_Add-on item e)Add-on Item e) Sponsored by Mayor Stoddard City Commission Meeting 3/17/15 RESOLUTION NO.____________________ 1 2 A Resolution amending the City Manager’s authority to institute a policy for the waiver 3 of the standard fees for the use of City parks and facilities by local schools under certain 4 conditions. 5 6 WHEREAS, South Miami Middle School (“SMMS”) does not have adequate space to operate its 7 athletic programs at South Miami Middle School; and 8 9 WHEREAS, SMMS is interested in holding its basketball home games in the gymnasium at the 10 Gibson-Bethel Community Center from March through May 2015; and 11 12 WHEREAS, a majority of the students who attend SMMS reside in the City of South Miami; and 13 14 WHEREAS, the School Board has exclusive use and control of Palmer Park for recreation purposes 15 between the hours of 8:00 A.M. and 3:30 P.M. during the school year (except Saturday, Sundays, and school 16 holidays) and pays a base rental payment, adjusted by the percentage differential between the Consumer Price 17 Index for the month of September and every year thereafter since 1978; and 18 19 WHEREAS, the City has worked, and continues to work, cooperatively with all local schools in the 20 City of South Miami. 21 22 NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF 23 THE CITY OF SOUTH MIAMI, FLORIDA THAT: 24 Section 1. The City Manager is authorized to institute a policy of waiving the standard fees for 25 the use of City parks and facilities by local schools, such as South Miami Middle School, provided the 26 City Manager is able to demonstrate extraordinary circumstances and, if he is to waive all fees, he 27 must determine, in his estimation, that there is sufficient collaboration between the school and the City. 28 Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason 29 held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of 30 the remaining portions of this resolution. 31 Section 3. PASSED AND ENACTED this ____ day of _____________, 2015. 34 Effective Date.
