Alexander, City Manager January 6, 2015 Agenda Item No.: A Resolution approving the application of VolksBlast, Inc., a non-profit organization, to waive certain fees and costs associated with its event showcasing classic cars, to be held on February 8, 2015, on Sunset Drive in South Miami. Background: VolksBlast, Inc., a non-profit organization, has submitted a Special Event Application to hold its classic car show on February 8, 2015. For the past several years, VolksBlast, Inc. has held its event in the City of South Miami, showcasing 200 classic cars. Expense: Account: The applicant is requesting a street closure of Sunset Drive, signatures requirement from majority of business affected by road closure, waiving of certain fees, and payment for this event after the completion of the car show. The applicant has paid the City $660, which includes $60 application fee, $100 administrative fee, and $500 deposit. The applicant will be responSible for additional services, including $1,320 for Police, $2,400 for 96 Parking meters, Street Closure fee of $475, MOT Fee $200, and Public Works Staff $172; totaling an estimated amount of $4,567. However, the applicant has requested the following fees be waived: City Meters ($25 X 37 meters in Lot B behind former Chase Band) $925 Street Closure( 1900 linear feet x .25) $475 MOT Fee $200 Total amount requested to be waived $ 1,600 If the above estimated cost of $1,600 is waived, then VolksBlast, Inc., will pay for Police personnel at the estimated cost of $1,320, and the cost for the parking meters on Sunset Drive in the amount of $1,475, and one Public Works staff person in the amount of $172, with a combined total of $2,967. Additionally, for the past two years, under Resolution # 215-13-14033 and Resolution # 258-12-13815, VolksBlast, Inc. approval was given to hold this event, and the City Commission waived fees for Public Works, street closure fee, and metered parking spaces. WHEREAS, Yolks Blast Inc, a 501 (c) 3 non-for-profit organization, has submitted a Special Event Application; and, WHEREAS, for past several years the Yolks Blast Inc has held their classic car show event in the City of South Miami; and, WHEREAS, the applicant has requested permission to hold its event on February 8, 2015; and, WHEREAS, the applicant has paid $660, which includes $60 application fee 100 administrative fee and $500 deposit fee; and, WHEREAS, VolksBlast, Inc., will provide, prior to this event, a list of entertainers/bands and any other activities occurring during this event, along with an insurance policy naming the City as an additional insured, and meeting the other standard requirements of the City; and, WHEREAS, a logistic meeting with Police and Public Works Departments will be coordinated through the Special Events Coordinator, in January 2015; and, WHEREAS, the applicant will be responsible for all services rendered by the Police $1,320 (2 Officers @ 13 hours x $40.00 per hour, plus one (1) Officer @7 hours x $40 per hour), and Public Works $172 (1 employee plus FICA), and Parking meters totaling $2,400.00 ($25.00 per meter per day for 59 parking spaces on Sunset Drive from US 1 to Red Road, plus 37 meters in Lot B behind the former Chase Bank), and Street Closure fee in an amount of $475 (1,900 linear feet X .25) and MOT fee of $200, total estimated amount of these services would be $4,567; and, WHEREAS, the applicant is seeking a waiver for the following items: 37 Metered Parking Spaces (Lot B behind Chase Bank) Street closure MOT Fee Total amount waived and, $925 $475 $200 $1,600 WHEREAS, under Resolution # 215-13-14033 and Resolution 258-12-13815, VolksBlast, Inc. was given waivers for Public Works, Street closure fee, and 37 metered parking spaces in Lot B located behind Chase Bank; and, WHEREAS, if the City waives the amount mentioned above, then Yolks Blast Inc would pay the City $2,967, for Police services, 59 Parking meters and one Public Works personnel. The City hereby approves the application of VolksBlast, Inc., for waiver of fees as set forth in the above recitals. Section 2. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Permits for Special Events must be on event site at all times. 4. No Street shall be closed without authorization from the City of South Miami Public Works Department and Police Department. S. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami-Dade County standards and any additional requirements by the City of South Miami Public Works Department and Police Department. 