WHEREAS,Habitat for Humanity of Greater Miami,Inc.has made application for a variance from Section 20-3.5 (E)of the Land Development Code to allow a twenty-four feet three inches (24'-3")rear setback where a twenty-five (25)foot setback is required on property located intheRS-4 Single-Family Residential zoning district;and, WHEREAS,the property is located at 6039 S.W.63 Terrace; South Miami,Florida,33143,and is legally described as follows: Lot 75,Block 14,together with the east 7.50 feet of that portion ofthe15.00footwide alley adjacent to said lot 75 (Closed by Resolution No.R-92-1515), "Franklin Subdivision",according to the plat thereof, as recorded on platbook 5atpage34,ofthe Public records of Miami-Dade County,Florida,less the South 10.00 feet thereof;and, WHEREAS,Planning Division staff recommended approval of the application fora variance upon evaluating the application for (a)consistency withtheComprehensivePlanand (b) compliance withthe hardship requirement containedinSection 20-5.9 (C)of the Land Development Code;and, WHEREAS,on May 30,2000,the Planning Board voted 6:0 to recommend approval of the variance;and, WHEREAS,the Mayor and City Commission ofthe City of South Miami desire to accept the recommendation ofthe Planning Board. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: City Commission June 13,2000 Section 1.The application submitted by Habitat for Humanity of Greater Miami,Inc.for a variance from Section 20- 3.5Eof the Land Development Code in order to allow a twenty- four feet three inches (24'-3")rear setback,where a twenty- five (25)rear foot setback is required on property located in the RS-4 Single-Family Residential zoning district,is hereby granted. Section 2.This approval is subject to and dependent upon construction of the proposed single-family residential house in conformity with the layout depicted in the submitted site plan. Section 3.The City Manager may revoke this approval upon a determination that the provisions of this resolution have been violated or any violation is occurring at the subject property or related property that is not in compliance with this resolution. Section 4.The City Manager shall have final approval and authority over all matters regarding the determination of the applicant's compliance with the intent of these sections.
