdefault,non-compliance or violationof any provisionofthis agreement bythe
subgrant recipient,the subgrant recipient'sconsultantsandsuppliers,orboth,theDepartment
shall impose sanctions it deems appropriate including withholding payments andcancellation,
termination,or suspension of the agreement inwholeorin part Insuch event,the Department
shallnotify the subgrant recipientof its decision thirty (30)days in advance oftheeffectivedateof
such sanction.The subgrant recipientshallbepaidonlyforthose services satisfactorily
performed priorto the effective date of such sanction.

20.Commencement of Project
a.Ifa project isnot operational within 60daysofthe original start dateofthe award period,the
subgrantrecipient must reportbylettertotheDepartmentthe steps takentoinitiatethe
project,the reasons fordelay,andthe expected startdate.
b.If aprojectisnot operational within90daysofthe original startdateoftheawardperiod,the
subgrantrecipient must submitasecond statement totheDepartmentexplainingthe
implementation delay.
c.Uponreceipt of theninety(90)dayletter,theDepartmentshall determine ifthe reason for
delayisjustifiedorshall,atitsdiscretion,unilaterally terminatethis agreement andre-
obligate subgrant fundstootherDepartmentapprovedprojects.The Department,where
warranted byextenuatingcircumstances,mayextendthestartingdateoftheprojectpastthe
ninety(90)dayperiod,butonlyby formal written adjustment tothis agreement
21.Excusable Delays
a.Except with respect todefaultsofconsultants,the subgrant recipientshallnotbein default by
reason ofanyfailurein performance ofthis agreement accordingtoits terms (including any
failureby the subgrant recipientto make progressinthe execution ofwork hereunder which
endangers such performance)if such failure arises out of causes beyond the controland
without the faultor negligence of the subgrant recipient.Such causes include,butarenot
limitedto,acts ofGodorofthe public enemy,actsofthe government ineitheritssovereign
orcontractualcapacity,fires,floods,epidemics,quarantinerestrictions,strikes,freight
embargoes,andunusually severe weather,butinevery case,the failure toperformshallbe
beyond the control and without the faultor negligence of the subgrant recipient
b.If failuretoperformis caused by failureofa consultant toperformor make progress,andif
such failure arises outof causes beyond the control of subgrant recipient and consultant,and
without faultor negligence of either of them,the subgrant recipient shall not be deemed in
default,unless:
(1)Supplies or services tobefurnishedbythe consultant were obtainablefromother
sources,
(2)The Department orderedthe subgrant recipientinwritingtoprocure such supplies or
services from other sources,and
(3)Thesubgrantrecipientfailedtoreasonablycomplywith such order.
c.Uponrequestofthesubgrant recipient,theDepartmentshallascertainthefactsandthe
extent of such failure,andiftheDepartment determines that any failuretoperform was
occasionedbyoneormoresaidcauses,thedeliveryscheduleshallberevised accordingly.
22.Grant Adjustments
a.Subgrantrecipients must submitagrantadjustmentthroughSIMONformajorsubstantive
changes suchas changes inprojectactivitiesorscopeoftheproject,targetpopulations,
service providers,implementationschedules,project director,anddesignsorresearchplans
set forth inthe approved agreement and for anybudgetchangesthataffectacost category
that was notincludedinthe original budget,Adjustments arealsorequired when there will
beatransferof 10%ormoreofthetotalbudgetbetweenbudgetcategories,orthereisan
indirect cost ratecategorychange.
b.Subgrant recipients maytransferupto 10%ofthe total budgetbetween current,approved
budget categories without prior approval as long asthefundsare transferred toan existing
line item.
c.Underno circumstances cantransfersoffundsincreasethetotal budgeted award.

d.Requests for changes to the subgrant agreement must be electronically signed by tine
subgrant recipient or implementing agency's chief official orthe chief official's designee.
23.Disputes and Appeals
a.The Department shall makeits decision in writing when responding toany disputes,
disagreements,or questions of fact arising under this agreement and shall distribute its
responseto all concerned parties.The subgrant recipient shall proceed diligently with the
performance ofthisagreement according tothe Departnhent's decision.
b.If the subgrant recipient appealsthe Departments decision,the appeal also shall bemadein
writing within twenty:one (21)calendar daystothe Department's clerk (agency clerk).The
subgrant recipient*s right to appeal the Department's decision is contained in§120,Fla.Stat.,
andinprocedures set forth inRule 28-106.104,Florida Administrative Code.Failure to
appeal within thistime frame constitutes a waiver of proceedings under §120,Fla.Stat.
24.Conferences and Inspection of Work .
Conferencesmaybeheldattherequestofany party tothisagreementAtanytime,a
representativeofthe Department,oftheU.S.Department ofJustice,ortheAuditor General ofthe
Stateof Florida,havethe right of visiting the project site to monitor,inspectand assess work
performed underthis agreement.
25.Access to Records
aTheRoridaDepartmentofLawEnforcement,theAuditorGeneralofthe State of Florida,the
U.S.Department ofJustice,the U.S;Comptroller General oranyoftheirdulyauthorized
representatives,shallhaveaccesstobooks,documents,papersandrecordsofthesubgrant
recipient,implementingagencyandcontractorsforthepurposeofauditandexamination
according to the Financial Guide and the Common Rule.
b.TheDepartment reserves therightto unilaterally terminatethis agreement ifthesubgrant
recipient,implementingagency,or contractor refusestoallow public access to all documents,
papers,letters,orother materials subjectto provisions of§119,Fla.Stat,unless specifically
exempted and/or made confidentialbyoperationof§119,Fla.Stat,and made or received
bythe subgrant recipientoritscontractorinconjunctionwiththis agreement.

28.Background Check
Whenever a background screening for employment ora background security check l6requiredby
lawfor employment,unless otherwiseprovidedbylaw,the provisionsof§435,Fla.Stat,shall
apply.

