RESOLUTION NO.216-00-11109 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,RELATING TO A REQUEST PURSUANT TO SECTION 20-3.4(B)(4) OF THE LAND DEVELOPMENT CODE FOR A SPECIAL USE APPROVAL TO LOCATE AN GENERAL RESTAURANT IN THE "GR"GENERAL RETAIL ZONING DISTRICT SPECIFICALLY LOCATED AT 4016 AND4020SW57thAVE. WHEREAS,Ernesto Llerandi,on behalf of Matthews-Jacobs Investments,L.C..property owners of 4016 and 4020 SW 57th Ave,submitted an application fora special useto allow a general restaurant tobe located ina "GR",GeneralRetail zoning district specifically at4016and4020SW 57th Ave;and WHEREAS,a general restaurant is allowed asa special useina General Retail Zoning District subject to meeting certain conditions specified inthe Land Development Code Section 20- 3.4(B)(4);and WHEREAS.The approval of a special use requires a recommendation from the Planning Board andthe approval of theCity Commission after apublic hearing;and WHEREAS,The Planning and Zoning Department staff recommended denial of the proposed special use;and WHEREAS,on September 26,2000,the Planning Board voted5-0to recommend denialof the special use request;and, WHEREAS,the Mayor andCity Commission of theCity of South Miami desire toaccept the recommendation of the Planning Board. APPLICABLE REGULATIONS: The LDC,Section 20-3.4(B)(4)(b),provides that special use requests must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board.The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood.In addition,special uses may also be required to comply with the additional requirements,which are set forth in Section 20-3.4(B)(4)(b).In the case of a general restaurant the following supplemental requirements are listed: (i)All such establishments shall provide only inside or patio service on private property. Public streets,rights-of-way,sidewalks and required setbacks may not be used for patio orstreet-sideservices of anykind. (ii)No services ofa drive-in or ofa fast food nature shall be permitted (iii)The city commission shall review and recommend approval,disapproval or modification of all site plans and projects specifications for this special use permit. ••&• The requested special usemust comply with the JLDC requirements!set forth in Section 20- 5.8(B)(1)in that the use:;:\•"•'.f ;| a)Willnotadverselyaffectthehealthorsafetyofpersons residing orworkinginthe vicinity of the proposed use, b)Willnotbedetrimentaltothepublicwelfareorpropertyorimprovementsinthe neighborhood;and, c)Complies with all other applicable Code provisions. STAFF ANALYSIS: The proposed useis located inthe "GR"GeneralRetaildistrict..A general restaurantis permitted withSpecialUseApproval.Theproposedusemustmeetthe requirements for specialuses contained under Section 20-3.4(B)(4)(b)General Restaurant and Section 20-5.8SpecialUse Approval of theLDC.Ageneralrestaurantshallmeananestablishmentwheretheprincipal business isthesale of food and beverages tothe customer ina ready-to-consume state and where thedesignshallprovideasit-downareaforthecustomers."DeliciasDe Espana"isanexisting bakeryanddeli serving avariety of Spanishcuisine and occupies2,034squarefeet.The applicantisproposingtoextendtheexistingbakeryanddelibyanadditional1,220squarefeet, whichwill provide adiningareafortwentypatrons.Theproposed expansion willresultinatotal of 3,254squarefeetwithaparkingrequirement of onespacerequiredforevery 100 squarefeet requiringatotal of 33 parking spaces.Indeterminingrequiredparking,creditisgivenforthe existing2,034squarefeet of deli@1to150squarefeetandanadditional1,220squarefeet of previouslyretailuse@1to300squarefeet,resultinginacredit of 19parkingspaces.Atotal of 14additionalparkingspacesarerequired.Therefore,tocomplywith the parkingrequirement, the applicant has chosen torequestavariance,whichisaseparateitem number PB-00-017 on tonight's agenda.Furthermore,theapplicantintendstoofferbeerandwine,requiringaseparate permit. This application does not conflict with the Comprehensive Plan. The following observations,formthebasisforthe staffs recommendation: 1)Applicant had been advised to resubmit revisedplans indicating an enclosed air-conditioned trash room.Revised plans have not been submitted. 2)Todate,the applicant hasnotbeenabletoprovidetherequiredparkingspaces. 3)Theapplicant'srequesttomeettheparking requirements throughavariance,undera separate application,is recommended fordenialbystaff.
