A Resolution approving the Final Plat of Davis Oaks, being a replat of a portion of tract 8 of
revised plat of a portion of the amended plat of Palm Miami Heights, recorded in plat book 43,
page 37, Miami-Dade County, Florida.
BACKGROUND:
On June 11, 2014, an application for Waiver of Plat was filed by the owner of the property, RP1-
SM, LLC, in order to divide one existing tract of land located at 6001 SW 80th Street (Figure 1)
into five single family lots as described below. The property currently has a one story single
family residence addressed off SW 80th Street. The applicant proposes to divide the 1.45 acre
tract to create five buildable lots as depicted in the attached plat, with lots 1 through 3 fronting
SW 79th Street, and lots 4 & 5 fronting SW 80th Street.
This property also includes a portion of SW 60th Avenue, an unimproved right-of-way that was
abandoned and vacated by Resolution No. 81-05-12060, and recorded in the public records of
Miami Dade County. The existing home, and other structures will be demolished prior to the
construction of the new single family residences.
Any required roadway and drainage improvements must be done pursuant to Section 20-4.2(C)
of the City's land development code, which states the following:
(1) Sidewalks, curbs, gutters, drainage and paving shall be installed by the developer in
accordance with Chapter 28 of the County Code and other applicable city
requirements, unless such can be and are waived or deferred by the city commission.
(2) No building shall be erected, improved, modified, altered or enlarged in any zoning use
district, other than in an RS residential district, unless proper public improvements have
been installed.

The final plat as proposed meets the mmlmum requirements for the RS-3 single-family
residential zoning district. The City's arborist will provide a comprehensive review of the
proposed tree disposition once the proposed development and landscape plans have been
submitted to the department for Board review, and prior to the issuance of a development
permit. Please note that a citywide moratorium on the removal of trees is still in effect; all tree
relocation and removal shall be done in compliance with the City's permitting and canopy
mitigation requirements. A trip generation report prepared by SRS Engineering, Inc. indicated
that the additional trips generated by the proposed development will not decrease the adopted
levels of service for the neighborhood collector streets. High Surveying & Mapping verified the
accuracy of the proposed final plat pursuant to Chapter 177, Florida Statutes; the final plat has
been revised to address any comments.

RECOMMENDATION
Staff recommends approval of the final plat request with the condition that the applicant
comply with the following conditions, and/or other conditions deemed appropriate by the City
Commission.
1. Compliance with the conditions of the Miami-Dade County approval of application No.
T -23506-3-REV.
2. Compliance with current City Land Development Code requirements.
3. Compliance with all City tree removal and canopy mitigation requirements.
4. Compliance with the City's Public Works requirements for any roadway, sidewalk,
driveway and/or drainage improvements.
5. Compliance with the provisions of Resolution 81-05-12060.
6. Demolition of the existing one-story structure prior to issuance of a development
permit.
7. Compliance with any Miami-Dade County Environmental Resource Management
requirements prior to final recording of this plat.

8 WHEREAS, the Mayor and the City Commission of the City of South Miami have received and
9 reviewed an application filed by RPI-SM, LLC, a Florida limited liability company, seeking to re-plat
10 property legally described as Tract 8, less the West 100 feet thereof, and the west 25 feet of SW 60
11 Avenue adjoining Tract 8 which was vacated by City Resolution 81-05-12060, REVISED PLAT OF A
12 PORTION OF THE AMENDED PLAT OF PALM .rYliAMI HEIGHTS, according to the Plat thereof~ as
13 recorded in Plat Book 43, Page 37 of the Public Records of Miami-Dade County, Florida; and

15WHRERAS, the Miami Dade County plat committee met on September 5, 2014 and
16 recommended approval of the tentative plat subject to any provisions enumerated in their approval letter,