continued employment.Forthe purposes ofthe subsection,security background
investigations shall include,butnotbelimitedto,employment history checks,fingerprinting
forall purposes and checks inthis subsection,statewide criminal and juvenile records checks
throughtheFlorida Department ofLawEnforcement,andfederalcriminal records checks
throughtheFederalBureauofInvestigation,andmayincludelocalcriminalrecords checks
throughlocallaw enforcement agencies.
(1)Anypersonwhoisrequiredtoundergosuchasecuritybackground investigation and
who refuses to cooperate in such investigation or refuses to submit fingerprints shallbe
disqualifiedfor employment insuchpositionor,ifemployed,shallbe dismissed.
(2)Such background investigations shallbe conducted atthe expense of the employing
agency or employee.When fingerprintingis required,the fingerprints of the employee
orapplicantforemploymentshallbetakenbytheemploying agency orbyan
authorized law enforcement officer and submitted tothe Department ofLaw
Enforcement for processing andforwarding,when requested bytheemploying agency,
to the United States Department of Justice for processing.The employing agency shall
reimburse the Department ofLawEnforcementforany costs incurred byitin the
processing of the fingerprints.
29.Drug Court Projects
ADrugCourtProject must complywith§397.334,Fla.Stat,"Treatment-Based DrugCourt
Programs."
30.Overtime for Law Enforcement Personnel
Priortoobligatingfundsfromthisawardtosupportovertimebylaw enforcement officers,theU.S.
DepartmentofJustice encourages consultationwithallallied components ofthecriminaljustice
systemintheaffected jurisdiction.Thepurposeofthisconsultationistoanticipateandplanfor
systemicimpacts such as increased courtdocketsandtheneedfordetention space.
31.Criminal Intelligence System
a.Thesubgrantrecipient agrees thatany information technologysystemfundedorsupported
bytheOfficeofJusticeProgramsfunds will complywith28C.F.R.Part 23,Criminal
Intelligence Systems Operating Policies,ifthe Office ofJusticeProgramsdeterminesthis
regulationtobeapplicable.ShouldtheOfficeofJustice Programs determine28C.F.R.Part
23tobe applicable,the Office ofJustice Programs may,atits discretion,perform audits of
thesystem,as per28C.F.R.23.20(g).Shouldanyviolationof28 C.F.R Part23occur,the
subgrant recipient maybe fined asper42 U.S.C.3789g(c)-(d).Thesubgrant recipient may
not satisfy such afinewith federal funds.
b.The subgranteeunderstandsandagreesthatnoawardedfundsmaybeusedto maintain or
establish acomputer network unlesssuch network blocks the viewing,downloading,and
exchangingof pornography.In doing sothesubgrantee agrees thetheserestrictions will not
limit theuseofawardedfundsnecessaryforanyfederal,state,tribal,or local law
enforcementagencyoranyother entity carrying out criminal investigations,prosecutions,or
adjudication activities.

32.Confidential Funds
A signed certification thatthe project director ortheheadofthe Implementing Agencyhasread,
understands,and agrees to abide byalloftheconditionsforconfidentialfunds as set forthin the
effective edition ofthe Office ofJustice Programs Rnancial Guideis required from all projects that
areinvolvedwith confidential funds.Thesigned certification mustbesubmittedatthetimeof
grantapplication.
33.Civil Rights Compliance
a.Federal laws prohibit recipients of financial assistance from discriminating onthebasisof
race,color,national origin,religion,sex,disability,orageinfunded programs or activities.All
subgrant recipients,implementingagencies,and contractors mustcomplywithanyapplicable
statutorily-imposed nondiscrimination requirements,whichmay include the Omnibus Crime

(3)Asubgrantrecipientorimplementingagencyis exempt fromtheEEOPlanrequirementif

Organizations*!(the"EqualTreatment Regulation8).The Equal Treatment Regulation
providesinpartthatDepartmentofJusticegrantawardsofdirect funding maynotbeusedto
fund any inherently religious activities,suchas worship,religious instruction,or
proselytization.Recipientsofdirectgrantsmay still engagein inherently religious activities,
but such activitiesmust be separate intimeorplace from the DepartmentofJusticefunded
program,and participation in such activities by individualsreceiving services from the grantee
ora sub-grantee must be voluntary.TheEqual Treatment Regulationalso makes clearthat
organizations participating in programs directly funded by the Department of Justice are not
permittedto discriminate in the provision ofservicesonthebasisof a beneficiary's religion.
Thesubgranteealso understands and agrees thatawardfundsmaynotbeusedto
discriminateagainstor denigrate thereligiousor moral beliefsof students who participate in
programsforwhichfinancial assistance isprovided from the award,ortheparentorlegal

34.Immigration and Nationality Act
Nopublicfunds will intentionallybeawardedtoanycontractorwhoknowinglyemploys

Department shallconsider the employment by any contractorof unauthorized aliens aviolationof

35.National Environmental Policy Act (NEPA)
a.The subgrant recipient agrees to assist FDLEincomplyingwiththeNEPA,the National
Historic Preservation Act,andother related federal environmental impact analyses
requirements inthe use ofsubgrantfundsbythesubgrant recipient Thisappliestothe
following new activities whether ornot they arebeingspecificallyfundedwith these subgrant
funds.That is,It applies as longas the activity isbeing conducted bythe subgrant recipient
oranythirdpartyand the activity needs to be undertaken Inorderto use these subgrant
funds,Accordingly,the subgrantee agrees tofirstdetermineifanyofthefollowingactivities
wai be funded by the grant,priortoobligatingfundsforany of these purposes.Ifitis
determinedthatanyof the following activitieswill be fundedbythegrant,the grantee agrees

that are(a)purchased as an incidental component of a funded activityand(b)
traditionally used,for example,in office,household,recreational,or educational
environments.
(5)Implementation ofaprogramrelatingto clandestine methamphetamine laboratory
operations,including the identification,seizure,or closure of clandestine
methamphetamine laboratories.
b.The subgrant recipient understands and agrees that complying withNEPA may require the
preparationofan Environmental Assessment and/oran Environmental Impact Statement,as
directed by the Bureau of Justice Assistance.The subgrant recipient further understands and
agrees to the requirements for implementation ofaMitigationPlan,as detailed by the
Department of Justice at www.bia.gov/Fundinq/nepa.htinl.for programs relatingto
methamphetamine laboratory operations.
c.For any of asubgrantrecipient'sexistingprogramsoractivitiesthat will befundedby these
subgrants,the subgrantrecipient,upon specific requestfrom the Department andtheU.S.
Department of Justice,agrees to cooperate withthe Department ofJustice in anypreparation
by Department of Justice ofanationalorprogram environmental assessment ofthatfunded
program oractivity.
36.Mitigation of Health,Safety and Environmental risks dealing with Clandestine
Methamphetamine Laboratories
If anawardismadetosupportmethamphetamine laboratory operationsthesubgrant recipient
must complywiththiscondition,whichprovidesfor individual site environmental
assessment/impact statements as required underthe National EnvironmentalPolicyAct.
a.General Requirement Thesubgrantrecipientagreestocomplywith federal,state,and local
environmental,healthand safety lawsand regulations applicabletothe Investigation and
closureofclandestinemethamphetamine laboratories andtheremovalanddisposalofthe
chemicals,equipment andwastesusedinor resulting fromtheoperationofthese
laboratories.Thesubgrant recipient alsoagreestocompletea Methamphetamine Mitigation
Plan (WIMP)thatincludesthenineprotectivemeasuresor components requiredbyBJAand
submit the plantoFDLE'sOfficeofCriminalJusticeGrants.
b.Specific Requirements:The subgrant recipient understands andagreesthatany program or
initiative involving the identification,seizure,orclosureofclandestine methamphetamine
laboratories canresultinadverse health,safetyand environmental impactsto (1)thelaw
enforcement andother governmental personnel involved;(2)any residents,occupants,
users,and neighbors ofthesiteofaseized clandestine laboratory;(3)theseized laboratory
site'simmediateand surrounding environment ofthesite(s)where any remaining chemicals,
equipment,andwaste from aseized laboratory's operationsareplacedor come to rest.
Therefore,the subgrant recipient further agreesthatinorderto avoid or mitigate the possible
adversehealth,safetyand environmental impacts from anyof clandestine
methamphetamine operations funded underthis award,it will (1)include the nine,below
listed protective measuresor components;(2)provide fortheiradequate funding to include
funding,as necessary,beyond that provided bythis award;and (3)implement these
protective measures directly throughout the life ofthesubgrant In so doing,the subgrant

