WHEREAS,Myra&Company's Day Spa,propertylocatedat7313 SW 59 Court,submitted anapplicationforaspecialusetoallowageneralrestauranttobe locatedinaSR,Specialty Retailzoningdistrict specifically at 7313 SW 59 Court; and WHEREAS,ageneralrestaurantisallowedasaspecialuseina SR, SpecialtyRetailZoningDistrictsubjecttomeetingcertainconditionsspecifiedinthe Land Development Code Section 20-3.4(B)(4)(b);and WHEREAS.Theapproval of aspecialuserequiresa recommendation from thePlanningBoardandthe approval of theCity Commission afterapublic hearing; and WHEREAS,ThePlanningandZoningDepartment staff recommended approval of theproposedspecialusewithconditions;and WHEREAS,on April 11,2000,thePlanningBoard voted 5-1to recommend approval with conditions of thespecialuserequest;and, WHEREAS,theMayorandCity Commission of the City of South Miami desiretoacceptthe recommendation of thePlanningBoard. APPLICANT'S PROPOSAL The applicant is requesting a Special Use Approval to operate aCafe,atthe above referencedlocation.Theintent of thecafeistoserveonlythepatrons of thespaonthe existing outdoor patio area.Operating hours ofthecafeshallbethesameasthe existing beauty shop.The proposed Cafe consists ofa kitchen of approximately 125 square feet,to belocatedwithintheexistingMyra&Company'sDaySpafacilityandanoutdoorpatio connected bya walkway. SPECIAL CONDITIONS APPLICABLE TheLDC provides that special uses mustbe approved bytheCity Commission aftera public hearing and receipt ofa recommendation from the Planning Board.The overall purpose isto determine the compatibility ofthe proposed usewiththe surrounding neighborhood.In addition,special uses may also be required to comply withthe additional requirements,whichareset forth in Section 20-3.4(B)(4)(b).Inthecaseofa general restaurant thefollowing supplemental requirementsarelisted: (i)Allsuch establishments shall provide only inside orpatio service on private property.Public streets,rights-of-way,sidewalks and required setbacks may not be usedforpatioor street-side services ofany kind. (ii)No services ofa drive-in or ofafastfood nature shallbe permitted. (iii)The city commission shallreviewand recommend approval,disapproval or modification ofallsiteplansandproject specifications forthisspecialuse ANALYSIS Theproposeduseislocatedinthe"SR"SpecialtyRetaildistrict.Ageneralrestaurantis permitted withaSpecialUse Approval.A general restaurant mustmeetthe requirements forspecialuses contained under Section 20-3.4(B)(4)(b)General Restaurant andSection 20-5.8 Special Use Approval ofthe LDC.A general restaurant shallmeanan establishmentwheretheprincipalbusinessisthesale of foodandbeveragestothe customerinaready-to-consumestateandwherethedesignshallprovideasit-downarea forthecustomers.Althoughnotlistedasapermitteduseinthe "SR",SpecialtyRetail District,theproposed CafS isbestdescribedasanaccessoryrestaurant.Pursuantto Section 20-3.4(B)(16)anaccessoryrestaurantrequiresthefollowingsupplemental conditions: (a)Such usesarelocated entirely within the principal building forthe convenience oftheoccupants oforvisitorstotheprincipaluse; (b)Such usesdonotoccupy more than ten (10)percent of thegrossfloorarea of the principal buildinginwhichlocated;and (c)Such usesshallnothaveanysignsor advertising visiblefromoutsidethe principal building. The proposed Caf<§meetsthe requirements ofan accessory restaurant.Itisthe staffs observationthatnoadditionalparkingisrequiredduetothefactthatalltheusers of the Caf&willbethepatrons of thebeautyshop.The cafe*willnotbeopentothepublicand willnotgenerateadditional traffic. TherequestedspecialusecomplieswiththeLDC requirements setforthforspecialusesin Section20-3.4andtheproposedusemeetstheconditionalrequirementssetforthin Section 20-5.8 (B)(1)in that theuse: a)Willnotadverselyaffectthe health orsafety ofpersonsresidingorworkingin the vicinity ofthe proposed use, b)Willnotbe detrimental tothepublic welfare orpropertyor improvements inthe neighborhood;and, c)Complieswith all otherapplicableCodeprovisions. The proposed usedoesnot conflict withthe Comprehensive Planandmeetsthe requirements setforthfor special usesandfor general restaurants asstated above. PLANNING BOARD ACTION The subject application was presented tothe Planning Board atits April 11,2000 meeting. AtthattimetheBoardadoptedamotion(5-1)recommending approvalofthe application subject to following conditions (including those set forth by staff):(1)theuseis located entirly within the principal building;(2)the cafe is not open to the public and is for the convenience ofthe patrons andthe employees only;(3)thecafeisnotto occupy more than 10%ofthe gross floor area;(4)no additional signage or advertising is visible from outside the principal building;(5)that air-conditioned space be utilized for refuse/waste;6)that ventilation be adequate;(7)thatthe restaurant use apply onlytosaid applicant. RECOMMENDATION APPROVAL withthefollowingconditions: Basedon information received subsequent tothe Planning BoardmeetingheldonApril 11, 2000,thestaffis recommending an additional condition withrespectto catering.
