No. 119-00-11012RESOLUTION NO.119-00-11012 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO MUNICIPALITIES;URGING THE MIAMI-DADE LEAGUE OF CITIES TO SUPPORT THE INCORPORATION AND/OR ANNEXATION OF PETITIONING COMMUNITIES WITHIN MIAMI-DADE COUNTY;PROVIDING AN EFFECTIVE DATE. WHEREAS,the Florida League of Cities'Intergovernmental Relations Committee,recently adopted a resolution that all unincorporated areas in Miami- Dade County ("county")should have the right to vote on incorporation "without needless delay and intrusion fromthe County";and WHEREAS,communities throughout the unincorporated areas of the County have expressed a strong desire to create their own municipalities orbe annexed to existing municipalities;and WHEREAS,communities within the County have been rejected in their efforts toform new municipalities since December,1996;and WHEREAS,the County had imposed a number of onerous impediments uponanyareas seeking incorporation and/orannexation;and WHEREAS,the County now wishes to move forward with the formation of new municipalities and/or annexations by existing municipalities. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA; Section 1.The County's requirements for incorporation,including the percentage of signatures required to petition for incorporation,fees,andother County requirements,shallbe returned tothose under which the Village of Pinecrest,Aventura,and Sunny Isles Beach were created. Section 2.Residents shallset municipal boundaries rather than government mandated.The boundaries shallbe contiguous and geographically logical,and include areas related asto history,geography and communities of interest. Section 3.All municipal services currently enjoyed by existing municipalities shall be granted tothenew incorporated municipalities. Additions shown by underlining and deletions shown by overstriking. Section 4.Anyandall communities seeking incorporation and/or annexation shallbe permitted to proceed without further delay. Section 5.The County shall eliminate the retention of revenues bythe Countyfor annexed areas.The withholding of allbutad valorem taxesplacesan undue burden on existing municipalities whichare required to provide afullrange of municipal services to annexed areasbutwouldnothavethefull complement of revenue to adequately service these areas. Section6.This resolution shalltake effect immediately uponapproval. PASSED AND ADOPTED this6thday of June,2000. BACKGROUND The attached resolution sponsored byMayor Robaina urges Miami-Dade League of Cities to support the incorporation and/or annexation of petitioning communities within Miami-Dade County. The Florida League of Cities'Intergovernmental Relations Committee,recently adopted a resolution that all unincorporated areas inMiami-Dade County shall have the right to vote on incorporation without needless delay and intrusion from the County.Furthermore,the communities within Miami-Dade County have been rejected in their efforts to form new municipalities since 1996. A RESOLUTION URGING THE MIAMI-DADE LEAGUE OF CITIES TO SUPPORT THE INCOJRPORAHON AND/OR ANNEXATION OF PETITIONING COMMUNITIES WITHIN MIAMI-DADE COUNTY.
