A Resolution approving an application for variances for a new two-unit residential

BACKGROUND:
The applicant, Censig Holdings, LLC, has requested approval for four variances of Section 20-
3.S(F) to permit a minimum lot size of 7,358 square feet where 10,000 square feet are required,
to permit a frontage of 52.03 feet where 75 feet is required, and to permit side (interior)
setbacks of 5 feet on either side of the property where 12.5 feet are required, in order to
construct a two-unit residential structure located at 6031 SW 76 Street (Figure I).

The property is located in the mid-block of SW 76th Street in between SW 61 st Avenue and
SW 59th Place, just south of US-I/South Dixie Highway. The existing structure was built in
1951 prior to the establishment of the current dimensional requirements, on an irregular shape
lot zoned RM-18 within the Larkin Pines neighborhood (Figure 2).

The City's Land Development Code requires any new construction to meet the current zoning
standards for the particular district where it is located; in this instance, within the RM-18, Low
Density Multi-Family Residential District. The applicant's hardship letter claims the property is
unusually narrow and has an irregular shape. This parcel configuration is due to the rear
portion of the lot being narrower than the front portion of the lot. Also, the lot size is merely
7,358 square feet and the frontage is 52.0 I feet.

ANALYSIS
The applicant is proposing a two-unit structure (duplex) on the property. It is important to
note that up to three units are permitted pursuant to the land Development Code. However,
only two units will be built fronting SW 76th Street. Please refer to the property survey and
Figure 2 that illustrates the irregular shape lot; consisting of 7,358 square feet and a frontage of
52.03 feet.
(I) The subject site is surrounded on the north by RM-24, Medium Density Multi-Family, on the
east and west by RM-18, Low Density Multi-Family, and on the south by RS-3, Residential
single family homes.
(2) The property is not vacant. Currently, there is a one-story residence built in 1951 prior to
the establishment of the current dimensional requirements and an accessory structure on a
legal nonconforming lot of record.

(3) This is an irregular shape lot. The rear portion of the lot is narrower than the front of the
lot. Also. the lot size is merely 7.358 square feet and the frontage is 52.0 I feet.
(4) The variance requested to allow for a lot size of 7.358 square feet. lot frontage of 52.03
feet. and for five feet side (interior) setbacks on the proposed two-unit residential is a
unique situation due to the peculiarly narrow shape and size of the lot which justifies the
granting of the variance.
(5) The applicant's Statement of Hardship states that all variances decisions shall be based upon
an affirmative finding that the denial of the variance would result in a hardship to the
landowner. Further. the hardship must be inherent in the land.
(6) The four variances requested will have minimal impact on surrounding properties. Hence.
the variances are also necessary to use the property and create a two-unit structure within
the permitted density allowed under the low density multi-family zoning district.
The applicant needs approval of four variances in order to construct a duplex within the
permitted density. located at 6031 SW 76 Street (Lot II. Block 2. Larkin Pines) within the RM-
18. Low Density Multi-Family zoning district. The applicant is requesting approval for lot size.
lot frontage. and side (interior) setbacks for the development of low density multi-family
residential use.
The subject parcel at 6031 SW 76 Street is considered a legal non-conforming lot of record and
any new construction must meet the zoning standards for the RM-18. Low Density Multi-Family
zoning district. Development of the property is prohibited because the lot area of the parcel is
7.358 sq. ft. which is below the minimum required lot size of 10.000 sq. ft. The property will
face SW 76 Street which has only 52.03 feet of frontage. This frontage is below the minimum
required frontage of 75 feet for the zoning district (LDC Section 20-3.5(F). The third and forth
variance requested are side (interior) setback variance. Please refer to the proposed Site Plan.
Sheet A I. that illustrates the overall intent. Further. the development will comply with all other
City Code requirements.
In June 2008 the City Commission amended the Land Development Code to add
specific criteria for judging variance requests. LDC Section 20-5.9 (H) now requires
that all variance decisions shall be based on an affirmative finding as to each of the
following criterion:

relating to a specific property;

2. Denial of the variance would result in hardship to the owner. Hardship
results if the restriction of the zoning ordinance, when applied to a particular
property, becomes arbitrary, confiscatory or unduly oppressive· because of
conditions of the property that distinguish it from other properties under
similar zoning restrictions;
A denial of the variances would be a hardship on the owner; the struaure was built in
1951 prior to the establishment of the current dimensional requirements.
3. The extraordinary conditions and circumstances do not result from the
actions of the applicant;
This is an irregular shaped lot and the struaure predates the current code
requirements.
4. The requested variance is the minimum variance necessary to make possible
the reasonable use of the land, building or structure;
The granting of the requested variance is the smallest possible and the only ones
necessary to allow for the reasonable use of the property.
5. That the approval of the variance will be consistent with the general intent
and purpose of the Land Development Code, and will not be injurious to the
neighborhood or otherwise detrimental to the public welfare.
The approval of the variance is consistent with the City's objective to preserve the
charaaer of the designated struaure and neighboring struaures.
At the February 10, 2015 Planning Board meeting, the board reviewed Application PB-IS-002
for the requested variances, and following a public hearing on the application, voted 4 ayes and
I nays to recommend approval of the variance as requested.
RECOMMENDATION
The Planning Board recommends approval of the request as presented. The City Commission
can approve the application as submitted, approve with conditions/modifications or deny the
application. Should the Commission recommend approval of the requested variances, the
development will comply with RM-18 zoning district, Section 20-3.5(F), Dimensional
Requirements; including maximum building height of 2 stories (30 feet), maximum impervious
coverage of 60%, and all other City Code requirements.

