APPLICANT'S PROPOSAL The applicant isrequestingaSpecialUse Approval tooperateageneralrestaurant,apizzeria,at theabove referenced location.Theproposedarea of the restaurant istobelocatedwithinan existing onestorybuilding.Itwilloccupyatotalof1,530squarefeet,andwillhaveatraditional family oriented casual atmosphere serving salads,sandwiches,focaccia,pizzaandavarietyof breadsaccompaniedbysoda,wineandimportedbeers.Operatinghoursarefrom 11:00 a.m.to 10:30 p.m.Sunday through Thursday and 11:00 a.m.to 11:30 p.m.Fridayand Saturday. SPECIAL CONDITIONS APPLICABLE TheLDCprovidesthatspecialusesmustbe approved bytheCityCommissionafterapublic hearingandreceipt of arecommendationfromthePlanningBoard.Theoverallpurposeisto determinethe compatibility of theproposedusewiththe surrounding neighborhood.In addition, specialusesmayalsoberequiredtocomplywiththe additional requirements,whicharesetforth inSection20-3.4(B)(4)(b).Inthecase of ageneralrestaurantthefollowingsupplemental requirementsarelisted: (i)Allsuch establishments shallprovideonlyinsideorpatioserviceonprivate property. Public streets,rights-of-way,sidewalks and required setbacks may notbeusedfor patio or street-side services ofany kind, (ii)Noservices ofa drive-in or ofafastfood nature shallbepermitted. (Hi)The city commission shall review and recommend approval,disapproval or modification ofallsiteplansandprojectsspecificationsfor this special usepermit. ANALYSIS Theproposeduseislocatedinthe"SR"SpecialtyRetaildistrict.Ageneralrestaurantis permittedwithaSpecialUseApproval.Theproposedusemustmeettherequirementsforspecial uses contained under Section 20-3.4(B)(4)(b)General Restaurant and Section 20-5.8 Special Use Approval of theLDC.Ageneralrestaurantshallmeananestablishmentwheretheprincipal businessisthesale of foodand beverages tothe customer ina ready-to-consume stateandwhere thedesignshallprovideasit-downareaforthecustomers.Arestauranthaving1,530squarefeet requires onespaceforevery100squarefeetforatotal of 16parkingspaces.Thepreviousretail usewaslessintense,requiring onespaceforevery300squarefeet,resulting ina credit of only sixparking spaces.Asaresult of amoreintenseusetheapplicantneedsten additional parking spaces.Allowing forthethree existing parking spaces in front,seven additional parking spaces are required.Theapplicanthas complied by providing staffwithaletterstatingthatthe remaining seven parking spaceswillbeleased through theCity of SouthMiamiattheSouth MiamiMetroRail Station parkinggarage. The requested special use complies with the LDC requirements set forth for special uses in Section20-3.4andtheproposedusemeetsthe conditional requirements setforthinSection20- 5.8(B)(1)in that use: a)Will not adversely affect the health or safety ofpersons residing or working in the vicinity oftheproposed use, b)Will not be detrimental to the public welfare or property or improvements in the neighborhood;and, c)Complies with all other applicable Code provisions. The proposed use does not conflict with the Comprehensive Plan and meets the requirements set forth for special usesand general restaurant as stated above. PLANNING BOARD ACTION The subject application was presented to the Planning Board atits April 11,2000 meeting,At thattimethe Board adopted a motion (6-0)recommending approval of the application subject to the following conditions:1)that seven parking spaces are leased prior to issuance ofa certificate of occupancy and that this application should include a parking allocation letter provided by the City to the leasee before going to the City Commission;2)that the interior structure will be modified to allow for refuse removal and deliveries via the adjacent restaurant.