recipient understands thatit may implement these protective measures directly through the
useofitsownresourcesandstafformaysecurethe qualified servicesofotheragencies,
contractororotherqualified third party.
(1)Provide medical screening of personnel assigned ortobe assigned bythe subgrant
recipienttotheseizureor closure ifof clandestine methamphetamine laboratories;
(2)Provide Occupational Safety and Health Administration (OSHA)required initial and
refresher training for law enforcement officials and other personnel assigned bythe
subgrant recipient to either theseizureor closure of clandestine methamphetamine
laboratories;
(3)As determined bytheir specific duties,equip personnel assigned tothe project with
OSHA required protectivewearandother required safetyequipment;
(4)Assign properly trained personnel to prepare a comprehensive contamination report on
eachclosed laboratory;
(5)Employ qualified disposalcontractorsto remove all chemicals and associated
glassware,equipment,andcontaminatedmaterialsand wastes from thesite(s)of each
seized clandestine laboratory;
(6)Dispose of the chemicals,equipment,and contaminated materialsand wastes removed
from the sitesof seized laboratories at properly licenseddisposal facilities or,when
allowable,properlylicensed recycling facilities;
(7)Monitor the transport,disposal,and recycling components of subparagraphs 5and6
immediately above inorderto ensure propercompliance;
(8)Haveinplaceandimplementaninter-agency agreement orotherformof commitment
witha responsible State environmental agency thatprovidesforthat agency's (i)timely
evaluation of the environmental conditions at and around the site of a closed clandestine
laboratoryand (ii)coordinationwiththeresponsibleparty,propertyowner,orothersto
ensure that anyresidualcontaminationisremediated,if necessary,andin accordance
with existing federaland state requirements;and
(9)Haveinplaceand implement awritten agreement with the responsible state orlocal
service agencies toproperlyrespondtoanyminor,as definedby state law,atthesite.
This agreement must ensureimmediateresponsebyqualifiedpersonnelwhocan(i)
respond to the potentialhealth needs ofanyminoratthesite;(ii)take that minorinto
protective custody unless the minoriscriminally involved in the meth labactivitiesoris
subject toarrestfor other criminalviolations;(HO ensure immediate medical testingfor
methamphetamine toxicity;and(iv)arrangeforanyfollow-upmedical tests,
examinations,orhealthcare made necessary asaresultof methamphetamine toxicity
37.Non-Procurement,Debarment and Suspension
Thesubgrantrecipient agrees tocomplywith Executive Order12549,Debarmentand
Suspension and 2CFR180,"OMB GuidelinesTo Agencies On Governmentvwde DebarmentAnd
Suspension (Nonprocurement)8 These proceduresrequirethesubgrantrecipienttocertifyitshall
notenterinto any lowertiered covered transactionwithaperson who isdebarred,suspended,
declaredineligible oris voluntarilyexcludedfrom participating inthiscoveredtransaction,unless
authorizedby the Department.If thesubgrantis $100,000 ormore,the subgrant recipientand
implementing agency certify that they andtheir principals;

a.Each subgrant recipient agrees to comply with 28 CFRPart 69,"New Restrictions on

applicable,witheach submission thatinitiates consideration of such subgrant recipientfor
award of federal contract,grant or cooperative agreement of $100,000 or more.

encouraged toadoptand enforce policiesbanning employees fromtext messaging whiledriving
any vehicle during the course ofperformingworkfundedbythis subgrant andto establish
workplace safety policies and conduct education,awareness,and other outreach to decrease

65.System for Award Management (SAM)
The subgrant recipient must maintain current information in SAM untilit submits the finalfinancial

66.Maximum Allowable Salary

Background:The Florida Department ofLaw Enforcement byandthroughits
Office of Criminal Justice Grants awarded the City of South Miami
$3,227.00 fortheprojectentitled,ByrneGrantVehicleBurglary.
The Cityof South Miami will be allocating the funds to reduce crime
and improvepublic safety by purchasing two(2)tablet computers
for Police Officers.
The City will purchase tablets for use by detectives so they can be
in contact with computer aided dispatch for faster response times
and also have the abilityto access the USA software crime
reporting system.Tablet computers will also supplement in-office,
outdated computers to ensure that detectives can manage the
problem of auto theft and auto burglary,bytracking occurrences
and through the use of statistics.

The South Miami Police Department is still inthe process ofconverting toa paperless systemfor
criminal justice reporting.The department hasbeen seeking funding to support the purchase of
tabletcomputersfor police officers.Tablets will enable officers to work more efficiently and
accuratelywhen preparing reports.Although thedepartmenthasbeenableto secure some
funding forthe conversion,the police officers are still in needof updated computer equipment for
daily operations.Current computing units areoutof warranty,inneedof expensive replacement
parts,andno functioning properly.BecausethePoliceDepartmenthasnothadthefundsfor
updating muchneeded computing units,grantfundshavebeen identified topurchasethe
equipment
Project Summary (Scope of Work)
TheSouth Miami PoliceDepartment will utilize FY 2015 JAG fundsto purchase two(2)tablet
computersforpolice officers.Theequipment will makeitpossibleto access necessary dataata
higherspeed,thereforeincreasing productivity.Funding will allow theSouth Miami Police
Departmenttocontinueitseffortstoupgradeequipmentusedtomanage criminal justicedata,
whileincreasing efficiency andeffectiveness.In addition,the tablets will allowtheofficersto
reducethetimeneededtostoredataandrecord keeping.Moreover,thedepartmentcanshare
information withotherlocallawenforcementagencies.In aneffortto improve themanagement
andmaintenanceof criminal justicedata,thedepartmentwill usethisyearsJAG ftinding to
purchase two(2)tablet computers tobeinstalledinpolicevehicles.
Thisproject requests federal grant fundingforalawenforcementor criminal justicetechnology
related projectand may be subject toreview and approvalby the State InformationTechnology
(IT)PointofContact.By utilizing fundsforthis project,thesubrecipientand implementing agency
agree to conform toall state and national standards for technology andinformation sharing
systems that connect to,and/or interface with stateand national systems,and/or reside onthe
state Criminal Justice Network(CJNet).These standards include,but are not limited to,the FBI
CJIS SecurityPolicyandanyrules,regulationsorguidance enacted bythe Criminal andJuvenile
Justice Information System (CJJIS)Council under F.S.943.06.
On June 3,2014 theBoardofCountyCommissionapprovedtheawardofRFP852Computerand
Mobile Hardware contractwithHewlett-PackardCompany(HP)fordesktop computers,
workstations,laptops,tablets and notebooks.The CityofSouth Miami will beprocuringtablet
computers through this Miami-Dade County agreement that underwent abid process.

