9q 1 ORDINANCE NO. _____ _ 2 3 An Ordinance amending Section 20-4.4!1:D Section , 4 . . . of the City of South Miami's Code 5 of ..... modify 6 requirements in multi-family residential rental properties. 7 8 WHEREAS, excessive parking requirements waste land, waste buildable space, 9 eliminate potential green space, reduce the earth's ability to recharge the aquifer when 10 built with impervious materials, are typically constructed with non-biodegradable 11 products, and drive up the cost of rental housing for those who can least afford it; and 12 13 WHEREAS, the 2010 US Census found that occupants of rental properties in the 14 City of South Miami owned 0.66 vehicles on average; and 15 16 WHEREAS, the 2010 US Census found that occupants of rental properties in the 17 census block bounded by Sunset Drive, SW 62 nd Ave, SW 64th St, and Red Road owned 18 0.44 vehicles on average; and 19 20 WHEREAS, the 2010 US Census found that occupants of rental properties in the 21 census block bounded by Sunset Drive, SW 62 nd Ave, SW 80 th St, and Red Road owned 22 0.79 vehicles on average; and 23 24 WHEREAS, most rental uuits in these two census blocks are in multi-family 25 apartments; and 26 27 WHEREAS, the South Miami Land Development Code requires residential 28 properties to have 2 parking spaces per uuit irrespective of demonstrated need; and 29 30 WHEREAS, the City's existing parking regulations require 2JQ.. 4 parking spaces 31 per car owned by rental apartment dwellers in South Miami, a significant waste of 32 resources; and 33 WHEREAS, Metrorail was recently extended to Miami International Airport, 34 which now allows visitors to reach the City quickly and easily using public transit instead 35 of a rental car~ 36 37 38 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 39 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORlDA: 40 41 Section 20-4.4(B)!m of the City of South Miami's l:tfa 42 .. ; Code shall be amended to read as follows: 43 44 (B) Space Requirements._ The minimum number of off-street parking spaces 45 required for each permitted or special use shall be as set forth below and 46 referenced in Section 20-3.3D. _Where fractional spaces result for a property, the 47 number of spaces required shall be the next highest whole number. 1 ill Two (2) spaces per dwelling unit, or one (1) space per dwelling unit for multi- 2 family rental properties. 3 -(2) Two (2) spaces per dwelling unit, provided that at least one (1) space per unit 4 shall be enclosed, or one (1) space per dwelling unit in multi-family rental 5 properties enclosed or not. 6 (3) One and one-half (1.5) spaces per efficiency or studio unit and two (2) spaces 7 per unit with one (1) or more bedrooms, plus an additional visitor space for every 8 ten (1 0) units~, except that no more than one (1) space per dwelling unit is required 9 for multi-family rental properties. 10 ill One (1) space per guest room or three-quarters (0.75) spaces per guest room 11 within a third (0.33) mile of the South Miami Metrorail Station, plus two (2) 12 spaces for the reception office. 13 (5)-One and three-quarters (1.75) spaces per bed. 14 ® One (1) space per three (3) seating spaces in the main assembly room. 15 (7) One (1) space per one hundred (100) square feet of gross floor area. 16 (S) One (1) space per one hundred fifty (150) square feet of gross floor area. 17 (9) One (1) space per two hundred (200) square feet of gross floor area. 18 (10) One (1) space per two hundred fifty (250) square feet of gross floor area. 19 (11) One (1) space per three hundred (300) square feet of gross floor area. 20 (12) One (1) space per four hundred (400) square feet of gross floor area. 21 (13) One (1) space per five hundred (500) square feet of gross floor area. 22 (14) One (1) space per one thousand (1,000) square feet of gross floor area. 23 (15) One (1) space per four (4) seats or seating places. 24 (16) Five (5) spaces per alley or five hundred (500) square feet of rink area. 25 26 Section 2. Section 20-S.S(C) of the City of South Miami's j;[illi~Jj)~Y~l[~tJ,t 27 Code shall be amended to read as follows: 28 29 (C) Required Parking Uses. 30 1. Residential: A minimum of two (2) cars per unit is required for 31 residential uses, or one (1) car per dwelling unit for multi-family rental 32 properties. Conversion from rental to condominium requires compliance 33 with parking codes for non-rented uses. 34 2. CommerciallRetail: One (1) space per 150 sq. ft. to 400 sq. ft. of gross 35 floor area (see schedule section 20-7. 12A). 36 3. Office: One (1) space per 200 sq. ft. to 400 sq. ft. of gross floor area (see 37 schedule section 20-7.12B). 38 4. Light Industrial: 39 (a) One space per 100 sq. ft. to 1,000 sq. ft. (See schedule section 20-3.3 40 and 20-4.4). 41 (b) No parking of vehicles in driveway at anytime. 42 (c) In any area with light industrial uses, any vehicle under repair must be 43 stored inside buildings at all times. 44 (d) For light industrial uses, any garage areas must be totally enclosed and 45 have garage doors closed when not in use. 46 47 Page 2 of4 1 Section 20-7.12(C) of the City of South Miami's 1l~~ 2 : Code, relating specifically to the Hometown District Overlay, shall be 3 amended to read as follows: 4 5 C. Residential & Lodging Uses Dwelling, Dwelling, Multi-Family 2 sj3aees 1 space per dwelling unit 2 sj3aees I space per 6 ** plus 1 additional parking space required for every 10 units, except if the entire 7 building is a multi -family rental property. 8 * Uses marked with an asterisk require a special use pemnt with city commission 9 approval. All other uses are permitted of right. Outdoor dining is permitted of right 10 in special pre-approved areas (see Regulating Plan). 11 12 Section 4: Codification. The provisions of this ordinance shall become and be 13 made part of the Code of Ordinances of the City of South Miami as amended; that the 14 sections of this ordinance may be renumbered or re-lettered to accomplish such intention; 15 and that the word "ordinance" may be changed to "section" or other appropriate word. 16 17 Section 5. Severability. If any section, clause, sentence, or phrase of this 18 ordinance is for any reason held invalid or unconstitutional by a court of competent 19 jurisdiction, this holding shall not affect the validity of the remaining portions of this 20 ordinance. 21 22 Section 6. Ordinances in Conflict. All ordinances or parts of ordinances and all 23 sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. 24 However, it is not the intent of this section to repeal entire ordinances, or parts of 25 ordinances, that give the appearance of being in conflict when the two ordinances can be 26 harmonized or when only a portion of the ordinance in conflict needs to be repealed to 27 harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its 28 terms, it is hereby amended to harmonize the two ordinances.
