Resolution of the City Commission for the City of South Miami approving a final plat to allow
for the subdivision of property located at 6250 SW 56th Street, South Miami, Florida -Folio No.
09-4025-000-0190.
BACKGROUND:
On August 6,2013, the applicant 6520 Development UC, following Planning Board review and
recommendation, came before the City Commission with two waiver of plat applications
within an RS-3 zoning district. One application was for the north portion of the site with three
lots; one application for the south portion of the site with four lots, on property located at 6520
SW 56th Street. At that Commission meeting, the waiver of plat for the north portion was
approved by Resolution No. 163-13-13981; the waiver of plat for the south portion was denied
by Resolution No. 164F-13-13982. Subsequent to this Commission meeting, the applicant
chose to abandon the waiver of plat and move forward with a replat of the property located at
6520 SW 56th Street.
On May 16, 2014, Application No. T-14-005 for tentative plat review was filed with the
Planning & Zoning Department by the owners of the property, 6520 Development, nc, and
subsequently Application No. T-23499-2-CORR was also filed with Miami Dade County,
pursuant to Section 28-4 of Miami Dade County Code. The application was to subdivide the
single tract of land located at 6250 SW 56th Street into nine (9) new buildable, single-family
lots.
The Planning & Zoning Department conducted a review of application No. T-14-005 for a
tentative plat of the referenced property. A copy of the tentative plat review letter is included
in the backup for reference.

Analysis
The property is approximately 2.7 acres (mol), located in an RS-3 -Medium lot Single Family
Residential Zoning District, with frontage along SW 56th Street (Miller Road), and SW 65th
Avenue (Figure 1).

The property owner is proposing to subdivide this tract of land into a nine (9) lot
subdivision, for the purpose of constructing nine new single family residences. The
subdivision as proposed, will have an internal private road shown as SW 65th Court, with
ingress off SW 56 Street, and egress on SW 65th Avenue. The nine lots will range in size
from 10,040 to 13,251 square feet (Figure 2). The minimum lot size within the RS-3 zoning
use district is 10,000 square feet, with a minimum requirement of 75 feet of frontage. The

proposed lots are consistent with the RS-3 zoning district and with the RS-3 properties on
the east, south, and the northeast. The properties to the west and northwest are zoned
RT -6 "Townhouse Residential".

FINDINGS
The Miami Dade County plat committee met on October 3,2014 and recommended approval
of the tentative plat subject to any provisions enumerated in their approval letter, and subject
to final plat approval by the City and County.
On October 21, 2014 the Miami Dade County Environmental Quality Control Board (EQCB)
recorded Board Order No.14-55, approving a variance for the installation of septic tanks and
drainfields as a means of domestic waste disposal, limited to no more than four (4) non-
complying lots depicted on the tentative plat. Lots 1 and 6 of Block 2, and Lots 1, 2, and 3 of
Block 1 meet the County's minimum lot size requirements for septic tanks. In discussions with
the Miami Dade County Attorney for environmental resource management, lot size calculation
for septic tanks is determined based on the County's definition of "sewage loading", under
Chapter 24, Section 24-5 of the County Code. The definition states:
Sewage loading shall mean the estimated average amount of waste water generated by the
actual and projected use of a property as a function of the unsubmerged area of said property.
Abutting easements and rights-of-way shall be included to the center lines thereof in
calculating the unsubmerged area of the property.
Therefore, in calculating whether a lot meets the minimum size requirement of 15,000 square
feet for septic tanks, the County uses the square footage of abutting right-of-way (to the center
line) in their calculations. Lots 1 and 6 of Block 2, and Lots 1, 2, and 3 of Block 1 utilize the
square footage of the abutting right-of-way along SW 56th Street and SW 65th Avenue. The
remaining 4-lots were granted a variance by the EQCB. The Miami Dade County Environmental
Quality Control Board report is included for your reference.
A tree removal permit application was filed by the applicant on July 18, 2013, and a permit for
tree removal and mitigation was issued on March 4, 2014 prior to the revisions to the tree
ordinance and tree moratorium. The trees were removed according to the permit issued on
March 4, 2014. Additionally, a tree replacement bond was filed by the property owner, with
the City on November 11, 2014, and is included for reference.
Public works reviewed the proposed final plat and provided the following comments:
Yard waste pickup cannot be combined with different property owners; a centralized area
being proposed will not be acceptable. The development will need to utilize a private bulk
trash hauler for this purpose. The proposed sidewalks indicated on drawing that was reviewed
meets the requirements. Public Works will address any concerns related to drainage and
infrastructure that may arise when construction documents when submitted for permit review.
The final plat as proposed meets the minimum requirements for the RS-3 single-family
residential zoning district, and is consistent with the provisions of the City's comprehensive
plan.