aProject Performance Reports
(1)Reporting Time Frames:The subgrant recipient shall submit Quarterly Project
PerformanceReportstothe Florida Department ofLawEnforcement,hereafterknownas
the Department,within fifteen (15)days after theendofthe reporting period.In addition,
ifthesubgrantaward period isextendedbeyondthe "original"project period,additional
QuarterlyProjectPerformance Reports shallbesubmitted.
Failure tosubmit Quarterly Performance Reportsthatarecomplete,accurate,andtimely

Manager,or Performance Contacts.
b.Financial Reports
(1)Project Expenditure Reports
(a)The subgrant recipientshallhaveachoiceofsubmittingeitheraMonthlyora
QuarterlyProjectExpenditureReporttotheDepartment.ProjectExpenditure
Reportsare due thirty(30)days after the end of the reportingperiod.In addition,if
the subgrant awardperiodis extended,additionalProject Expenditure Reports shall
be submitted.
(b)Allproject expenditures for reimbursement of subgrant recipient costs shall be
submittedontheProjectExpenditureReportFormsprescribedand provided bythe
OfficeofCriminalJusticeGrants(OCJG)throughtheSIMON (Subgrant Information
Management ON-line)
(c)AllProjectExpenditure Reports shallbe submitted insufficientdetailforproperpre-
audit and post-audit.
(d)Before the "final"ProjectExpenditureReportwillbe processed,thesubgrant
recipient must submit to the Departmentall outstanding project reportsand must
have satisfied allspecialconditions.Failuretocomplywiththe above provisions
shall result in forfeiture of reimbursement

duringthepreviousquarter.If any PGIremains unspent after the subgrant ends,the

(b)PGIEarningsand Expenditures reports must beelectronically signed by the subgrant

5.Fiscal Control and Fund Accounting Procedures
a.All expenditures andcostaccountingoffundsshallconformto the OfficeofJustice
Programs Financial Guide,the Common Rule,and OMBCirculars A-21,A-87f and A-110,
or A-102 asapplicable,intheirentirety.
b.Thesubgrantrecipientisrequiredtoestablishandmaintain adequate accounting systems
and financial recordsandtoaccuratelyaccountforfundsawardedtothem.Asasubgrant
recipient,you must havea financial management system in place thatisabletorecordand
reportonthereceipt,obligation,andexpenditureofgrantfunds.An adequate accounting
system fora subgrant recipient must beableto accommodate afundand account structure
to separately trackreceipts,expenditures,assets,and liabilities forawards,programs,and
subgrant recipients.
c.AH funds spent onthisprojectshallbedisbursed according toprovisionsofthe project
budget as approved by the Department.
d.Allfundsnotspentinaccordancewiththisagreementshallbesubjecttorepaymentbythe
subgrant recipient.
6.Payment Contingent on Appropriation and Available Funds
TheStateof Florida's performance and obligation topayunderthisagreementis contingent upon
anannualappropriationbythe Florida Legislature.Furthermore,theobligationoftheStateof
Florida to ireimburse subgrant recipients for incurred costsissubjectto available federal funds.
7.Obligation of Subgrant Recipient Funds
Subgrantfundsshallnotunder any circumstances beobligated prior totheeffectivedate,or
subsequent totheterminationdate,ofthesubgrantaward period.Onlyproject costs incurred on
or after theeffective date,andonor prior tothe termination dateofthe subgrant recipient's

theendofthe subgrant period.
8.Advance Funding
Advance funding maybe provided toa subgrant recipient upon a written requesttothe

agency's Chief Financial Officer ortheChief Financial Officer designee.
9.Trust Funds
a.The unit of local government must estabOsh atrustfundin which,to deposit JAGfunds.
The trust fuhd mayormaynotbean interest bearing account.
b.Theaccountmayearn interest,butanyearnedinterestmustbeusedfor program purposes
andexpendedbeforethe federal grant period enddate.Anyunexpendedinterest
remainingat the endofthefederalgrantperiod must be submittedtotheOfficeof Criminal
Justice Grants for transmittal to the Bureau of Justice Assistance.
10.Travel and Training
Thecostofalltravelshallbereimbursedaccordingtothesubgrantrecipient'swrittentravel
policy.If thesubgrantrecipientdoesnothavea written travel policy,costof all travelwillbe
reimbursed according toStateof Florida Travel Guidelines §112.061,Fla.Stat.Any foreign
travel must obtainpriorwrittenapproval.
11.ProgramIncome(also known asProjectGeneratedIncome)
a.Allincomegeneratedasadirectresultofasubgrantprojectshallbe deemed program
income.
b.Anyprojectthat will potentially earn PGI mustsubmitanEarningsandExpendituresReport
toreporthowmuch PGI wasearned during each quarter.Areport must besubmittedeach
quarterevenifnoPGIwasearnedor expended.PGI EarningsandExpendituresreports
must beelectronicallysignedbythe subgrant recipientor implementing agency's Chief
FinancialOfficeror the Chief Financial Officer designee.
c.PGI expenditures requirepriorwrittenapprovalfrom the OfficeofCriminal Justice Grants.
Program income must be used forthe purposes ofandunder the.conditions applicableto
the award,if the cost isallowableunderthefederalgrantprogram,thenthe cost would be
allowable using programincome.PGI budget requests must be signed by the subgrant
recipientor implementing agency's ChiefFinancialOfficeror the Chief Financial Officer
designee.
d.Program income shouldbe used asearnedand expended as soon as possible.Any
unexpended PGI remainingattheendof the federal grantperiod must besubmitted,to
OCJG for transmittal to the Bureau of Justice Assistance.
|12.Approval ofConsultant Contracts j
The Department shall review and approve in writing all consultant contracts prior to employment j
ofaconsultant when theconsultant'srate exceeds $650(excludingtraveland subsistence costs)
per eight-hour day,or $8125 per hour.A detailed justification must be submitted to and j
approvedbyFDLE prior to obligation orexpendituresofsuchfunds.Approvalshallbe based j
upon the contract'scompliancewithrequirementsfoundinthe Financial Guide,theCommon i
Rule,andinapplicable state statutes.The Department'sapproval of thesubgrantrecipient
agreement does notconstituteapprovalofconsultantcontracts.If consultants arehiredthrough
acompetitivebidding process (not sole source),the $650 threshold does notapply.
13.Property Accountability
a.The subgrant recipientagreestouse all non-expendable propertyfor criminal justice
purposes duringitsusefullifeor dispose ofitpursuantto§274,Fla.Stat.

