BACKGROUND: The applicant, Christi Elias, has requested approval for a variance of Section 20-3.5(E) of the City's Land Development Code to allow a building coverage of 30.7% where a maximum of 30% is required, in order to construct a 124 square feet bathroom addition to an existing one-story residence located at 7830 SW 57 Court. The existing structure was built in 2014 on a 13,500 square-foot lot zoned RS-3 within the Victoria Place subdivision (Figure 2). STAFF OBSERVATIONS The applicant is proposing to build a bathroom addition consisting of 124 square feet that will be located on the northwest side of the referenced site. Please refer to the survey and Figure 2 for the existing building orientation, which illustrates the existing conditions of the property. (1) The subject site is surrounded on the north, south and west by single family homes zoned RS-3 and to the east by RO-Residential Office uses. (2) The proposed building coverage of 4,148 square feet or 30.7% of the existing site is only exceeding the 30% maximum building coverage by 98 square feet; however, it is not exceeding the maximum allowed impervious coverage of 40%. (3) The applicant's Statement of Hardship states the handicapped-accessible bathroom is a necessity for her mother's care in order to mobilize her by using a 45" x 29" medical lift device. In June 2008 the City Commission amended the Land Development Code to add specific criteria for judging variance requests. LOC Section 20·5.9 (HI now requires that all variance decisions shall be based on an affirmative finding as to each of the following criterion: VP 1. The variance is necessary to relieve particular extraordinary conditions relating to a specific property; The requested handicapped-accessible bathraom additian will allow the applicant to accommodate her disabled mother in her home. 2. Denial of the variance would result in hardship to the owner. Hardship results if the restriction of the zoning ordinance, when applied to a particular property, becomes arbitrary, confiscatory or unduly oppressive because of conditions of the property that distinguish it from other properties under similar zoning restrictions; . A denial of the variance would be a hardship on the owner by preventing the property from being habitable by the applicant's disabled mother. 3. The extraordinary conditions and circumstances do not result from the actions of the applicant; The property had been built priar to the need of accommodation of the property owner's disabled mother. 4. The requested variance is the minimum variance necessary to make possible the reasonable use of the land, building or structure; The granting of the requested variance is the smallest possible and the only one necessary to allow for the reasonable use of the structure. 5. That the approval of the variance will be consistent with the general intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. The approval of the variance is consistent with the City's objective to preserve the character of the deSignated structure and neighboring structures and will have no impact to surrounding properties. RECOMMENDATION The Planning Board recommends approval of the request as presented. The City Commission can approve the application as submitted, approve with conditions/modifications or deny the application. Should the Commission recommend approval of the requested variance, the development will comply with the RS-3 Low Density Single-Family Residential District, Section 20-3.5(E), Dimensional Requirements, including maximum building height of 25 feet, maximum impervious coverage of 40% and all other City Code requirements. That the approval of the variance will be consistent with the general intent and 40 purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise 41 detrimental to the public welfare; and 42 43 WHEREAS, even if the circumstances do not strictly fall within the requirements for a 44 variance, the federal Fair Housing Act ("FHA"), 42 U.S.C. 3601 et seg.,applies to municipalities 45 and prohibits them from implementing land use policies that exclude or otherwise discriminate 46 against protected persons, including individuals with disabilities. As an example, it is the Justice Department's position that a reasonable accommodation includes a waiver of a setback requirement so that a paved path of travel can be provided to residents who have mobility impairments. It is also the Justice Department's opinion that a request would only be unreasonable if (I), the request imposes an undue burden or expense on the local govemment or (2) the request would create a fundamental alteration in the zoning scheme. If neither of these conditions exist, the refusal to grant a reasonable accommodation may be unreasonable and a violation of the federal FHA. WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the recommendation of the Planning Board. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The recitals set forth in this resolution are true, and they are supported by competent substantial evidence and they are incorporated into this resolution by reference. Section 2. That the subject application No. PB-15-006 that was submitted to the Planning Board by the applicant Christi Elias; said application requesting approval of a variance from Section 20-3.5(E) to allow a building coverage of 30.7% where a maximum of30% is required, in order to construct a 124 square feet bathroom addition to an existing one-story residence located at 7830 SW 57 Court, South Miami, Florida, within the RS-3 zoning district; and is hereby approved. Section 3. I reside at this address. I am requesting a variance to the South Miami code allowing me to add 98 square feet to my home. I need this variance so that I can add a handicap bathroom to the rear of my home. My mother, who is a paraplegic with several medical complications, has recently moved into my home. The handicapped bathroom is a necessity for her care. Statement of Hardship I am the homeowner of 7830 SW 57 Court, South Miami. I reside at this address. I am requesting a variance to the South Miami code allowing me to add 98 square feet to my home. I need this variance so that I can add a handicap bathroom to the rear of my home. My mother, who is a paraplegic with several medical complications, has recently moved into my home. The handicapped bathroom is a necessity for her care. We must use a medical lift to move my mother. This lift is 45 inches long and 29 inches wide and will not fit into our standard sized bathrooms. A photograph of the lift is attached. When I constructed my home my mother was living in a very fine assisted living facility where we hoped she would receive the care required. Unfortunately, since entering the living facility my mother has been hospitalized several time with infections due to inadequate care. I have determined that the best care will be the care I provide in my home. I have nursing aid daily but need to add the handicapped bath to provide the full proper care. I'm talking about how some drivers as- sume that once you make it driving through Pinecrest (south of the border) the en- forcement of traffic laws is nonexistent Calming adjustments were discussed for our inte- rior and major roads in Pal- metto Bay to help combat speeding drivers. I've been trying to get something done in my neighborhood for decades. When my com- plaints were finally ad- dressed, radar speed signs were temporally placed and an occasional speed trap is set up. So after all this, after a couple of weeks the speed- ing and reckless driving on my street continues. If I might make a suggestion to help solve this issue con- cerning traffic calming, complain to Miami-Dade Public Works if our local government seems reluc- tant to aggressively follow through (as in the past) with this. Most importantly, it all comes down to the enforce- ment of our driving laws.
