A Resolution authorizing the City Manager to execute the First
Amendment to fiscal year 2015 Florida Recreation Development
Assistance Program (FRDAP) grant agreement with Florida Department
of Environmental Protection for the Fuch's Park grant.
The City of South Miami was awarded funding for the Fuchs Park Project
in the amount of $50,000 through the Florida Department of
Environmental Protection. The original grant agreement stated funding
would be provided for the I) demolition and installation of a new
playground, 2) pavilion renovation, 3) restroom renovations and 4)
benches, picnic tables and grills. However, due to an unexpected fire, the
bathrooms were already renovated using City funds and therefore this
Amendment revises the Work Plan in Attachment I to delete the
restroom renovations from the project elements, as grant funds are no
longer needed. The Florida Department of Environmental Protection has
agreed to these revisions.

WHEREAS, the City desires to amend the agreement to revise the Work Plan III
Attachment I so as to delete the restroom renovations from the Project Elements; and
WHEREAS, Paragraph 3 of the Agreement requires that revisions to Attachment 1 be
reduced to writing in an amendment to the Agreement; and
WHEREAS, the Florida Department of Environmental Protection has agreed to these
revisions to Attachment 1 to the Agreement
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1: The City Manager is hereby authorized to execute the First Amendment to the
grant agreement with the Florida Department of Environmental Protection so as to delete the
restroom renovations from the Project Elements for the Fuchs Park project and to provide for a
grant amount of $50,000. The grant agreement and amendment is attached to this resolution.
Section 2: This resolution shall be effective immediately after the adoption hereof.

THIS FIRST AMENDMENT TO DEP AGREEMENT NO. A5162 ("First
Amendment") affects Fuchs Park and is made and entered into between the STATE OF FLORIDA
DEPARTMENT OF ENVIRONMENTAL PROTECTION (the "DEPARTMENT") and the CITY
OF SOUTH MIAMI (the "GRANTEE").
RECIT ALS:
WHEREAS, on or about September 8, 2014, the Department and Grantee entered into a
Florida Recreation Development Assistance Program DEP Agreement No. A5162 (FRDAP
Project No. A15162) (the "Agreement") for the development project known as Fuchs Park
("Project").
WHEREAS, the Agreement collectively includes Attachments I and 2, and the same are
incorporated herein by reference. Attachment I contains the Project Work Plan and lists each
required Project Element and allocates the total Project budget among the Project Elements.
WHEREAS, the Grantee has requested, and the Department has agreed, to modify
Attachment I of the Agreement, to delete the restroom renovation from the Project Elements.
WHEREAS, Paragraph 3 of the Agreement requires that revisions to Attachment I be
reduced to writing in an amendment to the Agreement.
WHEREAS, the Department and the Grantee confirmed that such revisions are within the
parameters of the Agreement and wish to revise the Agreement, as more particularly set forth in
this First Amendment.
NOW THEREFORE, in consideration of the foregoing Recitals, the Agreement, and
other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the parties mutually agree as follows:
I. Recitals. The Recitals set forth hereinabove are true and correct and are
incorporated herein by reference.

2. Amendments to the Agreement. Attachment I to the Agreement is hereby deleted
and the Attachment I to this First Amendment is hereby substituted in lieu thereof. From and after
the date of this First Amendment, the term "Attachment I" shall mean the Attachment I attached
to this First Amendment.
3. Ratification. Except as modified by this First Amendment and its Attachment I, the
Agreement is hereby ratified and confirmed and remains in full force and effect. In the event of a
conflict between the Agreement and this First Amendment, this First Amendment shall control.
Hereinafter, the term "Agreement," shall collectively mean the Agreement, as modified by this
First Amendment.
IN WITNESS WHEREOF, the parties have caused this First Amendment to be duly
