December 2,2014 Agenda Item NO.:_-5- Thru: DATE: SUBIECT: A Resolution of the City Commission of the City of South Miami, relating to an appeal of a decision of the Environmental Review and Preservation Board regarding the denial of a sign age installation located at 5740 Sunset Drive. BACKGROUND: The original application [ERPB-14-006] for sign age review was filed by the applicant in January 2014. On February 4,2014, the Environmental Review and Preservation Board (ERPB), reviewed the signage request by AAA On Time Electric (the applicant) to install a sign that was proposed to be mounted above the entrance on the fascia leading into the business and on the projecting storefront for RAZZLEDAZZlE Barber Shop, located at 5740 Sunset Drive (Figures 1, & 2). The proposed illuminated flat sign would consist of reverse channel letters that will read "RAZZlEDAZZlE" on the first line and "BARBERSHOP" just below. The proposed sign was intended to be flush mounted to the building and consist of a combination of black letters with a red outline, detailing the colors of the company. Following a staff review of the proposed sign, it was found that it did not exceed 20% of the area allowed for any building face (32.4 S.F.) and was less than two hundred (200) square feet in area. The applicant also proposed to install a traditional barber pole on the exterior of the storefront. located at the far right of the establishment, the proposed barber pole would be mounted to the black aluminum storefront via screws at a height of eighty-four (84) inches above the sidewalk, and extend out from the building approximately ten (10) inches. When reviewed, it was found that the height of the proposed barber pole complied with the regulations listed in Section 20-3.3(E)(11) which states that non-stationary elements shall have a minimum clearance of seven (7) feet above the sidewalk. Figure 3 shows a comparison of signage for the business just west of the subject location, at the end of the block. At that meeting, the Board felt that the sign was too large, overlapped adjacent businesses, and was out of scale due to the rendering that was provided. Also, the barber pole should be moved closer to the entrance. Because of this, the Board deferred the item with the condition that the applicant provides the Board with additional photographs of adjacent stores, and provides a revised rendering that is to scale. Subsequent to the February 4, 2014 ERPB meeting on the applicants request, the applicant and business owner had four additional appearances before the ERPB. Below is a summarized chronology of events that led to the final action of denial of the request at the October 7, 2014 ERPB meeting. February 4,2014: ERPB-14-006 -RazzleDazzle Barbershop Signage Request Timeline First appearance before the ERPB: The applicant proposed signage that would be located on both the fascia board as well as above the storefront entrance. The applicant also proposed to install a barber pole at the western edge of the storefront. The Board felt that the sign was too large, overlapped adjacent businesses, and was out of scale due to the rendering that was provided. Also, the barber pole should be moved closer to the entrance. Because of this, the Board deferred the item with the condition that the applicant provides the Board with additional photographs of adjacent stores, and provides a revised rendering that is to scale. March 18, 2014: Second appearance before the ERPB: The applicant resubmitted plans for review by the ERPB. It was a consensus that the Board was not receptive to allowing signage on the fascia board, and that the barber pole be relocated to the entrance of the store. Also, the Board felt that the wording above the entrance appeared to be larger than the proposed area. Because of this, the Board deferred the item with the condition that a drawing/picture that is to scale detailing the correct location of the sign in relation to its surroundings be submitted. It was determined that the business already had window signage, of which the business owner stated that the signs in question were put up in order to increase traffic to the business. Board member Kelly stated that the window area of the storefront could be utilized, and the Board discussed the possibility of modifying the configuration of the proposed sign so that it can accommodate the window area. Because of this, the Board granted final approval for the application with the condition that the sign "RazzleDazzle Barber Shop" be placed above the projecting storefront window (only) that is closest to the sidewalk, and not on the fascia board. Sometime following the April 15, 2014 ERPB meeting, the applicant installed the sign that is currently on the building. The sign is attached to the projecting storefront, but also extends out over the alcove opening (Figure 4). Figure 4. At the hearing, the magistrate ordered the case to continue for 60-days till the September hearing agenda, to allow the property owner to re-appear before the ERPB on July 22, 2014 to get approval for the signage installed without a permit. July 22,2014: Fourth appearance before the ERPB: The applicant submitted revised plans for review by the ERPB. The plans submitted depicted the sign that was found to be in violation by Officer Bynum. Because of the recessed design of the storefront, the Board showed concern with how the sign would be attached to the building. Even though the business owner stated that the sign is supported by anchors, the Board deferred the application so that the applicant could work with the sign fabricator to address the Board'sconcerns, and come up with a design that would adequately secure that portion of the sign that extended east of the storefront window