RESOLUTION NO. ____ _
A Resolution of the City of South Miami to encourage Florida Power & Light Company
("FPL"), the Public Service Commission and the state legislature to give electrical utility
customers a larger percentage for their net metering credit if the customers contribute
their excess electricity to a non-profit charity.
WHEREAS, net metering allows customers of Florida Power & Light Company ("FPL") to
offset their electricity usage with electricity the customer generates using solar panels on a home or a
wind turbine. These installations are connected to a bidirectional meter, which will measure the net
quantity of electricity that the customer uses ("retail meter"). The retail meter spins forward when the
customer uses electricity from FPL, and it spins backward when the customer generates excess
electricity (thereby "exporting" electricity to the electric grid). A special retail meter (also called the
"net meter") is required to allow for the "netting" of usage and generation, especially when there may
be exporting of electricity.
WHEREAS, the net metering tariff is a schedule of the rates, charges, terms and conditions
affecting how FPL and other electrical distributors treat a net metering customer when providing net
metering or other distribution services to customers.
WHEREAS, under the present net-metering tariff, FPL levels up with solar over-producers in
December, but only pays the value of the avoided fuel costs (~3 cents / kilowatt-hours "kWh"), rather
than the full value of the power which is 9-11 cents / kWh; and
WHEREAS, one concern is that FPL would demand that solar producers donate their surplus
every month, which would damage net-metering because a producer could not bank surplus power from
a sunny April to cover a deficit in a cloudy June; and
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The City shall negotiate with FPL, and lobby the Public Service Commission and
the state legislature to change the net metering tariff so that customers who generate their own
electricity can donate their net surplus power annually to a non-profit charity for the full write-off value
and to have FPL make a year-end power donation in the customer's name, amounting to the banked
surplus of the producer across the calendar year.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon adoption
by vote of the City Commission.