RECOMMENDATION
The City of South Miami Code establishes the criteria under Chapter 20-4.2 of the land
development code for final plat approval. Staff has determined that the proposed final plat
complies with these requirements and therefore, staff recommends approval of the final plat
request subject to the following conditions, and/or other conditions deemed appropriate by
the City Commission.

b. Compliance with current City Land Development Code and Code of Ordinance
requirements.
c. Compliance with the City's tree protection ordinance and canopy mitigation

WHEREAS, 6520 Development Group, LLC, owners of the parcel located at the 6520 SW 56th
Street, submitted a Tentative Plat request to the City on May 16,2014, application No. T-14-005; and
subsequently to Miami Dade County, application No. T-23499-2-CORR, pursuant to Section 28-4 of
Miami Dade County Code; and
WHRERAS, the Miami Dade County plat committee met on October 3,2014 and recommended
approval of the tentative plat subject to any provisions enumerated in their approval letter, and subject to
final plat approval by the City and County; and

In May of this year the department reviewed a tentative plat application for the referenced replat for 9
lots with an internal road. Subsequent to that review the applicant submitted to Miami Dade County for
review and approval, and if you recall, their attorney (Melissa Tapanes) met with the Manager, you and I
to discuss submittal timelines. The application has been approved by Miami Dade County, and on
December 3,2014, they submitted to the City for "final" plat approval. The final plat has not changed
since the original tentative plat application in May. Please advise if this proposed amendments to
Section 20-4.2 -Land Subdivision, would affect this final plat proposal. Please note that I have it
scheduled to go to the City Commission at the January 6, 2015 meeting. Thank you.

The level of service report is as follows:
1. Traffic: The quantity of trips that will be generated by the site will not impact the existing level of service
for SW 65 Avenue or SW 56 Street. When the plat is submitted to Miami Dade County they will conduct a
traffic level of service for their plat review process.
2. Water: The site has an existing 12" water main located on SW 56 Street and a 6" water main located on SW
65 Ave. The site will have a new 8" water main installed within the ingress-egress and utility easement as
part of the Miami Dade Water & Sewer Department requirements for the approval of this plat since SW 65
Avenue (Miller Road) is a Miami Dade County roadway.
3. Sewer: The site will be served by on-site septic systems for each lot in accordance with the Health
Department standards. There is no available public sanitary sewer facilities within feasible distance to the
site that can be extended to serve the site.
4. Drainage: The site will be grade to retain all storm water for a 1 Day 10 Year storm event. This will be
accomplished by providing catch basins and french drains for the paved road that will be located within the
ingress-egress and utility easement. The lots will be graded to properly retain this storm event on each lot.
5. Solid Waste: As the site is within the City of South Miami the solid waste generated by each lot will have
be picked up by the City of South Miami. Using 7 pounds per day per person and an estimate occupancy
rate of 4 people per lot the estimated solid waste quantity will be 28 pounds per day.
6. Parks & Recreation: The site will utilize the City of South Miami facilities already existing within the
City's limits as well any facilities available within the area maintained by Miami Dade County.

The Planning & Zoning and Public Works Departments' conducted a review of your application
No. T-14-005 for a tentative plat of the referenced property [Folio 09-4025-000-0190],Located
at the southwest corner of SW 56th Street and SW 65th Avenue. The proposed plat will create a
nine (9) lot residential subdivision with an internal private road.
This parcel is zoned RS-3 -Low Density Single Family Residential, and meets the City's
minimum lot requirements of 10,000 square feet with 75 feet of frontage per lot, for this district.
The City's arborist reviewed the tree removal permit that was submitted with your application
and provided mitigation requirements for the finished development. A landscape performance
bond will need to be posted prior to development approval.
The Public Works Department reviewed the proposed layout and provided the following
comments:
• The 18 feet of paved street shown in the typical section is acceptable for the proposed
one way, with ingress at SW 56th Street (Miller), and egress at SW 65th Avenue.
However, Public Works will not be able to provide trash/yard waste collection. The
HOA will be required to manage a separate contract with a private hauler or landscape
vendor.
.. Garbage collection provided by the City on a one way can only be collected on the right
side of the street, or at a "one stop" location within the development.
When you have formally submitted your T-Plat application to Miami Dade County, the City will
submit your application for Miami Dade Schools concurrency review. You will be notified
directly by the Schools Facilities Planning Division once they have completed their review.
Additionally as discussed, the peak hour lOS standards for collector roadways is "E" capacity,
except that County collector roadways in the adopted Urban lnfill Area are exempt from
concurrency review requirements. Based on the information provided by your consulting
engineers (Cherokee Consulting, Inc.), each lot as proposed will be on an individual septic
system and served by Miami Dade potable water, subject to County approval.