b.The subgrant recipientshallestablishandadministera system toprotect,preserve,use,
maintain anddisposeofany property furnished toitbytheDepartmentorpurchased
pursuant tothisagreement according to federal property management standards set forth in
theOfficeofJusticePrograms Financial Guide,U.S.DepartmentofJusticeCommonRule for
State and Local Governments or the federalOMBCircular A-110 or A-102,as applicable.
Thisobligationcontinuesaslongasthesubgrantrecipientretainsthe property,
notwithstandingexpirationofthis agreement.
14.Ownership of Data and Creative Material
Ownership of material,discoveries,inventions,andresultsdeveloped,produced,ordiscovered
subordinatetothis agreement isgoverned by thetermsof the OfficeofJusticePrograms
Financial Guide(asamended),andtheU.S.Departmentof Justice CommonRulefor State and
Local Governments,or the federal OMBCircular A-110 or A-102,as applicable.
15.Copyright
The awarding agency reserves aroyalty-freenon-exclusive,andirrevocable license toreproduce,
publish,or otherwise use,and authorize others to use,forfederal government purposes:
a.The copyright inanywork developed underanawardor subaward,and
b.Anyrightsofcopyrighttowhichasubgrantrecipientorsubrecipient purchases ownership
with support funded under thisgrant agreement.
16.Patents
If anyprogramproduces patentable items,patentrights,processes,orinventions,in the course
ofwork sponsored bythefederalawardor subaward funds,such facts must be promptlyandfully
reportedto the awarding agency.
a.Unless there isaprior agreement between the subgrant recipient and the Department on
dispositionof such items,the Department may determine whether protectionon the invention
or discovery willbe sought.
b.The Department will also determine howrightsin the inventionordiscovery(includingrights
under any patents issued)willbeallocatedand administered inorderto protect the public
interest consistent with "Government PatentPolicy"("President's Memorandum forHeadsof
Executive Departments andAgencies,"dated August 23,1971,and statement of
Government patentpolicy,asprintedin36FederalRegister16839).
c.Government regulations have been issued inTitle37CFRPart401by the U.S.Department
of Commerce.
17.Publication or Printing of Reports
Thesubgrant recipient shallsubmit for reviewand approval onecopyofany curricula,training
materials,oranyotherwrittenmaterialsthatwillbepublished,including web-based materialsand
websitecontent,throughfunds from thisgrantatleastthirty(30)days prior tothetargeted
dissemination,date.Thesubgranteeunderstandsand agrees thatany training materials
developedordeliveredwithgrant funding must adheretotheOJP Training Guiding Principles for
Granteesand Subg rantees availableat

18.Audit
a.Subgrantrecipientsthatexpend $500,000 ormoreinayearin federal awardsshallhavea
singleor program-specific audit conducted forthat year.Theaudit shall be performed in
accordancewiththe federal OMB Circular A-133 andother applicable federal law.The
contractforthis agreement shallbeidentifiedinthe Schedule ofFederalFinancial Assistance
inthesubjectauditThecontract shall be identified as federal fundspassedthroughthe
Florida DepartmentofLawEnforcementandincludethecontractnumber,CFDAnumber,
award amount,contract period,fundsreceivedanddisbursed.When applicable,the
subgrantrecipientshallsubmitanannual financial auditthat meets therequirementsof
§11.45,Fla.Stat.,"Definitions;duties;authorities;reports;rules.";§215.97,Ra.Stat,
"Florida SingleAudit Act";andRulesofthe Auditor General,Chapter10.550,"Local
Governmental Entity.Audits"and Chapter 10.650,"Florida SingleAuditActAudits Nonprofit
andFor-Profit Organizations."
b.A complete auditreportthat covers anyportionoftheeffective dates ofthis agreement must
besubmittedwithin30daysafteritscompletion,butnolaterthannine(9)months afterthe
auditperiod.In ordertobecomplete,the submitted reportshallincludeany management
letters issued separatelyandmanagement'swrittenresponsetoall findings,bothaudit report
and management letterfindings.Incompleteauditreportswillnotbe accepted bythe
Department.
c.Thesubgrantrecipientshall have allaudits completed byan Independent PublicAccountant
(IPA).The IPA shall be either aCertifiedPublic Accountant ora Licensed Public Accountant.
d.The subgrant recipientshall take appropriatecorrectiveactionwithinsix(6)months ofthe
issue dateof the auditreportin instances of noncompliance withfederal laws and
regulations.
e.The subgrant recipientshall ensure thatauditworking papers are made availabletothe
Department,orits designee,upon request foraperiodof three (3)years from the datethe
auditreportis issued,unless extended inwritingby the Department.
f.Subgrantrecipientsthat expend lessthan$500,000infederalawardsduringafiscalyearare
exempt from the audit requirements ofOMBCircular A-133 forthatfiscalyear.Inthis case,
written notification,which can bein the form of the "Certification of Audit Exemption"form,
shallbeprovidedto the Departmentby the Chief Financial Officer,or designee,thatthe
subgrantrecipientis exempt Thisnoticeshallbeprovidedto the Departmentnolaterthan
March1following the end of the fiscalyear.
g.If this agreement isclosedoutwithoutanaudit,the Department reserves the righttorecover
anydisallowed costs identifiedinanaudit completed after such closeout.

19.Performance of Agreement Provisions
In the event ofdefault,non-comprianceorviolationofanyprovision of this agreement by the
subgrant recipient,the subgrant recipient's consultants and suppliers,or both,the Department
shall imposesanctionsit deems appropriate including withholding paymentsand cancellation,
termination,or suspension oftheagreementinwholeorinpartInsuchevent,the Department
shall notifythesubgrantrecipientofits decision thirty (30)daysinadvanceoftheeffectivedateof
suchsanction.Thesubgrant recipient shall be paidonlyforthoseservices satisfactorily
performed priorto the effective date of such sanction.

