THE CITY OF PLEASANT LIVING To: FROM: DATE: SUBJECT: CITY OF SOUTH MIAMI OFFICE OF THE CITY MANAGER INTER-OFFICE MEMORANDUM The Honorable Mayor & Members of the City Commission Steven Alexander, City Manager February 3, 2015 Agenda Item No.:3 A Resolution for special use approval to permit a general restaurant at 570 I Sunset Drive, Shops at Sunset Place Unit ell C, within the Speciality Retail "SR", Hometown District Overlay "HD-OV". BACKGROUND: Pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC) the applicant is requesting Special Use Approval to locate a general restaurant at the above referenced location. The location of the restaurant will be in an existing ground level storefront of the Shops at Sunset Place, fronting the interior street, Banyan Court, and occupying space C I I C. This location will back up to Jimmy John's subs, which fronts on SW 57th Avenue (Red Road) (Figures I & 2). This proposed use is located in the "SR" Specialty Retail, "HD-OV" Hometown District Overlay zoning district which allows restaurants if approved through the special use process. The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board. Pursuant to the requirements for special use application review, the applicant provided notification via US mail to the surrounding property owners of their intent to file said application; documentation is on file with the Planning & Zoning Department. Although not technically a restaurant, the City's current land development code does not have a classification solely for a "coffee shop." The other similar uses are classified as "Ice Cream Parlors" and "Confectionary" stores, but are limited to ten seats only. Their concept and "Pasion// is to provide coffee lovers with a complete unique experience. The coffee house locations offer a "comfortable home away from home setting which is why we are attracted to securing our home away from home within the Shops at Sunset Place ... " The operation will generally be 7 days a week; Monday through Saturday 7 a.m. -11 p.m. and Sunday 8:00 a.m. -10:00 p.m. On April 1, 1997, the City Commission approved Resolution No. 64-97-10035, allocating the Shops at Sunset Place a total of 61,250 square feet of restaurant space. Parking calculations were based on these space allocations for all the uses in the Shops. With the addition of the 1,564 square feet for Pasion Del Cielo Coffee Co, the total restaurant square footage at the Shops is 46,287 square feet; area remaining for restaurant use is 14,964 square feet. The requested special use complies with the LDC requirements set forth for special uses in Section 20-3.4 and the proposed use meets the conditional requirements set forth in Section 20-5.8 in that the use: a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use, b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c) Complies with all other applicable Code provisions. This application does not conflict with the Comprehensive Plan. The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board. The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood. RECOMMENDATION: At the January 13, 2015 Planning Board meeting, a public hearing was conducted. The Board voted 6-0 to recommend approval of the special use application PB-15-001. If approved, the following terms and conditions as well as all applicable City ordinances, codes, rules and regulations should apply: (1) Adhere to the Special Conditions applicable in Section 20-3.4(B)(4)(b) General Restaurant and Section 20-5.8 Special Use Approval of the Land Development Code. All such establishments shall provide only inside or patio service on private 26 property. Public streets, rights-of-way, sidewalks and required setbacks may not be 27 used for patio or street-side services of any kind. 28 ii. No services of a drive-in or of a fast food nature shall be permitted. 29 iii.
