South Miami Rotary, a 50 I (c)(3), has submitted a Special Event Application to hold its 32rd Annual Arts Festival on February 21 & 22, 2015. For the past 31 years, South Miami Rotary Art & Craft Festival has been held in the City of South Miami, and sponsored through South Miami Rotary. The applicant has paid the City $1,260, which includes $60 application fee, $100 administrative fee, $500 deposit, banner over public right-of-way fee of $300, and pole banners fee of $300 for 7 pole banners. The applicant is responsible for all services rendered by the Police $7,740, Public Works $4,478, Street Parking meters $3,200, Street Closure $475, MOT Fee $200; totaling an estimated amount of $16,093. The applicant is requesting waivers from obtaining signatures of approval from a majority of the business affected by the street closure, fees for road closure costs, parking revenue and the requirement that costs of police and any other department be paid prior to the permit being issued. The City hereby approves the applicant's request for waiver of street closure and parking meter(s) fees. Section 2. The City Manager is hereby authorized to allow the final payment of all fees, including but not necessarily limited to Police and Public Works upon completion of the event, currently in the approximate amount of $12,218.40, which does not include any applicable street closure fees. Section 3. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. We request that in the Resolution drafted for the Commission you please include waivers from the following sections of Ordinance 158: 6.3 Which requires us to obtain signatures of approval from a majority of the business affected by the street closure. 6.4 Those provisions pertaining to road closure costs and lost parking revenue 6.6 The requirement that costs of police and any other department employment be paid prior to the permit being issued. All of the waivers that we request are in keeping with the long standing policy of the City of South Miami which has always recognized the value to the city of the South Miami Rotary Art Festival. We bring approximately 25,000 visitors to the city over a two day period, many of whom return throughout the year to spend money in the downtown area. Kindly note that overall net parking revenues increase in South Miami as a result of both the Chamber and Rotary Art Festivals. The thousands of patrons that visit the festivals fill up the municipal parking garage and other metered locations throughout the Town Center that typically would not be filled during the same hours of operation. Profits from our festival are used to fund an annual college scholarship for a South Miami student. We have been giving scholarships to needy children in South Miami for at least 20 years. Our free dictionary and atlas project in conjunction with the Miami-Dade Public Libra~ System awards over 3000 dictionaries and atlases to South Miami 3rd and 5t grade students, respectively, as well as to several at-risk schools throughout the county. We would be happy to innumerate some of our other projects which vary according to needs of the community and the world not the least of which was the lighting of Rotary Field at Murray Park in South Miami. Prior to 2011 the City of South Miami provided grants to non-profits such as Rotary to help defray Police and Public Works expenses incurred. In the past few years we understood that you had budget problems, but we continued to show the City as a sponsor in our publicity in hopes that you would be able to return to that status when budget allows, hopefully this year. The city has always recognized the value of our art festival to bring many return visitors to South Miami raising awareness of all that the city has to offer. WHEREAS, South Miami Rotary, 50 1 (c)(3), has submitted a Special Event Application; and, WHEREAS, for the past 30 years the South Miami Rotary Art Festival has been held in the City of South Miami, and sponsored through South Miami Rotary; and, WHEREAS, the applicant has requested permission to hold its event on February 22 & 23,2014; and, WHEREAS, the applicant has paid for the deposit, application, Street and pole banner fees, totaling $1,260; and, WHEREAS, the applicant will pay for all services rendered by the Police and Public Works Departments in an estimated amount of $13,517; (Police $7,730 and Public Works $5,787); and, WHEREAS, Resolution #155-03-11705, revising a policy related to requiring signature petition from businesses as previously established through Resolution #27-03-11576, and granting an exemption as to the South Miami Rotary; and, WHEREAS, Resolution #85-06-12226, dated June 6, 2006, waives the requirements established in Resolution #27-03-11576, by providing that the "Mayor and City Commission agree to close Sunset Drive for the annual event", and "Rotary shall not be required to reimburse the City for lost parking revenues"; and, WHEREAS, Resolution # 229-11-13543, dated December 20, 2011, waived the requirements for payment of the fee for the street closure for the event held in 2012; and, WHEREAS, Resolution # 243-12-13800, dated November 20, 2012, again waived the proposed street closure fee for the 2013 events; and, WHEREAS, the applicant is requesting that it not be assessed street closure fees, as per Resolutions # 229-11-13543 and 243-12-13800 from 2011 and 2012 respectively. WHEREAS, the Mayor and City Commission of the City of South Miami desire to continue to encourage the existence of the annual South Miami Arts and Crafts Festival; and, WHEREAS, for the past 22 years the Red Road Merchant's Association (RCSM and RS!VfA) sponsored the South Miami Arts and Crafts Festival; and, WHEREAS, RCSM and RSMA are no longer interested in sponsoring the event; and, WHEREAS, the Rotary Club of South Miami (Rotary) would like to continue the event, sponsor the event, and have the event recognized as an annual event supported by the Mayor and City Commission; and, WHEREAS, if the Mayor and City Commission agree, the Rotary would like to rename the event the "South Miami Rotary Arts Festival;" and, WHEREAS, Rotary would like the City's annual special event pelmit policy adopted under resolution 27-03-11576, to be waived as to this annual event, as the art festival has been a long standing event and popular event in the City; and, WHEREAS, the city shall annually allocate funds to support the city's "in- kind" police services for the event, in order to assist with defraying the costs of the Rotary's efforts to sponsor the event; and, WHEREAS, the Mayor and City Commission agree to close Sunset Drive for the annual event; and, Additions shown by underlining and deletions shown by overstriking. Res. No. 85-06-12226 WHEREAS, Rotary shall coordinate with the South Miami Police Department regarding scheduling and coordinating the event and ensuring proper security for the event; and, WHERAS, Rotary shall not be required to pay any additional rental charges to the city for the special event, but, may be required to pay for necessary clean-up services; and, WHEREAS, Rotary shall not be required to reimburse the City for lost parking revenues; and, WHEREAS, the Mayor and City Commission desire to provide "in-kind" assistance to the Rotary by providing police services to the Rotary for the annual event; and, WHEREAS, Rotary shall be required to obtain public liability insurance coverage, which policy shall name the city as an additional insured for the date, time, and location of the sponsored event, in the amount of $1,000,000, prior to the event date. All organizations sponsoring an approved special event which closes a public street within the City of South Miami, must provide in advance, a petition signed by a majority of businesses facing the street affected by the approved special event. Section 5. All organizations sponsoring approved special events using public property or public streets within the City of South Miami must agree in writing as to pay the actual the amount of City revenue loses and final City expenditures associated with the approved special event. 27-03-11576 (2) Section 6.