20.Commencement of Project
a.If a project isnot operational within 60daysofthe original startdateofthe award period,the
subgrant recipient must report by letter tothe Department thestepstakento initiate the
project,the reasons fordelay,andthe expected startdate.
b.ifa project isnot operational within 90daysofthe original start dateofthe award period,the
subgrant recipient mustsubmitasecondstatementtothe Department explaining the
implementation delay.
c.Uponreceiptoftheninety (90)day letter,theDepartmentshalldetermineifthereasonfor
delayisjustifiedorshall,at its discretion,unilaterally terminatethis agreement andre-
obligatesubgrantfundstootherDepartmentapproved projects.TheDepartment,where
warranted byextenuatingcircumstances,mayextendthe starting dateofthe project pastthe
ninety(90)dayperiod,butonlybyformalwritten adjustment tothis agreement
21.Excusable Delays
a.Exceptwith respect todefaultsofconsultants,thesubgrantrecipientshallnotbeindefaultby
reasonofany failure inperformanceofthisagreement according toitsterms (including any
faftlure bythe subgrant recipientto make progress in the execution of work hereunder which
endangers suchperformance)if such failurearisesoutof causes beyond thecontroland
without the faultor negligence of the subgrant recipient Such causes include,butare not
limitedto,acts of Godorofthepublic enemy,actsof the government in either its sovereign
orcontractual capacity,fires,floods,epidemics,quarantine restrictions,strikes,freight
embargoes,andunusually severe weather,butin every case,thefailuretoperformshallbe
beyond the controlandwithoutthefaultornegligenceof the subgrantrecipient.
b.Iffailuretoperformis caused byfailureofa consultant toperformor make progress,andif
suchfailurearisesoutof causes beyond the controlofsubgrantrecipientandconsultant,and
withoutfaultor negligence of eithef of them,the subgrant recipientshallnot be deemed in
default,unless:
(1)Supplies or services to be furnishedby the consultant were obtainable fromother
sources,
(2)The Departmentorderedthesubgrantrecipientin writing toprocuresuchsuppliesor
services from other sources,and
(3)The subgrantrecipient failed toreasonablycomplywithsuchorder.
c.Upon request ofthesubgrantrecipient,the Department shallascertain the factsand the
extent of such failure,andif the Department determines thatanyfailuretoperform was
occasionedbyoneormoresaid causes,thedelivery schedule shallberevised accordingly.
22.Grant Adjustments
a.Subgrantrecipients must submitagrant adjustment throughSIMONformajorsubstantive
changessuchaschangesin project activities orscopeofthe project,target populations,
serviceproviders,implementation schedules,project director,and designs orresearchplans
set forth intheapprovedagreementandforanybudgetchangesthataffectacostcategory
thatwasnotincludedinthe original budget,Adjustments arealsorequiredwhenthere will
beatransferof10%ormoreofthetotalbudgetbetweenbudgetcategories,orthereisan
indirect costratecategorychange.
b.Subgrantrecipientsmaytransferupto 10%ofthetotalbudget between current,approved
budgetcategorieswithout prior approval aslongasthefundsaretransferredtoanexisting
line item.
c.Underno circumstances cantransfersoffundsincreasethetotal budgeted award.

d.Requests for changes tothe subgrant agreement must be electronically signedbythe
subgrant recipient or implementing agency's chief official orthe chief official's designee.
23.Disputes and Appeals
a.The Department shall make its decision in writing when responding toany disputes,
disagreements,or questions of fact arising under this agreement and shall distribute its
response to all concerned parties.The subgrant recipient shall proceed diligently with the
performance ofthisagreement according tothe Department's decision.
b.If the subgrant recipient appeals the Department's decision,the appeal also shall bemadein
writing within twenty-one (21)calendar days tothe Department's clerk (agency clerk).The
subgrant recipient's right to appeal the Department's decision is contained in §120,Fla.Stat,
andinproceduresset forth inRule28-106.104,Florida Administrative Code.Failure to
appeal within thistime frame constitutes a waiver of proceedings under §120,Fla.Stat
24.Conferences and Inspection of Work
Conferences maybe held atthe request ofany party tothis agreement.Atany time,a
representativeoftheDepartment,oftheU.S.DepartmentofJustice,ortheAuditorGeneralofthe
Stateof Florida,havethe right of visiting the project siteto monitor,inspect andassess work
performed under this agreement
25.Access to Records
a.The Florida Department ofLaw Enforcement,the Auditor GeneraloftheStateof Florida,the
U.S.Department of Justice,the U.S.Comptroller General oranyoftheirduly authorized
representatives,shall haveaccesstobooks,documents,papersand records ofthe subgrant
recipient,implementing agencyand contractors forthepurposeof audit and examination
according to the Financial Guide andthe Common Rule.
b.The Department reservesthe right to unilaterally terminate thisagreementifthe subgrant
recipient implementing agency,or contractor refusesto allow public accesstoalldocuments,
papers,letters,orother materials subjectto provisions of§1.19,Fla.Stat,unless specifically
exempted and/ormadeconfidentialbyoperationof§119,Fla.Stat.,and made orreceived
bythesubgrant recpient orits contractor in conjunction withthisagreement.
c.Thesubgrantrecipientwillgivetheawardingagencyor the GeneralAccountingOffice,
throughanyauthorizedrepresentative,access toandtherightto examine allpaperor
electronic records related to the.financial assistance.
26.Retention of Records
The subgrantrecipientshallmaintainallrecordsand documents foraminimumof five (5)yearsfrom
thedateofthefinal financial statement andbeavailableforauditandpublicdisclosureuponrequest
ofdulyauthorizedpersons.The subgrantrecipientshallcomplywithStateof Florida General

27.Personnel Changes
Upon implementation of the project,\r\the event there isa change inChiefOfficialsfor the
SubgrantrecipientorImplementing Agency oranycontact information toincludemailingaddress,
phone number,emailortitle change,project staff must notifytheSIMONhelp desk toupdatethe
organizationalinformationinSIMON.If theprojectdirector changes,agrant adjustment must be
entered in SIMON to reflect the change.
28.Background Check
.Whenever abackgroundscreeningforemploymentorabackgroundsecurity check is required by
lawfor employment,unlessotherwise provided bylaw,theprovisionsof§435,Fla Stat shall
apply.