over the alcove entrance. October 7, 2014: Fifth appearance before the ERPB: The applicant resubmitted plans for review by the ERPB. The design submitted was similar to the design submittal from the July 22nd meeting; the difference was the addition of aluminum brackets to address the Board's concerns of how the sign would be adequately secured to the structure (Figure 5). Although the sign fabricator provided a revised design for securing the sign, the Board felt that the proposed signage would not be securely fastened to the building. The Board then reiterated that the original approval called for the sign to be placed above the projecting storefront window that is closest to the sidewalk only and not as currently installed. The Board then denied the application, stating that the design that was originally approved by the ERPB in April should be used. October 7, 2014 Because the case was deferred from the July 22, 2014 ERPB meeting and denied at the October 7, 2014 ERPB meeting, the case will be scheduled for the next available Special Magistrate hearing (November 20, 2014). If the Commission should choose to approve the appeal, it is recommended that the fastening schedule be reviewed by the Building Department for compliance and any outstanding fees be paid prior to the issuance of a permit. STATUS UPDATE: Originally appearing before the Environmental Review & Preservation Board at its March 18, 2014 meeting, this item was deferred so that the applicant could provide the Board with a drawing/picture to scale that details the correct location of the sign in relation to its surroundings. At the request of the Board, the applicant has submitted a revised drawing for review as well a photograph of the site. Staff has attached additional photographs in an effort to supplement the photographs provided by the applicant. STAFF ANALYSIS: The applicant is proposing to install two (2) signs that will be mounted above the entrance leading into the store. Considered to be flat signs, Section 20-4.3(1)(5) All Other Zoning Districts, of the Land Development Code, provides the following regulations for flat signs: FLA T signs with a total aggregate sign area, not to exceed twenty (20) percent of the area of any building face; for the purposes of sign regulation, there shall be considered to be only four (4) facades to any building; no single sign shall exceed two hundred (200) square feet in area. Direct illumination is permitted. Both illuminated flat signs will consist of reverse channel letters that will read "RAZZLE DAZZLE" and "BARBERSHOP" respectively. Based on the revised drawings that were provided, the portion of the "RAZZLE DAZZLE" sign will be flush mounted to the fascia above the store and will have a height of twelve (12) inches, a length of ten (10) inches, and a sign area of approximately ten (10) square feet. The "BARBERSHOP" sign will be located on the left side of the storefront, just above the storefront windows. Consisting of white colored lettering that will be flush mounted to the building, the sign will have a height of nine (9) inches, a length of eighty (80) inches, and a sign area of approximately five (5) feet. Furthermore, it was found that while the name of the business "RAZZLE DAZZLE BARBERSHOP" is split up into two separate signs, and was reviewed separately, it is considered to be one sign that complies with the regulations listed above for flat signs. When reviewed against the other signage for this building, it was found that the only tenant that has signage mounted to the fascia is the corner tenant, Buns & Buns. While there is no signage master plan for this building, it has been common practice that all signage for this building be located just above the storefront entrance and not mounted to the fascia, which is reserved only for the corner tenant. If the sign is to be relocated to the area above the entrance, then either a further reduction in size or a total redesign would be necessary in order to accommodate the proposed signage. The applicant is also proposing to install a traditional barber pole on the exterior of the storefront. Previously proposed for the far right of the establishment, the applicant has relocated the proposed barber pole to the entrance into the establishment. The proposed barber pole will be mounted to the black aluminum storefront via screws at a height of eighty-four (84) inches above the sidewalk, and will extend out from the building approximately ten (10) inches. When reviewed, it was found that the height of the proposed barber pole complies with the regulations listed in Section 20-3.3(E)(11) which states that non-stationary elements shall have a minimum clearance of seven (7) feet above the sidewalk. Therefore, it is recommended that both the proposed sign and the barber pole be approved. RECOMMENDATION: Approval with the following conditions: 1. No electrical wiring is to be exposed; 2. All signage from the previous tenant must be removed; 3. Any additional signage will require a separate submittal to the ERPB; and 4. Any comments and/or suggestions from the Board. On December 26, 2013, I hired Luis Arnaldi who presented himself-as a contractor, to do a sign for "RazzleDazzle Barbershop" in South Miami. Luis and I met on site after I signed the lease to my 6th location and he took the appropriate measurements. The sign was from then on, in his hands, to follow any and all regulations in order for my sign to properly be installed. Any requirements from the Landlord or miscellaneous information needed to assist Mr. Arnaldi, was just a phone call away and our communication clearly laid out the expectations for the job. Please see attached the PAID contract, which includes permitting fees. I take full responsibility for not