Alexander, City Manager Date: December 2, 2014 Agenda Item No.: Subject: A Resolution contributing to the memorial services for Mr. Hans Huseby and amending or repealing Resolutions #27-03-11576 and/or #155-03- 11705. Background: On Saturday, November 29, 2014, we lost an amazing person who was a great supporter of the City of South Miami. Mr. Hans Huseby was an astounding man, with a positive attitude. He was an incredible contributor to the Red Sunset Merchants Association for many years. He worked tirelessly for the Safe Street Halloween and for Santa's Elves Parade events held within South Miami on Sunset Dr. He was the model of a man, who understood the value of sharing his love and devotion to the South Miami community. John "Hans" Huseby will be greatly missed. The event is to be a "memory of services" relating to his life and is expected to be attended by somewhere between 500 and one thousand people. The family requested the closure of Sunset Drive (SW 72 Street) between SW 57 Court to SW 57 Avenue (Red Road), and staff has suggested an alternate site of SW 57 Court from Sunset Drive (SW 72 Street) to SW 73 Street. He worked tirelessly for the Safe Street Halloween and 14 for Santa's Elves Parade events held within South Miami on Sunset Dr. He was the model of a 15 man, who understood the value of sharing his love and devotion to the South Miami 16 community; and 17 18 WHEREAS, Team FootWorks would like to hold a memorial service in front of the 19 Team FootWorks store on Sunset Drive (SW 72 Street) between SW 57 Court to SW 57 Avenue 20 (Red Road), and as an alternate City staff has suggested the closure of SW 57 Court from Sunset 21 Drive (SW 72 Street) to SW 73 Street; and, 22 23 WHEREAS, the City would like to contribute to the service in memory of Mr. Hans 24 Huseby. 25 26 WHEREAS, Mr. John "Hans" Huseby will be greatly missed by the City of South 27 Miami; and 28 29 WHEREAS, Resolution #27-03-11576, passed in early 2003, required all organizations 30 sponsoring approved special events using public property or public streets within the City of 31 South Miami to reimburse the City for all City revenue lost, and for costs incurred by the City 32 associated with the approved special event. It also required approval of the City Commission by 33 resolution which was required to include the estimated reimbursement amount to be paid to the 34 City for lost revenue and City costs. Each Special event which results in closing a public street 35 within the City was required to provide, in advance, a petition signed by a majority of businesses 36 facing the street affected by the approved special event and if the sponsoring organization had 37 been allocated monetary grants in the adopted City Budget, the organization was required to 38 reimburse the City from the designated monetary grant. 39 40 WHEREAS, later in 2003 Resolution #155-03-11705 was adopted amending section 4 of 41 Resolution No. 27-03-11576 which sets forth a policy requiring a signature petition of a majority 42 of businesses facing the street affected by the approved special event. Resolutions #27-03-11576 and/or #155-03-11705 are hereby amended and/or repealed as follows: __________________________ _ Section 2. The City Manager is authorized to waive the following fees for the Hans Huseby memorial services: __________ _ Section 3. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. RELATED TO SPECIAL EVENTS, IN ORDER TO REVISE A POLICY RELATED TO REQUIRING A SIGNATURE PETITION FROM BUSINESSES IMPACTED BY A SPECIAL EVENT; PROVIDING AN EFFECTIVE DATE. WHEREAS, public property and public street locations within the City of South Miami are used by organizations for special events which are beneficial to the City and its residents; and WHEREAS, the City Commission at its February] 8, 2003 adopted Resolution No. 27-03-11576 which set forth policies on funding special events, costs for special events, and policies to be followed by organizations sponsoring special events within the City; and WHEREAS, Section 4 of Resolution No. 27-03-11576 sets forth a policy requiring a signature petition of businesses impacted by a street special event ;and WHEREAS, the City Commission desires to clarify the above policy by specifying that certain long standing special events are exempt from the policy pertaining to a signature petition of businesses impacted as set forth· in Section 4 of Resolution No. 27-03-11576. NOW, mEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 'COMMISSION OF THE CITY OF SOUTH MIAMI, FLOIRDA, AS FOLLOWS: Section 1. That Section 4 of Resolution No. 27-03-11576 which sets forth a policy requiring a signature petition of businesses impacted by a street special event, is hereby amended to read: "Section 4. WHEREAS, public property and public street locations within the City of South Miami are used by organizations for special events which are beneficial to the City and its residents; and WHEREAS, such special events may require City services and resources to be expended in order to provide security, clean up, banner hanging, street blocking, covering of parking meters; and WHEREAS, the Mayor and City Commission desire set forth a policy requiring reimbursement to the City for all revenues lost or expenditures made for special events. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLOIRDA, AS FOLLOWS: Section 1. All organizations sponsoring approved special events using public property or public streets within the City of South Miami must reimburse the City for all City revenue loses, and City expenditures associated with the approved special event. Section 2. All organizations sponsoring special events using public property or public streets within the City of South Miami must receive approval by resolution from the South Miami City Commission. The resolution must include the estimated reimbursement amount to be paid to the City for all City revenue loses and City expenditures associated with the approved special event. Section 3. The resolution described in Section 2 above may also specify an additional monetary contribution to be made by the organization to the City; the resolution shall specify as how the additional monetary contribution is to be used by the City. Section 4. All organizations sponsoring an approved special event which closes a public street within the City of South Miami, must provide in advance, a petition signed by a majority of businesses facing the street affected by the approved special event. Section 5. All organizations sponsoring approved special events using public property or public streets within the City of South Miami must agree in writing as to pay the actual the amount of City revenue loses and final City expenditures associated with the approved special event. 27-03-11576 (2) Section 6. All organizations sponsoring approved special events using public property or public streets within the City of South Miami which have been allocated monetary grants in the adopted City Budget, should pay for the required reimbursement from the designated monetary grant.