6. Event areas shall be restored to equal or better condition than they were before the event started. 7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public Works Department may restore the event area and charge the applicant for the cost of restoration plus a minimum of 15% for administrative fee and any additional incidental fees. 8. Applicant must pay all fees prior to.the start of their event(s). 9. Applicahts that receive approval for their event more than thirty (30) days in advance shall notify the City of South Miami Special Event/Marketing Coordinator at least forty-eight (48) hours prior to start of their event. 10. Any damage to private property shall be restored to its original condition or better and as accepted by the Owner. The following policies and procedures must conform in order to schedule a police officer for employment on a temporary or infrequent basis: ~ The South Miami Police Department shall be the final authority in determining the minimum number of officers required to police a particular event. If more than three officers are hired, a supervisor must also be hired. The City Manager Office and South Miami Police Department will determine the supervisor to officer ratio for larger events. ~ The Applicant will be required to compensate the assigned officer for a minimum of three (3) hours even if the even! is of a shorter duration. Currently the rate for Extra-Duty Police Officer is $40 per hour & $50 per hour for Supervising Officer, plus a $3.00 charge for radio usage for each officer. ~ The Applicant must compensate the officer(s) for their services at least one (1) day prior to the start of the scheduled event that the officer(s) will be assigned to. No monetary payment will be accepted. No payment by exchange of goods or services is acceptable. ~ If, during a scheduled event, the Applicant determines that he/she needs to extend the time an officer(s) works at the assignment, the Applicant shall compensate officer(s) for a full hour worked if the Officer(s) works for more than 20 minutes and/or less 59 minutes beyond the regularly scheduled time of the event. ~ Applicant must notify of a cancellation request of an Off-DUty Police Officer forty-eight (48) hours prior to the scheduled date of service. WHEREAS, VolksBlast, Inc. a non-profit organization, has submitted a Special Event Application; and, WHEREAS, for several years VolksBlast, Inc. has held their classic car show event in the City of South Miami; and, WHEREAS, the applicant has requested permission to hold its event on February 9, 2014; and, WH EREAS, the applicant has paid $500 deposit fee, $ J 00 administrative fee, and $60 application fee; totaling $660.00; and, WHEREAS, VolksBlast, Inc. will provide a list of entertainers/bands and any other activities occurring during this event, along with an insurance accord naming the City as an additional insured will be provided to the City in January of 20 14; and, WHEREAS, a logistic meeting with Police and Public Works Departments will be coordinated through the Special Events Coordinator, in January 2014; and. WHEREAS, Yolks Blast Inc, a 501 (c) 3 non-for-profit organization, has submitted a Special Event Application; and, WHEREAS, for several years the Yolks Blast Inc has held their classic car show event in the City of South Miami; and, WHEREAS, the applicant has requested permission to hold its event on January 20, 2013; and, WHEREAS, the applicant has paid for the deposit fee of $600, and an application fee of $60.00; totaling $660.00; and, WHEREAS, the applicant will pay for all service rendered by the Police Deprutment in a total amount of $ 1,400.00, and City meters at $1,475.00 ($25.00 per meter per day X 59 meters), totaling $2,875.00 for all services; and, WHEREAS, the applicant is seeking a waiver of the street closure fee in the amount of $325.00 (1,300 linear feet X.2S-closure of Sunset Drive from USl to Red Road); and, WHEREAS, on December 13,2010, a resolution (#276-10-13310) approved a waiver for the street closure fee in the amount of $1 0,000; and, WHEREAS, during the past year, this flat fee was modified through the Fee Schedule under Ordinance Item -Temporary Full Road and Sidewalk Closure charging .25 per linear foot (as mentioned above); and" WHEREAS, in a meeting with the fanner City Manager Hector Mirabile, Commissioner Han-is and Mr. Stickley, ofVolks Blast Inc, it was concluded that the Public Works Depultment will not be involved in this event.