a All positionsin programs providing careto children,the developmental^disabled,or
vulnerableadultsfor15hoursormoreper week;all permanent andtemporary employee
positionsofthecentral abuse hotline;and all personsworkingundercontractwhohave
access to abuse records are deemed to be persons and positions of special trust or
responsibility andrequireemploymentscreeningpursuantto§435,Fla.Stat.,using the level
2 standards set forthinthat chapter.
b.All employees inpositionsdesignatedbylawaspositionsoftrustorresponsibilityshallbe
required toundergosecuritybackgroundinvestigationsasaconditionof employment and
continued employment For the purposes of the subsection,security background
investigationsshallinclude,butnotbe limited to,employment history checks,fingerprinting
forall purposes and checks inthis subsection,statewide criminalandjuvenile records checks
through the Florida Department ofLaw Enforcement,andfederalcriminal records checks
through the FederalBureauof Investigation,andmayincludelocalcriminalrecords checks
throughlocallaw enforcement agencies.
(1)Anypersonwhoisrequiredtoundergosuchasecuritybackgroundinvestigationand
whorefusestocooperateinsuchinvestigationor refuses tosubmit fingerprints shallbe
disqualifiedfor employment insuchpositionor,if employed,shall be dismissed.
(2)Such background investigationsshall be conducted at the expense of the employing
agency or employee.When fingerprintingisrequired,the fingerprintsof the employee
orapplicantfor employment shallbetakenbytheemploying agency orbyan
authorized law enforcement officer and submitted to the Department of Law
Enforcement forprocessingand forwarding,when requested by the employing agency,
to the United States Department of Justice for processing.The employing agency shall
reimbursetheDepartmentofLaw Enforcement forany costs incurredbyitinthe
processing of the fingerprints.
29.Drug Court Projects
ADrugCourtProject must comply with§397.334,Fla.Stat,"Treatment-Based DrugCourt
Programs."
30.Overtime for Law Enforcement Personnel
Priortoobligatingfundsfromthisawardtosupport overtime bylaw enforcement officers,theU.S.
DepartmentofJustice encourages consultation with allallied components ofthe criminal justice
system in the affected jurisdiction.Thepurposeofthisconsultationistoanticipateandplanfor
systemic impacts such as increased court dockets and the need for detention space.
31.Criminal Intelligence System
a.The subgrant recipient agrees thatanyinformation technology system fundedorsupported
bytheOfficeofJusticeProgramsfunds will complywith28C.F.R.Part23,Criminal
Intelligence Systems OperatingPolicies,if the Office of Justice Programs determines this
regulation tobe applicable.ShouldtheOfficeofJusticeProgramsdetermine28C.F.R.Part
23tobeapplicable,theOfficeofJusticeProgramsmay,atitsdiscretion,performauditsof
the system,asper28C.F.R.23.20(g).Shouldanyviolationof28C.F.R.Part23occur,the
subgrantrecipientmaybefinedasper42U.S.C.3789g(c)-(d).Thesubgrantrecipientmay

proselytization.Recipients of direct grantsmay still engagein inherently religious activities,
butsuch activities mustbeseparateintimeorplace from the Department ofJustice funded
program,and participationinsuchactivitiesby individuals receiving services fromthe grantee
ora sub-grantee mustbe voluntary..TheEqualTreatment Regulation alsomakesclearthat
organizations participating inprograms directly fundedbytheDepartmentofJusticearenot

34.Immigration and Nationality Act
No public funds will intentionally beawardedtoanycontractorwho knowingly employs

Departmentshall consider theemploymentbyanycontractorofunauthorizedaliensa violation of

35.National Environmental Policy Act (NEPA)
a.The subgrant recipient agrees to assist FDLE m complying withtheNEPA,theNational
Historic PreservationAct,andotherrelatedfederalenvironmentalimpactanalyses
requirements intheuseofsubgrantfundsbythesubgrant recipient.This applies tothe
following new activities whetherornottheyarebeing specifically funded with these subgrant
funds.Thatis,Itapplies as longasthe activity isbeing conducted bythe subgrant recipient
oranythirdparty and the activity needs tobe undertaken inorderto use these subgrant !
funds,Accordingly,the subgrantee agrees to first determine if any of the following activities !
will be funded by the grant,prior to obligating funds for any of these purposes.If it is \

b.The subgrant recipient understands and agrees thatcomplyingwithNEPAmay require the
preparation of an Environmental Assessment and/or an Environmental Impact Statement,as
directedbytheBureauof Justice Assistance.The subgrant recipientfurther understands and
agrees to the requirements forimplementationofa Mitigation Plan,as detailed bythe
Department of Justice -at www.bfa.aov/Fundina/nepa.html.for programs relatingto
methamphetamine laboratory operations.
c.Foranyofa subgrant recipient'sexistingprogramsoractivities that will befundedby these
subgrants,the subgrant recipient,upon specific request from the Department and the U.S.
DepartmentofJustice,agrees to cooperate withthe Department of Justice inanypreparation
byDepartmentofJusticeofanationalorprogramenvironmental assessment ofthatfunded
program or activity.
36.Mitigation of Health,Safety and Environmental risks dealing with Clandestine
Methamphetamine Laboratories
If anawardismadetosupport methamphetamine laboratory operations the subgrant recipient
must comply withthiscondition,which provides forindividualsite environmental
assessment/impact statements as requiredundertheNationalEnvironmentalPolicyAct
a.General Requirement The subgrant recipient agrees tocomplywithfederal,state,and local
environmental,healthandsafetylawsandregulations applicable totheinvestigationand
closureof clandestine methamphetamine laboratoriesand the removalanddisposalofthe
chemicals,equipment,and wastes usedinorresultingfromthe operation*ofthese
laboratories.Thesubgrantrecipientalso agrees tocompleteaMethamphetamine Mitigation
Plan (MMP)thatincludesthenineprotective measures or components requiredbyBJAand
submit the planto FDLE's OfficeofCriminal Justice Grants.
b.SpecificRequirements:Thesubgrantrecipientunderstandsand agrees thatanyprogramor
initiative involving theidentification,seizure,or closure of clandestine methamphetamine
laboratories canresultin adverse health,safety and environmental impactsto(1)thelaw
enforcementandothergovernmentalpersonnel involved;(2)anyresidents,occupants,
users,andneighborsofthesiteofaseizedclandestine laboratory;(3)theseized laboratory
site's immediate and surrounding environment ofthesite(s)whereany remaining chemicals,
equipment,and waste froma seized laboratory'soperationsare placed orcometorest.
Therefore,thesubgrantrecipientfurther agrees thatinordertoavoidor mitigate thepossible
adverse health,safety and environmental impacts fromanyof clandestine
methamphetamine operations funded under thisaward,itwill(1)include the nine,below
listedprotective measures orcomponents;(2)providefortheir adequate fundingtoinclude
funding,as necessary,beyondthatprovidedbythisaward;and(3)implement these
protective measures directlythroughout the lifeofthesubgrant.In sodoing,thesubgrant

recipient understandsthatitmayimplementthese protective measures directly throughthe
useofitsown resources andstafformaysecurethe qualified servicesofotheragencies,
contractororother qualified third party.-
(1)Provide medical screening of personnel assignedortobeassignedbythesubgrant
recipienttotheseizureorclosureifofclandestine methamphetamine laboratories;
(2)Provide Occupational Safetyand Health Administration (OSHA)required initial and
refresher training forlawenforcement officials andotherpersonnelassignedbythe
subgrant recipient toeithertheseizureorclosureofclandestine methamphetamine
laboratories;
(3)Asdeterminedbytheirspecificduties,equippersonnelassignedtotheproject with
OSHA required protective wearandotherrequiredsafety equipment;
(4)Assign property trained personnel to prepare acomprehensive contamination reporton
each closed laboratory;
(5)Employ qualified disposal contractorsto remove ail chemicals and associated
glassware,equipment,andcontaminatedmaterialsand wastes fromthesite(s)ofeach
seized clandestine laboratory;
(6)Disposeof the chemicals,equipment,andcontaminatedmaterialsand wastes removed
fromthesitesof seized laboratories at properly licenseddisposal facilities or,when
allowable,properly licensed recycling facilities;
(7)Monitor thetransport,disposal,and recycling components ofsubparagraphs5and6
immediately above inorderto ensure propercompliance;
(8)Haveinplaceandimplementaninter-agency agreement orotherformof commitment
witharesponsible State environmentalagencythatprovidesforthat agency's (i)timely
evaluation of the environmental conditions at and around the site of a closed clandestine
laboratoryand (ii)coordinationwith the responsibleparty,propertyowner,orothersto
ensure thatanyresidualcontaminationisremediated,if necessary,andin accordance
withexistingfederaland state requirements;and
(9)Haveinplaceandimplementawritten agreement withtheresponsible state or local
service agencies toproperlyrespondtoanyminor,asdefinedby state law,atthesite.
This agreement must ensure immediate response byqualified personnel who can (1)
respondto the potentialhealth needs ofanyminoratthesite;(ii)take thatminorinto
protective custody unless theminoris criminally involvedin the meth labactivitiesoris
subject toarrestforother criminal violations;(iii)ensure immediate medicaltestingfor
methamphetamine toxicity;and(iv)arrangeforany follow-up medical tests,
examinations,or health care made necessary as aresult of methamphetamine toxicity