Dear Mr. Flannigan:
The Planning & Zoning Department conducted a review of your application No. T-14-006 for a
tentative plat of the referenced property. The proposed plat will create five (5) new single family
residential lots; three fronting SW 79th Street, and two fronting SW 80th Street.
This parcel is zoned RS-3 -Low Density Single Family Residential, and meets the City'S
minimum lot requirements of 10,000 square feet. As we 4ave discussed, the property abuts an
unimproved p011ion of SW 60th A venue, between SW 79th and SW 80th Streets, which was
vacated to the abutting property owners by Resolution No. 81-05-12060.
As a condition to the vacation and abandonment of said right-of-way, abutting property owners
may not use the square footage of the vacated street to create new building sites. A review of the
conditions by the City Attorney concluded that "the vacated right-of-way may be used as part of
a subdivision, such as for setbacks and frontage, but the square footage cannot be used for any
calculations." Utilizing the said right-of-way will allow you to achieve the required minimum
seventy-five (75) feet of frontage to accommodate three lots along SW 79th Avenue and proceed
with the proposed replat.
Prior to final plat approval, the City's Arborist will review the propo~ed tree disposition and
provide the necessary canopy mitigation requirements to comply with the City's tree protection
and landscape ordinance requirements. Any additional comments from the City's Public Works
Department relative to driveways, swales and rights-of way, will be incorporated into the final
review along with any Miami-Dade County comments and recommendations.
When you have formally submitted your T-Plat application to Miami-Dade County, the City will
submit your application for Miami Dade Schools concurrency review. You will be notified
directly by the Schools Facilities Planning Division once they have completed their review.

SOUTH MIAMI, FLORIDA IN RESPONSE TO PETITION OF ABUTTING
PROPERTY OWNERS APPROVING THE VACATION AND ABANDONMENT

FULLY DESCRIBED IN A LEGAL DESCRIPTION SET FORTH BELOW;
SUBJECT TO PROPERTY OWNERS PROVIDING FOR THE RECORDING OF
ALL LEGAL DOCUMENTS NECESSARY FOR THE ABANDONMENT;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has the power to vacate, abandon, discontinue and
close an existing public or private street, alleyway, road, highway or other place used for travel or
any portion thereof, other than a state or federal highway, and to renounce and disclaim any right of
the City and the public in and to any land in connection therewith; and
WHEREAS, the City of South Miami has received a formal petition from all three of the
abutting property owners requesting the abandonment and vacation of an unimproved portion of SW
60 Ave. between SW 79 Street and SW 80 Street.
WHEREAS, the petition of the applicants states that 60th Avenue south of 80 th Street is also
closed and that there is no reason for the right-of-way to exist, that the paving of a street would
create traffic and would be dangerous to children in the area; and
WHEREAS, letters from Bell South, Miami-Dade Water and Sewer, and FPL have been
received stating that they have no utilities in the right-of-way and do not object to the street closure;

WHEREAS, the City haS no plans to use the unimproved right-of-way for vehicle traffic;
and
WHEREAS, the abandonment of this unimproved right-of-way would allow the abutting
property owners to assume ownership of the property and allow for expanded development on their
property; and
WHEREAS, the increase in lot size of all three abutting properties is of concern in that this may
lead to increased development on each property or the potential of additional building sites.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That all of the land shown as "unimproved right-of way" on the survey attached to this
resolution, said property generally described as an "unimproved right-of-way portion" of SW 60th
Avenue located between SW 79 Street and SW 80 Street, said unimproved right-of-way being 50

Dear Mr. Garcia-Carrillo:
As requested, SRS Engineering, Inc. has reviewed the proposed Palm Miami Subdivision and
prepared the attached trip generation table. The proposed subdivision will consist of five (5) new
residential units. A credit is taken for the existing residential unit on the property, therefore, the,
additional increase is 4 residential units. Trip generation results were obtained using FOOT's Trip
Generation Table based on the Trip Generation Rates from the 8th Edition ITE Trip Generation
Report, please see attached Exhibit "A. The total additional calculated Daily Trips for the proposed
subdivision is 38, and the estimated PM Peak Trips is 4. Based on these amounts it is our opinion
that the additional trips will not decrease the adopted level of service for the collector roads.
