A Resolution acknowledging Commissioner Josh Liebman's (Group Seat II)
appointment of Jose E. Suarez-Marill, as the representative of Group Seat II,
to serve on the Environmental Review and Preservation Board for a two-
year term ending November 5, 2016.
WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that:
* * * When a Board or Committee is comprised of five members, each
City Commissioner shall appoint one person to serve as a
representative on the Board or Committee. When there are more than
five (5) members on a Board or Committee, each City Commissioner
shall appoint one person to serve as a representative on the Board or
Committee, and all members of such Board or Committee in excess of
five (5) shall be appointed by three (3) affirmative votes of the City
Commission based on recommendations submitted by any City
Commissioner. When a Board or Committee has less than five (5)
members, then the selection of all members shall be by three (3)
affirmative votes of the City Commission from recommendations
submitted by any City Commissioner. (Amended 2-09-10)
23 WHEREAS, the Mayor and Commission recognize the important contributions made by
24 those who serve on the various city boards and committees, and wish to have a full complement
25 to each of the active boards and committees; and
26
27 WHEREAS, Commissioner Liebman now desires to appoint Jose E. Suarez-Marill to serve
28 on the Environmental Review and Preservation Board, as his representative. Therefore, Mr.
29 Suarez-Marill's appointment shall expire November 5, 2016 or upon his removal or until a
30 successor is duly appointed and qualified; and

32 WHEREAS, Commissioner Liebman desires to replace Beth Schwartz, whose term
33 expired November 14, 2013, with the appointment of Jose E. Suarez-Marill as representative for
34 City Commission Group Seat II on the Environmental Review and Preservation Board; and
35
36 WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22
37 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2)
38 consecutive two-year terms of membership on a specific commission, board, or committee.
39 After serving a maximum of two (2) consecutive year terms, an appointee shall not be
40 reappointed to the same commission, board or committee unless at least one year has elapsed
41 between the term limited position and the effective date of commencement of the proposed
42 appointment for a new term; and

44 WHEREAS, Mr. Suarez-Marill has not served on the Environmental Review and
45 Preservation Board in the past; an d

WHEREAS, pursuant to Sec. 2-22 "Term Limits" of the Code of Ordinances, this will be
2 considered to be Mr. Suarez-Marill's first, two-year term for the purposes of Term Limits.

4 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
5 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:

7 Section 1. The City Commission hereby acknowledges Commissioner Liebman's
8 right to appoint Jose E. Suarez-Marill to the Environmental Review and Preservation Board as
9 the representative of Group Seat II pursuant to the terms of the City Charter and replace Beth
10 Schwartz.

12 Section 2. The expiration date of this appointment shall be November 5,2016
13 or until a successor is duly appointed and qualified.

15 Section 3. Effective Date. This resolution shall become effective immediately upon
16 adoption by vote of the City Commission.