WHEREAS, on February 2, 2015 Censig Holdings, LLC, submitted an application for
four variances to construct a new two-unit residential structure within the RM-18 zoning district;
and
WHEREAS, application No. PB-15-002 was submitted to the Planning Board by the
applicant Censig Holdings, LLC; said application requesting approval of a variance from Section
20-3.5(F) to permit the construction of a new two-unit structure, to allow for lot size 7,358
square feet where a minimum of 10,000 square feet is required, to permit a frontage of 52.03
where 75 feet is required, and to permit side setbacks of 5 feet where a minimum of 12.5 feet is
required, for a new two-unit residential structure located at 6031 SW 76 Street, South Miami,
Florida, within the RM -18 zoning district; and
WHEREAS, the approval of a variance requires a recommendation from the, Planning
Board and the approval of the City Commission after a public hearing; and
WHEREAS, at its February 10, 2015 meeting, the Planning Board after a public hearing
voted 4 ayes 1 nays to recommend approval of the variances requested; and ..
WHEREAS, the Mayor and City Commission of the City of South Miami desire to
accept the recommendation of the Planning Board. '
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. The recitals set forth in this resolution are true, that they are supported by
competent substantial evidence and that they are incorporated into this resolution by reference.
Section 2. That the subject application No. PB-15-002 that was submitted to the Planning
Board by the applicant Censig Holdings, LLC; said application requesting approval of a variance
from Section 20-3.5(F) to permit the construction of a new two-unit structure, to allow for lot
size 7,358 square feet where a minimum of 10,000 square feet is required, to permit a frontage of
52.03 where 75 feet is required, and to permit side setbacks of 5 feet where a minimum of 12.5
feet is required, for a new two-unit residential structure located at 6031 SW 76 Street, South
Miami Florida, within the RM -18 zoning district; and is hereby __________ _

20-5.9 -Variance approvals.
(A) Expiration of Variance Approvals. A variance approved pursuant to Section 20-5.5 shall lapse after
one (1) year if no building permit has been applied for in accordance with the request for such
variance and if the city commission has not specifi.ed a longer approval period for good cause
shown.
(8) Extension of Variance Approvals. Four (4) affirmative votes fo the city commission may grant an
extension to a previously approved variance if a proper and timely'request is made by the
applicant prior to the expiration of the one'y.ear period.
(C) Hardship Statement. All applications for a variance shall include a letter of intent indicating the
specific nature of the hardship upon which the request is based.
(D) Property Survey Required. All applications for a variance shal.1 include a current property survey
prepared bya registered surveyor.
(E) Neighborhood Awareness. All applications for a variance shall be accompanied by a map which
reflects all properties and the names bf all property owners within a five hundred (500) foot radius
of the subject property. A notarized affidavit shall be presented to the Planning and Zoning
Department within five (5) business clays of submittal of an acceptedappJication, attesting that the
applicant gave notice of the proposed application t.e all the property owners within the noted five
hundred (SOD) foot radius by regular u.s. mall with the exception of the abutting, or contiguous,
property owners, who shall be made aware via Certified Mail. The affidavit shall be accompanied
by a copy of the notification letter together with copies of the Certified Mail receipts.
(F) Proposed Site Plan Required. A site plan shall be required showing all proposed buildings and
setbacks and any other features relatinp to the variance request.
(G) Permitted Variance Requests. Applications for variances shall be restricted to only the following:
(1) Yard setbacks
(2) Lot size
(3) Lot coverage
(4) Building height
(5) Fences and walls
(6) Impervious coverage
(7) Off-street parking
(8) Open space
(9) Signs
(10) Landscaping

peculiar size, the Property is undevelopable under .the minimum lot size regulations of the
aforementioned provision. This amounts to a defect in the land which deprives the
Applicant of a right enjoyed by all other owners of adjoining lots. A hardship would result
if the minimum lot size requirement of Section 20-3.5(F) where applied to the Applicant's
Property, becoming arbitrary, confiscatory, andlor unduly oppressive due to the Property's
peculiar size. If the minimum lot size variance is not granted, the Property will be in
violation of the Code because the lot size has historically and is presently only 7,358 square
feet. The existing residence on the lot would also require a minimum lot size variance if it
were currently approved.
Similarly to the request regarding lot size, the Applicant requests a variance to
permit a minimum lot frontage of 52.03 feet where 75 feet is required pursuant to the Code.
The hardship is inherent in the land as the lot frontage exists today at only 52.03 feet. Due
to the lot's nonconforming width, tlle Property is undevelopable under the minimum lot
frontage regulations. This amounts to a defect in the land which deprives the Applicant of
a right enjoyed by all other owners of adjoining lots. A hardship would result if the
