BACKGROUND: On June 11, 2014, an application for Tentative Plat (application no. T-14-006) review was filed by the owner of the property, RP1-SM, llC, in order to divide one existing tract of land located at 6001 SW 80th Street (Figure 1) into five single family lots as shown in Figure 4. This property also includes a portion of SW 60th Avenue, an unimproved right-of-way that was abandoned and vacated by Resolution No. 81-05-12060, and recorded in the public records of Miami Dade County. The existing home, and other structures will be demolished prior to the construction of the new single family residences. Following submittal to the City, the property owner submitted for review to Miami-Dade County, pursuant to Chapter 28 of the County Code. The proposal was to divide the 1.31 acre tract to create five buildable lots as depicted in the Figure 4 proposed plat, with lots 1 through 3 fronting SW 79th Street, and lots 4 & 5 fronting SW 80th Street. The Miami Dade Platt Committee approved the proposed Tentative Plat (application no. T-23506-3-REV) on September 5, 2014. Pursuant to Chapter 28 of the County Code, the property owner then submitted for Final Plat review to the City of South Miami City Commission. On October 21, 2014, the City Commission review the Final Plat request described above and deferred the item on the grounds that the applicant's use of the vacated right-of-way was contrary to the stipulation of the vacation stated in Resolution No. 81-05-12060. The Commission suggested the applicant consider other options for the subdivision of the tract, and present those options at a future Commission meeting. On November 6, 2014, the applicant presented the original proposal, and four additional options for Commission review. However, the applicant indicated that the original request was still the most feasible proposal and requested approval of that Final Plat. The Commission failed to approve the motion for Final Plat Davis Oaks by a vote of 1 aye; 4 nays. Davis Oaks Final PlaCRevised 6001 SW 80th Street December 2,2014 Page 2 of 9 Figure 1. ANALYSIS: The applicant has resubmitted Plat alternative 2 that had been presented to the City Commission on November 6, 2014, to Miami Dade County Platt Committee for review (Figure's 2 & 2A). This proposal while not optimal, does not utilize any square footage of the vacated 60th Avenue right- of-way for lot computations. Although it does utilize the right-of-way for "frontage" requirements along SW 79 Street. It had been previously determined by the City Attorney that the use o( the vacated right-of-way for frontage and setbacks would be permissible under the provisions of Resolution No. 81-05-12060. The applicant submitted a "revised" Tentative Plat to Miami-Dade County (application no. T- 23056-4-REV), that was reviewed and approved on November 21, 2014. Although a "new" lot configuration for the Final Plat (Figure 2A) is being presented to the City for consideration, the applicant is still requesting that the Commission give favorable consideration to, and approve as the Final Plat for Davis Oaks, the original proposal presented to the City Commission on October 21, 2014 (Figure 4). Staff has also included the previous lot analysis for this earlier proposal, should the Commission wish to consider this option for Final Plat approval. (2) No building shall be erected, improved, modified, altered or enlarged in any zoning use district, other than in an RS residential district, unless proper public improvements have been installed. The (revised) Final Plat indicated by Figures 2A and 3, as proposed, meets the minimum requirements for the RS-3 single-family residential zoning district. The City's arborist will provide a comprehensive review of the proposed tree disposition once the proposed development and landscape plans have been submitted to the department for Board review, and prior to the issuance of a development permit. Please note that a citywide moratorium on the removal of trees is still in effect; all tree relocation and removal shall be done in compliance with the City's permitting and canopy mitigation requirements. A trip generation report prepared by SRS Engineering, Inc. indicated that the additional trips generated by the proposed development will not decrease the adopted levels of service for the neighborhood collector streets. High Surveying & Mapping verified the accuracy of the proposed final plat pursuant to Chapter 177, Florida Statutes; the final plat has been revised to address any comments. CONCLUSION: Should the Commission choose to approve the "revised" final plat as submitted, it is recommended that the applicant comply with the following conditions, and/or other conditions deemed appropriate by the City Commission. 1. Compliance with the conditions of the Miami-Dade County approval of application No. T-23506-4-REV. 2. Compliance with current City Land Development Code requirements. 3. Compliance with all City tree removal and canopy mitigation requirements. 4. Compliance with the City's Public Works requirements for any roadway, sidewalk, driveway and/or drainage improvements. 5. Compliance with the provisions of Resolution 81-05-12060. 6. Demolition of the existing one-story structure prior to issuance of a development permit. 7. Compliance with any Miami-Dade County Environmental Resource Management requirements prior to final recording of this plat. WHEREAS, the petition of the applicants states that 60 th Avenue south of 80th Street is also closed and that there is no reason for the right-of-way to exist, that the paving of a street would create traffic and would be dangerous to children in the area; and WHEREAS, letters from Bell South, Miami-Dade Water and Sewer, and FPL have been received stating that they have no utilities in the right-of-way and do not object to the street closure; an.d WHEREAS, the City has no plans to use the unimproved right-of-way for vehicle traffic; and WHEREAS, the abandonment of this unimproved right-of-way would allow the abutting property owners to assume ownership of the property and allow for expanded development on their property; and WHEREAS, the increase in lot size of all three abutting properties is of concern in that this may lead to increased development on each property or the potential of additional building sites. That all of the land shown as "unimproved right-of way" on the survey attached to this resolution, said property generally described as an "unimproved right-of-way portion" of SW 60 th Avenue located between SW 79 Street and SW 80 Street, said unimproved right-of-way being 50 feet wide and 227 feet long more or less, running north and south, is hereby vacated and abandoned. Section 2. Pursuant to Fla. Statue 336.12 the vacated portion of SW 60th Avenue located between SW 79 Street and SW 80 Street is hereby conveyed to the abutting property owners with the following conditions: Res.