Coastal Barrier Resources System.

measure that is undertaken onthe incidence ofcrimein the geographic area where the

44.Environmental Protection Agency's (EPA)list of Violating Facilities
The subgrant recipient assures thatthefacilities under itsownership,lease orsupervisionwhich
shallbeutilizedin the accomplishment ofthe Program Purpose are notlistedon the EPA'slistof
•Violating Facilitiesandthatit will notifythe Department ofthereceiptofanycommunicationfrom
theDirectorof the EPAOfficeofFederalActivitiesindicatingthata facility tobe used in the
projectisunder consideration forlistingbythe EPA.
45.Flood Disaster Protection Act
The subgrant recipient wifl complywithSection102(a)of the Flood Disaster ProtectionActof
1973,PublicLaw93-234,87 Stat 975,requiringthat the purchase of floodinsurancein
communities where such insurance is available as aconditionof the receipt ofany federal
financial assistance for construction oracquisition purposes for use inany area that has been
identified as an area having special flood hazards.
46.National Historic Preservation Act
It will assist theDepartment(if necessary)in assuring compliance with section 106 ofthe National
Historic PreservationActof1966(16U.S.C.§470),Ex.Order11593 (identification and

networksas the communication backbone to achieve interstateconnectivity,unless thesubgrant
recipient can demonstrate to the satisfactionofthe Bureau of Justice Assistance thatthis

53.Supplanting
The subgrant recipient agreesthatfundsreceivedunderthisaward will notbeusedto supplant

based)task forcetraining.The training isprovidedfreeofchargeonlinethroughBJA'sCenterfor

required tocompletethis training once during the life oftheaward,oronceevery four yearsif

64.Text Messaging While Driving
PursuanttoExecutiveOrder 13513,"FederalLeadershipon Reducing Text MessagingWhile
Driving,"74Fed.Reg.51225 (October 1,2009),and§316.305,F.S.,thesubgrant recipient is
encouragedtoadoptandenforce policies banningemployees from text messaging while driving
any vehicle,during the course of performing workfundedbythissubgrantandtoestablish
workplace safety policies andconduct education,awareness,andotheroutreachtodecrease
crashes caused bydistracteddrivers.
65.System for Award Management (SAM)
The subgrant recipient must maintaincurrent information inSAMuntilit submits the final financial
report requiredunderthisawardorreceivesthe final payment,whicheverislater.Thisrequires
thatthe subgrant recipient review and update the informationat least annually after the initial
registration,andmore frequently if required bychangesin its information oranother award term.
66.Maximum Allowable Salary
Noportionof these federalgrantfundsshallbe used towards anypartof the annual cash
compensation ofany employee ofthesubgrantrecipient whose totalannual cash compensation
exceeds 110%ofthe maximum salarypayabletoa member oftheFederal government's Senior
ExecutiveServiceatan agency withaCertified SES PerformanceAppraisal System for thatyear.

DNAlabwith access toCODIS.NoprofilesgeneratedwithJAGfundingmay be enteredintoany
othernon-governmentalDNA database without prior express writtenapprovalfromBJA.For

68.interoperable Communications Guidance
Subgrant recipients thatareusing funds to support emergency communications activities must
comply with the current SAFECOM Guidance for Emergency Communication Grants,including
provisions on technical standardsthatensureandenhance interoperable communications.
Emergency communications activities include the purchase of Interoperable Communications
Equipment and technologies suchas voice-over-internet protocol bridging or gateway devices,or
equipment to support the build outof wireless broadband networks in the 700 MHz public safety
band underthe Federal Communications Commission (FCC)Waiver Order.SAFECOM guidance

Subgrant recipients Grantees interested in developing a public safety broadband network inthe
700 MHz bandintheir jurisdictions must adhere tothetechnicalstandards set forth intheFCC
Waiver Order,oranysucceeding FCC orders,rules,or regulations pertaining to broadband
operations in the700 MHz public safety band.The subgrant recipient shall alsoensure projects
support the Statewide Communication Interoperability Plan (SCIP)andare fully coordinated with
the full-time Statewide Interoperability Coordinator (SWIC).If any future regulatory requirement
(from the FCC or other governmental entity)results in a material technical or financial changein
the project,the recipient should submit associated documentation,andother material,as
applicable,forreviewbytheSWICtoensure coordination.Subgrant recipients must provide a
listing of ail communications equipment purchased with grant award funding (plus the quantity
purchasedofeachitem)to FDLE once items are procured during anyperiodic programmatic
progress reports.
69.Ballistic-Resistant and Stab Resistant BodyArmor
SubgrantrecipientsthatwishtopurchasearmorwithJAGfunds must certify that(aw
enforcement agencies receiving vests havea written "mandatory wear1'poficy jneffect.This
policy must beinplaceforatleast all uniformedofficersbefore funding canbeusedby the
agencyforbody armor.Thereareno requirements regarding thenatureofthe policy otherthanit
being amandatorywearpolicy for all uniformed officers whileonduty.FAQs related tothe

JAGfundsmaybeusedtopurchasearmorforanagency,butmaynotbeusedasthe50%

from any distributor or manufacturer,aslongasthevestshave been testedandfoundtocomply
with applicable National Institute ofJusticeballisticor stab standards andarelistedonthe NIJ
CompliantBodyArmorModelList (http://nij.gov).Inaddition,bodyarmor purchased mustbe

70.BJA orFDLE Sponsored Events
The subgrant recipient agrees to participate inBJA-orFDLE-sponsoredtrainingevents;technical

71.Expenses Related to Conferences,Meetings,Trainings,and Other Events
The subgrantrecipient agrees tocomplywithallapplicablelaws,regulations,policies,and

provided underthisaward,thesubgrantee will promptly notify,in writing thegrant manager forthis
