A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO OVERTIME
PAYMENT,AUTHORIZING THE CITY MANAGER TO PAY EXEMPT
EMPLOYEES OVERTIME FOR HOURS WORKED IN EXCESS OF FORTY
(40)HOURS A WEEK DURING A DECLARED DISASTER EMERGENCY
BY THE FEDERAL GOVERNMENT.
WHEREAS,theCity of SouthMiamicurrentlyhasapolicy of notpayingexempt
employees overtime forhoursworkedinexcess of fortyhoursaweek;and
WHEREAS,inthepast,duringdeclareddisaster emergencies therehavebeentimesthat
thisgroup of employeeshavegonebeyondthecall of dutyworkinglongerhourswithout
compensationtoensurethattheCityservicesareprovidedtoitscitizenswithoutinterruptions;
and
WHEREAS,bymeansofthisresolution,theCitywishesto create apolicythatwill
allowall exempt employees tobepaidovertimeforhoursworkedinexcess of forty(40)hoursa
week during declared disaster emergency.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI:
Section 1.That,atthediscretion of theCityManager,theCity exempt employees are
hereby authorized tobepaid overtime forhours worked in excess of forty(40)hours during
declared disaster emergency.
Section 2.That this resolution shalltake effect immediately upon approval.

REQUEST:

DURING A DECLARED DISASTER EMERGENCY BY THE FEDERAL
GOVERNMENT.
BACKGROUND &ANALYSIS
TheCitycurrentlyhasapolicy of notpayingovertimetoitsexemptemployeesforallhours
workedinexcess of fortyhoursaweek.Inthepast,duringdeclareddisasteremergencies,these
employeeshavehadtoworklonghourswithoutadditional compensation beyond theirregular
salariestoensurethatCityservicesareprovidedtoourcitizenswithoutinterruptions.For equity
reasons,thisresolutionisbeingproposedtoestablishapolicywherebyallexemptemployees
willbepaidovertimeforthehoursworkedinexcess of fortyhoursaweekduringdeclared
disasteremergency.Utilization of thispolicywillbeonacasebycasebasisatthediscretion of
theCity Manager.Thecostofthe overtime paidtothisgroup of employees issubjectto
reimbursementbytheFederalGovernment,if disasteremergencyisdeclared.
