BACKGROUND: The Environmental Review and Preservation Board (ERPB), at its July 1, 2014 meeting, reviewed the signage request by Saul Signs (the applicant) to install a total of three (3) signs for US Polo Assn., a new tenant at the Shops at Sunset Place. Pursuant to Section 20 - 4.3(1)(5) of the land Development Code, FlA T SIGNS with a total aggregate sign area, not to exceed twenty (20) percent of the area of any building face; for the purposes of sign regulation, there shall be considered to be only four (4) facades to any building; no single sign shall exceed two hundred (200) square feet in area. Direct illumination is permitted However, when reviewing the blade sign, it was found that it exceeded the maximum square footage allowed for hanging signs. Pursuant to Section 20-4.3(1)(5) of the land Development Code, One (1) HANGING SIGN per establishment not to exceed three (3) square feet in area each. Signs shall be uniform in size and design within a single property, but may vary in lettering style and color, provided that they are compatible and coordinated with other signs for individual establishments in the same development Indirect illumination is permitted Because members of the ERPB felt that the amount of signage that was being proposed was excessive, application No. ERPB 14-041 was granted approval with the condition that only the entrance sign (sign over the door) be approved. ANALYSIS: On July 21, 2014, the applicant submitted an application to appeal the approval of ERPB-14-041 to the city commission. The applicant felt that because the subject store is recessed back by approximately ten (10) feet, it wouldn't be immediately visible to the malls' pedestrian traffic. The applicant also stated that because other tenants in the mall have similar signage, they should be allowed to install their signage as originally intended. Pursuant to Section 20-6.2(A) of the land Development Code, a decision made by the ERPB may be appealed to the City Commission by the City administration, the applicant, or an interested citizen. The City Commission has 60 days from the filing date to hear the appeal and enter a decision (reverse, affirm or modify the ERPB decision). The filing of the appeal stays all actions or proceedings related to the development of the property. After an inspection that was conducted by staff, it was found that while a small percentage of tenants have signage similar to what the applicant is proposing, a majority of the signage within the Shops at Sunset Place complies with the Signage Master Plan, which has been used by staff since its adoption by the Shops. According to the plan, the sign location that was approved for this tenant space was a sign that was mounted behind the building face, and not on it. Based on this, the only sign that could be installed that would be in compliance with the signage master plan would be the entrance sign. CONCLUSION: The City Commission may approve the applicant's appeal, thereby approving the additional signage, deny the appeal or refer the applicant back to the ERPB for reconsideration. If the Commission should approve the appeal, it is recommended that the size of the hanging sign be reduced so that it is in compliance with the hanging sign regulations that are listed above. WHEREAS, the Environmental Review and Preservation Board (ERPB) at its July 1, 2014 meeting reviewed Application No. ERPB 14-041 and approved with conditions, the request for signage installation for a tenant space located at the Shops at Sunset Place, 5701 Sunset Drive; and WHEREAS, on July 21,2014 the applicant, Saul Signs, filed an appeal to the decision of the Environmental Review and Preservation Board claiming that the board only approved one (1) of the three (3) signs that were proposed; and WHEREAS, Section 20-6.2(A) of the Land Development Code allows for an appeal of an ERPB decision to be made to the City Commission by the applicant, interested citizens, or the City administration; and WHEREAS, Section 20-6.2(E) of the Land Development Code provides that the City Commission may reverse, affirm, or modify any decision of the Environmental Review and Preservation Board on which there has been an appeal. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Applicant requested approval of three (3) signs in ERPB Application #ERPB-14-041. The Application was filed on July 2014 and requested one cabinet Box with a Channel Letter Horse right above Store entrance. The cabinet Box was approved. There was also a channel letter and blade sign mounted on the facade located in front of store. These were not approved as per the board members of the City of South Miami. The decision was based on personal preference. The two exterior signs serve with the purpose of making the store more visible to customer eyes, since the store location recedes back 20 feet from plaza hallways that does not allow customer to easily locate the store. We appeal to this decision due to the fact that there are other stores within the same plaza that have multiple exterior signs throughout the place. For example, Buffalo Wild Wings has a Cabinet Box at store entrance, blade sign less than 5 feet away from store entrance along with a Channel Letter sign facing 57 th Avenue. All we ask is to have approved the store front signs. We do not need exterior signs on any major streets. We only want them inside the plaza by the store. The Plaza has approved all of our signs we are only having issues with the city's preference. On September 2nd @ 7:00 pm I will be attending a board meeting at the city building /zoning department to present the argument we have in regards to the signage we plan to install. It's