This petition comes before the Board as a request by Petitioner, 6520 Development LLC, for a variance
from the requirements of Section 24-43.1 (3) of the Code of Miami-Dade County, Florida. The request is
to allow the subdivision of a parcel of land into nine lots and the subsequent development of each lot into
single family residences served by public water and a septic tank system. Four of the lots would not
comply with the minimum 15,000 square foot gross lot size Code requirement for a single family
residence served by public water and a septiC tank system. The request comes as a result of DERM's
deferral of a tentative plat application (T-23499). The subject property is located at 6520 S.W. 56 th
Street, Miami, Florida.
Section 24-43.1 (3)(a)(i) of the Code requires the minimum lot size for a single family residence served by
public water and septic tank shall be fifteen thousand (15,000) square feet (gross).
The Petitioner proposes to subdivide the existing 2.69 acres of land into nine lots to construct a single
family residence on each lot. Each lot has access to public water however public sanitary sewers are
located 2,000 feet from the subject properties. Lots 1 and 6 of Block 2 and Lots 1, 2 and 3 of Block 1
would meet the lot size requirement. Lot 2 of Block 2 would contain 11,209 square feet or 75% of what
the Code requires, Lot 3 of Block 2 would contain 11,166 square feet or 74%, Lot 4 of Block 2 would
contain 13,934 square feet or 93% and Lot 5 of Block 2 would contain 14,826 square feet or 99% of the
required area.
Although four of the nine proposed lots would not comply with the minimum 15,000 square foot gross lot
size requirement for a single family residence to be served by a septic tank, the average gross lot size
considering the nine lots is 15,154 square feet. Moreover, the four non-complying lots would comply with
the maximum sewage loading for residential uses other than single family residence and duplex
stipulated in Section 24-43.1 (3)(a)(iii) of the Code, 1,500 gpd/Ac, if the homes are limited to a maximum
gross areas of 5,000 square feet.
Based on the foregoing, staff believes that granting the requested variance to allow the subdivision of a
parcel of land into nine lots, including four lots that do not comply with the minimum lot size requirement
for a single family residence to be served by public water and a septic tank system, will not be
detrimental to the public health, welfare and safety, will not create a nuisance, and will not materially
increase the level of pollution in this County. Therefore, staff recommends approval of the variance
from the requirements of Section 24-43.1 (3) of the Code, subject to the following condition:

1. This variance is limited to no more than four (4) non-complying lots as depicted on the tentative

2. The maximum gross area of each single family residence shall not exceed 5,000 square feet.
*The Petitioner is advised that this approval does not guarantee or ensure approvals from any other
federal, state, county or municipal agency and that the variance granted herein does not affect or
modify any requirement of any other provision of law.
**Failure at any time to comply with any of the Conditions of this Board Order shall render this Order
null and the variance granted herein no longer in effect. Upon compliance with the conditions, the
variance shall be reinstated.

THIS MATTER came before the Board on September 11, 2014 as a request by Petitioner, 6520
Development LLC, for a variance from the requirements of Section 24-43.1 (3) of the Code of
Miami-Dade County, Florida. The request is to allow the subdivision of a parcel of land into nine
lots and the subsequent development of each lot into single family residences served by public water
and a septic tank system. Four of the lots would not comply with the minimum 15,000 square foot
gross lot size Code requirement for a single family residence served by public water and a septic
tank system. The request comes as a result of DERM's deferral of a tentative plat application (T-
23499). The subject property is located at 6520 S.W. 56th Street, Miami-Dade County, Florida and
is more particularly described in Exhibit "A" attached hereto and incorporated herein by reference.
Section 24-43.1(3)(a)(i) of the Code requires the minimum lot size for a single family residence
served by public water and septic tank shall be fifteen thousand (15,000) square feet (gross).
The Petitioner proposes to subdivide the existing 2.69 acres of land into nine lots to construct a
single family residence on each lot. Each lot has access to public water however public sanitary
sewers are located 2,000 feet from the subject properties. Lots 1 and 6 of Block 2 and Lots 1, 2 and
3 of Block 1 would meet the lot size requirement. Lot 2 of Block 2 would contain 11,209 square feet
or 75% of what the Code requires, Lot 3 of Block 2 would contain 11,166 square feet or 74%, Lot 4
of Block 2 would contain 13,934 square feet or 93% and Lot 5 of Block 2 would contain 14,826
square feet or 99% of the required area.
Although four of the nine proposed lots would not comply with the minimum 15,000 square foot
gross lot size requirement for a single family residence to be served by a septic tank, the average
gross lot size considering the nine lots is 15,154 square feet. Moreover, the four non-complying lots
would comply with the maximum sewage loading for residential uses other than single family

