3 A Resolution of the City of South Miami, Florida amending its approval of the plat
4 of Davis Oaks, being a re-plat of a portion of tract 8 of "revised plat of a portion of
5 the amended plat of Palm Miami Heights" recorded in Plat Book 43, Page 37,
6 Miami-Dade County, Florida.

8 WHEREAS, on December 2, 2014, the Mayor and the City Commission of the City of South
9 Miami received, reviewed and approved an application filed by RP I-SM, LLC, a Florida limited liability
10 company, seeking to re-plat property legally described as Tract 8, less the West 100 feet thereof, and the
11 west 25 feet of SW 60 Avenue adjoining Tract 8 which was vacated by City Resolution 81-05-12060,
12 REVISED PLAT OF A PORTION OF THE AMENDED PLAT OF PALM MIAMI HEIGHTS,
13 according to the Plat thereof, as recorded in Plat Book 43, Page 37 of the Public Records of Miami-Dade
14 County, Florida; and

16 WHEREAS, after further review and discussion with the property owners, neighbors and other
17 interested persons, and upon the recommendation of City staff and in accordance with the land
18 development regulations of the City of South Miami, the Mayor and the City Commission have
19 determined that the approval of the plat should be amended to eliminate the flagpole lot provided therein;
20 and
21
22 WHEREAS, pursuant to other anticipated action by the City Commission to approve an
23 ordinance ratifying and amending its vacation of the right of way of SW 60 Avenue, located between SW
24 79 Street and SW 80 Street, and amending the conditions of approval thereof, the applicant has agreed to
25 amend its plat to reconfigure the lots therein and remove the flagpole lot, consistent with the conditions of
26 approval of the amended vacation and abandonment ofSW 60 Avenue.
27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
28 OF THE CITY OF SOUTH MIAMI, FLORIDA:

30 Section 1. The PLAT OF DAVIS OAKS, as amended to reconfigure the subdivision to eliminate
31 a lot having a flagpole configuration, as provided for by the ordinance ratifying and amending Resolution
32 81-05-12060 (a copy of the proposed amended plat is attached to this resolution and made a part hereof
33 by reference and will be recorded by or on behalf ofRP1-SM, LLC), is hereby approved and subject to
34 the following conditions, and/or other conditions deemed appropriate by the City Commission:
35 1. Compliance with the conditions ofthe Miami-Dade County approval of application No.
36 T-23506-4-REV;
37 2. Compliance with current City Land Development Code requirements.
38 3. Compliance with the City'S tree removal and canopy mitigation requirements.
39 4. Compliance with the City's Public Works requirements for any driveways, sidewalks or
40 other improvements.
41 5. Compliance with the provisions of ordinance ratifying and amending Resolution 81-05-
42 12060.
43 6. Demolition of the existing one-story structure prior to issuance of a development permit.
44 7. Compliance with any Miami-Dade County Environmental Resource Management
45 requirements prior to final recording of this plat. '

A Resolution approving the Final Plat of Davis Oaks, being a replat of
a portion of tract 8 of revised plat of a portion of the amended plat of
Palm Miami Heights, recorded in plat book 43, page 37, Miami-Dade
County, Florida.
WHEREAS, the Mayor and the City Commission of the City of South Miami have received and
reviewed an application filed by RPI-SM, LLC, a Florida limited liability company, seeking to re-plat
property legally described as Tract 8, less the West 100 feet thereof, and the west 25 feet of SW 60
Avenue adjoining Tract 8 which was vacated by City Resolution 81-05-12060, REVISED PLAT OF A
PORTION OF THE AMENDED PLAT OF PALM MIAMI HEIGHTS, according to the Plat thereof, as
recorded in Plat Book 43, Page 37 of the Public Records of Miami-Dade County, Florida; and
WHRERAS, the Miami Dade County plat committee met on November 21, 2014 and
recommended approval of the tentative plat subject to any provisions enumerated in their approval letter,
and subject to final plat approval by the City and County; and
WHEREAS, the replat application requests a subdivision of said parcel into five buildable
single-family lots; and
WHEREAS, the Planning Department reviewed the application in accordance with the land
development regulations of the City of South Miami and with Resolution 81-05-12060, and finds the
application in compliance.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH lVIIAMI, FLORIDA:
Section 1. That the Final PLAT OF DA VIS OAKS, as filed by and on behalf of RP I -SM, LLC
and legally described in Section 2, pursuant to section 20-4.2(b) of the Land Subdivision Regulations, and
labeled as "Exhibit A", is hereby approved , and subject
to the following conditions, and/or other conditions deemed appropriate by the City Commission:
1. Compliance with the conditions of the Miami-Dade County approval of application No.
T-23506-4-REV;
2. Compliance with current City Land Development Code requirements.
3. Compliance with the City's tree removal and canopy mitigation requirements.
4. Compliance with the City'S Public Works requirements for any driveways, sidewalks or other

reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this resolution.
Section 4. Effective Date. This resolution shall become effective immediately upon adoption by
vote of the City Commission.

A Resolution approving the Final Plat of Davis Oaks, being a replat of a portion of tract 8
revised plat of a portion of the amended plat of Palm Miami Heights, recorded in plat book 43, .
page 37, Miami-Dade County, Florida. .
BACKGROUND:
On June 11, 2014, an application for Tentative Plat (application no. T-14-006) review was filed
by the owner of the property, RP1-SM, LLC, in order to divide one existing tract of land
located at 6001 SW 80th Street (Figure 1) into five single family lots as shown in Figure 4. This
property also includes a portion of SW 60th Avenue, an unimproved right-of-way that was
abandoned and vacated by Resolution No. 81-05-12060, and recorded in the public records of
Miami Dade County. The existing home, and other structures will be demolished prior to the
construction of the new Single family residences.
Following submittal to the City, the property owner submitted for review to Miami-Dade
County, pursuant to Chapter 28 of the County Code. The proposal was to divide the 1.31 acre
tract to create five buildable lots as depicted in the Figure 4 proposed plat, with lots 1 through 3
fronting SW 79th Street, and lots 4 & 5 fronting SW 80th Street. The Miami Dade Platt
Committee approved the proposed Tentative Plat (application no. T-23506-3-REV) on
September 5, 2014. Pursuant to Chapter 28 of the County Code, the property owner then
submitted for Final Plat review to the City of South Miami City Commission.
On October 21, 2014, the City Commission review the Final Plat request described above and
deferred the item on the grounds that the applicant's use of the vacated right-of-way was
contrary to the stipulation of the vacation stated in Resolution No. 81-05-12060. The
Commission suggested the applicant consider other options for the subdivision of the tract, and
present those options at a future Commission meeting.
On November 6, 2014, the applicant presented the original proposal, and four additional
options for Commission review. However, the applicant indicated that the original request was
still the most feasible proposal and requested approval of that Final Plat The Commission failed
to approve the motion for Final Plat Davis Oaks by a vote of 1 aye; 4 nays.