only fair to allow a store front sign for us when other companies in the plaza have multiple signs near and far in the same location. STAFF ANALYSIS: The applicant is proposing to install a total of three (3) signs on the exterior surface above the storefront for the U.S. Polo Association, a new tenant in the Shops at sunset Place. Because two (2) of the three (3) signs are considered to be flat signs, Section 20-4.3(1)(5) All Other Zoning Districts, of the land Development Code, provides the following regulations for flat signs: FLA T SIGNS with a total aggregate sign area, not to exceed twenty (20) percent of the area of any building face; for the purposes of sign regulation there shall be considered to be only four (4) facades to any bUIlding; no single sign shall exceed two hundred (200) square feet in area. Direct illumination is permitted Located directly above the entrance leading into the store, the first proposed illuminated sign will consist of a white colored sign box with two (2) lines of push thru letters that will 5701 SW 72 Street ERPB-14-041 presented on July 1, 2014 Signage Installation Page 2 of 4 read "U.S. POLO ASSN./I in red colored letters and "since 1890" in black colored letters. The company logo, polo players, will be placed above the wording. The sign box will have a height of sixteen (16) inches, a length of seventy-seven (77) inches, and a sign area of approximately 8.53 square feet. The company logo will have a height of thirty-eight (38) inches, a length of twenty-two (22) inches, and a sign area of approximately 5.81 square feet. It is important to note that because they are attached together, both the sign box and the company logo are considered to be one sign even though separate dimensions were provided for each of them. After review of the proposed sign, it was found that it complies with the regulations I isted above for flat signs. Also, when combined, the square footage would be increased to 14.34 square feet, which complies with the regulations listed above for flat signs as well. The second proposed illuminated sign will be mounted to the wall above the storefront and will have similar text. This sign will consist of clear acrylic letters that will read "U.S. POLO ASSN." in red colored letters and "SINCE 1890" in black colored letters. The sign will have a total height 26.5 inches, a total length of 198 inches, and a sign area of approximately 36.47 square feet. After review of the proposed sign, it was found that it complies with the regulations listed above for flat signs. The third sign will be mounted to the column adjacent to the entrance into the store. Considered to be a hanging sign, Section 20-4.3(1)(5) All Other Zoning Districts, of the Land Development Code, provides the following regulations for hanging signs: One (1) HANGING SIGN per establishment not to exceed three (3) square feet in area each. Signs shall be uniform in size and design within a single propert~ but may vary in lettering style and colo0 provided that they are compatible and coordinated with other signs for individual establishments in the same development. Indirect illumination is permitted The proposed non-illuminated double-sided sign will consist of the company logo on a white colored background. Mounted to the column with bolts, the proposed sign will have a height of twenty-four (24) inches, a length of twenty-four (24) inches, and a sign area of approximately four (4) square feet, which exceeds the size regulations listed above for hanging signs. ~ONCLUSION: Pursuant to the signage master plan for the Shops at Sunset Place, it was found that only one sign location is allowed per unit. While both flat signs comply with the flat sign regulations, only one can be located on the building. Because of this, staff can only support one (1) of the proposed flat signs, and deny the remaining proposed signs. RECOMMENDATIONS: Staff recommends Approval for only one (1) of the two (2) flat signs with the following conditions: 1. No electrical wiring is to be exposed; 2. All signage from the previous tenant must be removed, and any damage to the building repaired; 3. Any additional signage will require a separate application to the ERPB for review and approval; and, 4. Any comments and/or suggestions from the Board. Staff recommends Denial for one (1) of the two (2) flat signs, and the hanging sign with the following comments: Because the signage master plan for the Shops of Sunset Place only allows for one (1) sign location for the unit, only one (1) sign can be approved. However, pursuant to Section 20- 4.3(L) of the Land Development Code, other types of signs, not expressly permitted by regulations stated in Section 20-4.3(1), may be approved by the Environmental Review and Preservation Board (ERPS) when the following conditions are met: 1. That the proposed sign is not prohibited by Section 20-4.3(E); 2. That the proposed sign conforms to the Florida Building Code and other code regulations, as applicable; 3. That the proposed additional sign on the building does not occupy more than 30% of the facade on which it is proposed to be installed or more than 20% of any window area; and 4. Detached signs may be permitted on any commercial property with the approval of the Environmental Review and Preservation Board, including detached signs that exceed the permitted location and height standards set forth in Section 20-4.3(\). Staff recommends the following conditions should the Board decide to approve the remaining flat sign and/or the hanging sign: 1. The hanging sign should be reduced so that it complies with the regulations for hanging signs; 2. No electrical wiring is to be exposed; 3.