residence and duplex stipulated in Section 24-43. 1 (3)(a)(iii) of the Code, 1,500 gpd/Ac, if the homes
are limited to a maximum gross areas of 5,000 square feet.
The Board finds that based upon the testimony presented and the foregoing findings granting a
variance to allow the subdivision of a parcel of land into nine lots, including four lots that do not
comply with the minimum lot size requirement for a single family residence to be served by public
water and a septic tank system, will not be detrimental to the public health, welfare and safety, will
not create a nuisance, and will not materially increase the level of pollution in this County.
ACCORDINGLY, IT IS,
ORDERED AND ADJUDGED that, based upon the evidence and testimony presented and the
foregoing findings, the requested variance from the requirements of Section 24-43.1(3) of the Code
of Miami-Dade County, Florida, be and the same is hereby granted, subject to the following
conditions:
1. This variance is limited to no more than four (4) non-complying lots as depicted on the
tentative plat and boundary survey (Exhibit A).
2. The maximum enclosed area of each single family residence shall not exceed 5,000 square
feet.
*The Petitioner is advised that this approval does not guarantee or ensure approvals from any other
federal, state, county or municipal agency and that the variance granted herein does not affect or
modify any requirement of any other provision of law.
**Failure at any time to comply with any of the Conditions of this Board Order shall render this
Order null and the variance granted herein no longer in effect. Upon compliance with the
conditions, the variance shall be reinstated.

the disposal of domestic liquid waste. Some of the proposed lots do not meet the minimum allowable lot size
requirements of Section 24-43.1(3) of the Code of Miami-Dade (the Code) for a single-family residence served
with a septic tank and public water. Pursuant to Section 24-43.1{3} of the Code, the minimum lot size for a single
family residence served by public water and a septic tank shall be 15,000 square feet (gross).
Inasmuch as the subject applic()tion did not comply with the above Code Section, DERM was not able to
administratively approve this application. Accordingly, the applicant applied for variance before the
Environmental Quality Controi Board -(EQCBj. Based upon the evidence and aVaiiableinrbrmation the Board -
approved the applicant's petition.
A public water supply must be utilized to serve this entire subdivision. Plans for the extension of the existing
water mains to serve this property must be approved by DERM prior to the approval of this waiver of plat
Average time to obtain a Water Extension permit is three (3) working days. However, actual time to obtain a
Water Extension Permit may vary significantly based on the completeness of the submittal and review time by

such obligation, all to be taxed as costs and included in any judgment rendered.
The surety hereby stipulates and agrees that no change, extension of time, alteration or addition to the terms of the
agreement or to the work to be performed thereunder or the specifications accompanying the same shall in anywise
affect its obligations on this bond, and it does hereby waive notice of any such change, extension of time, alteration or

APPLICANT'S REQUEST: The applicant has filed a tree removal permit for the removal of
188 trees as shown on the Tree Disposition Plan, sheet LD-1:
Tree Specifications
All replacements must be Native Hardwoods, Florida Fancy Number I with a minimum height
of 12'-0"
Tree Removal Conditions
1. As per the City's certified arborist, Doug Baker, the 188 trees listed for removal on the
attached Tree Disposition Plan are approved with the following conditions:
a. A total mitigation of 115 replacement trees will be required for the removal of the 188
trees on the property. Please refer to the attached Mitigation Table for details on how the
tree replacement mitigation was calculated.
b. If it is determined that the new single family residenccs for the project are two-story in
height, all replacement trees shall have a minimum height of eighteen (18) feet.
c. The stumps of the trees that were approved for removal must be ground and a final
inspection must be held prior to the expiration of this permit. ]f this permit is part of a new
construction project, the final inspection must be held prior to the issuance of the
CCliificate of Occupancy for the new construction projcct for this location.
2. Pursuant to Section 20-4.5(1)(4)( d) of the Land Development Code, a performance bond will
bc rcquired for this project. The performance bond must comply with the following guidelines:
a. The Planning Director may require the posting of a performance bond to guarantee
compliance with all conditions, limitations, and rcstrictions of the trcc removal permit,
including, but not limited to, planting of all required replacement trees.
b. The bond shall be equivalent to one hundred fifteen percent (115%) of the estimated cost of
the permitted activity and may be in the form of a letter of credit, surety, cash, or certificate
of deposit.

c. All performance bonds shall remain in force for a minimum of either one (1) year after the
actual completion date of the permitted activity (to ensure that any replanted trees which
perish are replaced), or until viability of all replanted trees has been achieved, which ever
occurs last.
d. At the discretion of the Planning Director, performance bonds may be partially released in
phases based upon partial completion of planting or other permit requirements.
3. In an effort to not hinder progress of this project, the tree removal permit for the
aforementioned property has been approved, allowing the removal of the 188 trees to
commence separately or as patt of an approved building permit for demolition. At the latest,
the performance bond will be required prior to submittal to the Environmental Review &
Preservation Board (ERPJ3) for preliminary review of the new single family homes.