researching his credentials prior to hiring him. I opened RazzleDazzle Barbershop in February 2014, without a sign. I knew this wouldn't draw much business in, since we were new to the area and did not have much exposure, due mainly to the narrow and awkward space in which we presently reside. Luis was in constant contact with me, telling me that it is along process with all the paperwork and permits needing to be pulled for approval. This was part of the con, conjecture on Luis's part} and delayed the placement of my sign, ultimately hurting my business. Luis and I went in front of the Environmental Review & Preservation Board on April 15, 2014, and our sign was approved. After approval from the board, Luis failed to comply with the process of pulling permits and took it upon himself to install the sign. Luis was overpaid to make sure he complied with EACH AND EVERY City of South Miami requirement. After receiving a summons that was left by a city inspector on May 21, 2014 for our sign, we did some investigation. It was discovered he was scamming me for my money without completing the assigned job. Luis Arnaldi is a sub contractor for a company by the name of All Signs, and he had a contractor review his papeIWork by signing off for the jobs he has done. The plans that were submitted to the Environmental Review & Preservation Board had fraudulent contact information in regards to Luis. When confronting Luis with this information, he was unprofessional and immediately disconnected our phone call. When trying to track down the real contractor, since Mr. Arnaldi was not willing to help, I was able to reach Robert Katzman, the owner of AAA ON TIME ELECTRICAL INC., and he agreed to collaborate with the City of South Miami and I with the process of moving fOIWard. I am currently seeking legal advice on how to take action from here since J cannot afford to hire a new sign company. Please consider and allow my sign to remain as is, since it is essential to the success of my business. On December 26,2013, I hired Luis Arnaldi who presented himself as a contractor, to do a sign for "RazzleDazzle Barbershop" in South Miami. Luis and I met on site after I signed the lease to my 6th location and he took the appropriate measurements. The sign was from then on, in his hands, to follow any and all regulations in order for my sign to properly be installed. Any requirements from the Landlord or miscellaneous information needed to assist Mr. Arnaldi, was just a phone call away and our communication clearly laid out the expectations for the job. Please see attached the PAID contract, which includes permitting fees. I take full responsibility for not researching his credentials prior to hiring him. I opened RazzleDazzle Barbershop in February 2014, without a sign. I knew this wouldn't draw much business in, since we were new to the area and did not have much exposure, due mainly to the narrow and awkward space in which we presently reside. Luis was in constant contact with me, telling me that it is a long process with all the paperwork and permits needing to be pulled for approval. This was part of the con, conjecture on Luis's part, and delayed the placement of my sign, ultimately hurting my business. Luis and I went in front of the Environmental Review & Preservation Board on April 15, 2014, and our sign was approved. After approval from the board, Luis failed to comply with the process of pulling permits and took it upon himself to install the sign. Luis was overpaid to make sure he complied with EACH AND EVERY City of South Miami requirement. Once the sign was installed, the community acknowledged that RazzleDazzle Barbershop was in town. This may be proven by our sales report. After receiving a summons that was left by a city inspector on May 21,2014 for our sign, we did some investigation. It was discovered he was scamming me for my money without completing the assigned job. Luis Arnaldi is a sub contractor for a company by the name of All Signs, and he had a contractor review his paperwork by signing off for the jobs he has done. The plans that were submitted to the Environmental Review & Preservation Board had fraudulent contact information in regards to Luis. When confronting Luis with this information, he was unprofessional and immediately disconnected our phone call. When trying to track down the real contractor, since Mr. Arnaldi was not willing to help, I was able to reach Robert Katzman, the owner of AAA ON TIME ELECTRICAL INC., and he agreed to collaborate with the City of South Miami and I with the process of moving forward. I am currently seeking legal advice on how to take action from here since I cannot afford to hire a new sign company. Please consider and allow my sign to remain as is, since it is essential to the success of my business. Staff stated that if the Board were to approve the application, the building inspector would inspect the sign to ensure that it complies with the Florida Building Code. Ms. Kelly stated that the sign that was approved by the Board was a sign that only sits above the storefront window, and does not cover the entire length of the storefront. Mr. Morales added that the barber pole is positioned near the door, below the sign which is not the correct location. Mr. Katzman stated that he is waiting to get approval from the Board in order to pull the necessary permits in order to correct the violations. When asked why the sign wasn't taken down if it wasn't approved, Ms. Linares stated that she was waiting to see if the sign was going to be approved by the ERPB. Ms. Linares gave background information on how the sign was installed. Ms. Kelly stated that the sign that was approved by the Board was half the size of the sign that was actually installed.
