Resolution No.
A Resolution acknowledging Commissioner Josh Liebman's (Group Seat II)
appointment of Donna Shelley, as the representative of Group Seat II, to
serve on the Green Task Force for a two-year term ending November 5,
2016.
WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that:
10 * * * When a Board or Committee is comprised of five members, each City
11 Commissioner shall appoint one person to serve as a representative on the
12 Board or Committee. When there are more than five (5) members on a
13 Board or Committee, each City Commissioner shall appoint one person to
14 serve as a representative on the Board or Committee, and all members of
15 such Board or Committee in excess of five (5) shall be appointed by three
16 (3) affirmative votes of the City Commission based on recommendations
17 submitted by any City Commissioner. When a Board or Committee has less
18 than five (5) members, then the selection of all members shall be by three (3)
19 affirmative votes of the City Commission from recommendations submitted
20 by any City Commissioner. (Amended 2-09-10)

22 WHEREAS, the Mayor and Commission recognize the important contributions made by
23 those who serve on the various city boards and committees, and wish to have a full complement
24 to each of the active boards and committees; and
25
26 WHEREAS, there is no current representative for City Commission Group Seat II on the
27 Green Task Force; and
28
29 WHEREAS, Commissioner Liebman now desires to appoint Donna Shelley to serve on
30 the Green Task Force, as his representative. Therefore, Donna Shelley's appointment shall expire
31 November 5, 2016 or upon her removal or until a successor is duly appointed and qualified; and

33 WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22
34 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2)
35 consecutive two-year terms of membership on a specific commission, board, or committee.
36 After serving a maximum of two (2) consecutive year terms, an appointee shall not be
37 reappointed to the same commission, board or committee unless at least one year has elapsed
38 between the term limited position and the effective date of commencement of the proposed
39 appointment for a new term; and
40
41 WHEREAS, Ms. Shelley served on the Green Task Force in the past (2007-2009);
42 and
43
44 WHEREAS, pursuant to Sec. 2-22 "Term Limits" of the Code of Ordinances, this will be
45 considered to be Ms. Shelley's first, two-year term for the purposes of Term Limits.

47 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
48 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:

2 Section 1. The City Commission hereby acknowledges Commissioner Liebman's
3 right to appoint Donna Shelley to serve on the Green Task Force as the representative of Group
4 Seat II pursuant to the terms of the City Charter.

6 Section 2. The expiration date of this appointment shall be November 5,2016,
7 or upon her removal, or until a successor is duly appointed and qualified.

9 Section 3. Effective Date. This resolution shall become effective immediately upon
10 adoption by vote of the City Commission.
