Resolution of the City Commission for the City of South Miami approving a
final plat to allow for the subdivision of property located at 5959 SW 61
Street, South Miami, Florida.
BACKGROUND:
On June 10, 2014, application No. T -14-007 for tentative plat review was filed
with the Planning & Zoning Department by the owners of the property,
Lawrence and Pamela Lahiff, in order to enlarge their property located at 5959
SW 61 Street (Figures 1 & 2).
The Planning & Zoning Department conducted a review of application No. T-
14-007 for a tentative plat of the referenced property, and the three abutting
properties owned by the applicants. The proposed replat will not create any
additional new single family residential lots, but rather simply adjust existing
lot lines to increase the lot area of 5959 SW 61 Street.
The parcels are all zoned RS-3 -Low Density Single Family Residential, and the
proposed tentative plat exceeds the City's minimum lot size requirements of
10,000 square feet and 75 feet of frontage. No demolition of existing
structures or tree removal is being proposed with this application. Any future
changes to lots or structures will be reviewed under a separate application. The
City's Public Works Department and City Arborist have no comments on this
proposal; additionally, no concurrency review is triggered.
Subsequent to the City's review, the applicants submitted for a tentative plat
review with Miami Dade County pursuant to Section 28-4 of Miami-Dade
County Code; application No. T -23518-3-REV. The Miami-Dade County plat
committee met on October 3, 2014 and recommended approval of the tentative
plat subject to any provisions enumerated in their attached approval letter and
subject to final plat approval by the City Commission. Upon final approval the
plat shall be recorded with the County.

The final plat as proposed meets the minimum requirements for the RS-3
single-family residential zoning district. The replat will not create any
additional new single family residential lots, but rather simply adjust existing
lot lines to increase the lot area of 5959 SW 61 Street. High Surveying &
Mapping verified the accuracy of the proposed final plat pursuant to Chapter
177, Florida Statutes.
RECOMMENDATION
Staff recommends approval of the final plat subject to the following, and other
conditions deemed appropriate by the City Commission.
a. Compliance with the conditions of the Miami-Dade County approval of
application No. T -23518-3-REV;
b. Compliance with current City Land Development Code requirements.
c. Compliance with the City's current tree removal moratorium, and any proposed

WHEREAS, Lawrence and Pamela Lahiff, owners of the parcel located at the 5959 SW 61 sl

WHRERAS, the Miami Dade County plat committee met on October 3,2014 and recommended
approval of the tentative plat subject to any provisions enumerated in their approval letter, and subject to
final plat approval by the City and County; and
WHEREAS, the replat application requests a subdivision of said parcel for the purpose of
rearranging existing lot lines to increase the size of Lot 1, Block 2, located at 5959 SW 61 ST; and
WHEREAS, the property owners own the adjacent and abutting properties to the north, east and
west; and
WHEREAS, the final plat does not create any additional buildable lots; and
WHEREAS, the replat is in compliance with the City's requirements within the RS-3, single-
family zoning district.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The application submitted by Lawrence and Pamela Lahiff, requesting approval of a
proposed Final Plat for the property legally described in Section 2, pursuant to section 20-4.2(b) of the
Land Subdivision Regulations is hereby , and subject to the following
conditions, and/or other conditions deemed appropriate by the City Commission:
a. Compliance with the conditions of the Miami-Dade County approval of application No.

shall not affect the validity of the remaining portions of this resolution.

consequently, any proposed development would have to be served by a septic tank and drainfield as a means
for the disposal of domestic liquid waste.
The subject property does not meet the minimum allowable lot size requirements of Section 24-43.1{3) of the
Code of Miami-Dade County (the Code) for a single-family residence served with a septic tank and public water.
Pursuant to Section 24-43.1(3} of the Code, the minimum lot size for a single family residence served by public
water and a septic tank shall be 15,000 square feet (gross). However, Section 24-43.1(3)(e) of the Code allows
platting of a subdivision of lots that do not meet the minimum lot size requirement if the original plat was
created prior to 1972 and the proposed plat will result in a subdivision with the equivalent number of lots.
The existing plat, Avocado Homes, was platted in 1950 with substandard lots (lots 18, 20,21: 11,770 sq. ft. each
and lot 22 12278 sq. ft.). The proposed four lots of Lahiff Subdivision do not comply with the minimum lot size
however will result in the equivalent number of lots. Therefore, the proposed plat can be approved pursuant to
Section 24-43.1(3)(e}.
