RESOLUTION NO.217-00-11110 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,RELATING TO A REQUEST PURSUANT TO SECTION 20-5.9(G)(7) OF THE LAND DEVELOPMENT CODE FOR A VARIANCE TO WAIVE THE 14 OFF- STREET PARKING SPACES REQUIRED FOR A GENERAL RESTAURANT TOBE LOCATED AT 4016 AND 4020 SW 57th AVE. WHEREAS,Ernesto Llerandi,on behalf of Matthews-Jacobs Investments,L.C,property owners of 4016 and 4020 SW 57th Ave,submitted an application for a variance to waive the fourteen (14)off-street parking spaces required for a general restaurant to be located at 4016 and 4020 SW 57th Ave;and WHEREAS,Section 20-5.9(G)(7)of theLand Development Code provides thata parking variancemaybegrantedbytheCityCommissionafterapublichearingandreceiptofa recommendation from the Planning Board;and WHEREAS,The Planning staff recommended denialofthe variance request;and WHEREAS,onSeptember26,2000,thePlanningBoardvoted5-0torecommend denial of the variance request;and, WHEREAS,the Mayor andCity Commission of theCity of South Miami desire toaccept the recommendation of the Planning Board. APPLICABLE REGULATIONS: TheLDC,Section20-5.9(G)(7)providesthataparkingvariancemaybegrantedbytheCity Commission afterapublichearingandreceipt of a recommendation from the PlanningBoard. STAFF ANALYSIS: Avariancerequestmay be approved for off-street parking bytheCity Commission asper Section 20-5.9(G)(7)Variance Approval of theLDC."Delicias De Espana"restaurant is requestingavariancefor14parkingspaces.Therestaurantwithatotal of 3,254squarefeethasa parking requirement of 1spaceforevery100squarefeet,requiringatotal of 33parkingspaces. Currentlythe restaurant occupies2,034squarefeet.Theapplicantisproposingtoextendthe existingbakeryanddelibyanadditional1,220squarefeet,whichwillprovideadiningareafor approximately twenty patrons.The proposed expansion will result inatotalof 3,254 square feet withaparkingrequirement of 1spacerequiredforevery 100 squarefeetrequiringatotal of 33 parkingspaces.Thepreviousretailusewaslessintensewith1spaceforevery300squarefeet therebyresultingina "credit"of 19 parking spaces.Indeterminingrequiredparking,creditis givenforthe existing 2,34 square feet of deli@1to150 square feetandthe additional 1,220 squarefeetofpreviouslyretailuse@1to300square feet,resultinginacreditof19parking spaces.Fourteenadditionalparking spaces are required.Theapplicant,from surrounding properties,attempted unsuccessfully toprovidetheadditional14 parking spaces andtheletters attached will reflect several attempts.However,either because of the distance requirement orthe fact that there isno surplus parking onsite.The applicant has been unable to comply withthe parking requirement.Asaresult,theapplicantatthistimeisrequestingavarianceapprovalon tonight's agenda item number PB-000-016. The following observations,formthebasisforthe staffs recommendation: 1)There areno special conditions attributable tothe property that would make it different from the neighboring properties; 2)The applicant has failed to meet the hardship statement,as set forth in Section 20-5.9(C). 3)Granting theparkingvariancewithouthardshipmaysetaprecedence,whichwouldnegate the City's efforts to encourage other applicants tomeet minimum required parking. 4)Other shared parking is available inthearea,especially inthe evening andon weekends. 5)Limited public parking is available. PLANNING BOARD RECOMMENDATION The Planning Boardatits September 26,2000 meeting adopted a motion adopted a motion (5-0) recommending denial of the parking variance requested RECOMMENDATION Itis recommended that the variance request be denied because the hardship,as defined bythe LDC,cannot be met. Theparkingissues concerning thiscommercialareaneedtobeaddressed.Staff hasbegunthe design process to provide additional parking on 41st Street.However,employees are currently parking inthis unimproved arearatherthaninremoteareas.Remote parking for employees should be secured and enforced otherwise these new improvements on 41s1 Street will not yield new "customer"parking. Additionally,itisalsorecommendedthatconsiderationbegiventograntingthisbuilding contributed building status similar tothe Hometown district.Contributed buildings have different parking requirements. Oncetheseissuesareresolvedthevariancerequestshouldbereconsidered.
