RESOLUTION NO. 3
A Resolution acknowledging Vice Mayor Harris' (Group Seat IV)
appointment of Sally Philips, as the representative of Group Seat IV, to
serve on the Board of TrusteeslPolice Officers Retirement Trust Fuud, for a two-
year term ending March 2, 2017.
WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that:
* * * When a Board or Committee is comprised of five members, each City
Commissioner shall appoint one person to serve as a representative on the
Board or Committee. When there are more than five (5) members on a
Board or Committee, each City Commissioner shall appoint one person to
serve as a representative on the Board or Committee, and all members of
such Board or Committee in excess of five (5) shall be appointed by three
(3) affirmative votes of the City Commission based on recommendations
submitted by any City Commissioner. When a Board or Committee has less
than five (5) members, then the selection of all members shall be by three (3)
affirmative votes of the City Commission from recommendations submitted
by any City Commissioner. (Amended 2-09-10)
22 WHEREAS, the City Commission desires to acknowledge the appointment of Sally Philips, a
23 resident of the City of South Miami, to serve for a two-year term on the Board of Trustees/Police Officers
24 Retirement Fund Board. Appointment shall expire March 2, 2017 or until removed or unless a successor is
25 duly appointed and qualified; and

27 WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22
28 "Term Limits" of the Code of Ordinances provides that, appointees are limited" to two (2)
29 consecutive two-year terms of membership on a specific commission, board, or committee.
30 After serving a maximum of two (2) consecutive year terms, an appointee shall not be
31 reappointed to the same commission, board or committee unless at least one year has elapsed
32 between the term limited position and the effective date of commencement of the proposed
33 appointment for a new term; and

35 WHEREAS, Sec. 2-22 "Term Limits" of the Code of Ordinances, as amended by Ordinance No.
36 06-14-2184, dated April 15, 2014, provides that the appointer, or his or her successor in office, may extend
37 the term limits of his or her appointment with the advice and consent of a majority of the City Commission;

WHEREAS, this will Ms. Philips' first, two-year term serving on this Board.
42 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
43 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:

45 Section 1. The City Commission hereby acknowledges Vice Mayor Harris' right to
46 appoint Sally Philips to the Board of TrusteeslPolice Officers Retirement Fund Board as the
47 representative of Group Seat IV pursuant to the terms of the City Charter.

49 Section 2. The expiration date of this appointment shall be March 2, 2017, or
