_Add-on AAdd-On Item a) Sponsored by: Commissioner Welsh City Commission Meeting 9/02/14 RESOLUTION NO. __________ 1 2 A Resolution enacting a moratorium on issuance of permits to cut 3 or otherwise kill all trees until the existing tree protection 4 ordinance can be amended to provide better protections. 5 6 WHEREAS, development of properties in the city has increased in pace; and 7 8 WHEREAS, the City’s tree ordinance states “The intent of this section is to provide a 9 mechanism to protect, reserve, and restore the tree canopy within the City of South Miami by 10 regulating the removal, relocation and trimming of trees”; and 11 12 WHEREAS, developers have recently obtained permits and cut down extremely old, 13 slow-growing, native trees including Dade County slash pine and cabbage palms, as well as large 14 live oaks; and 15 16 WHEREAS, the residents and City Commission of South Miami have not been 17 convinced such destruction was necessary to redevelop the properties; and 18 19 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 20 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 21 22 Section 1. 25 The City hereby issues a moratorium on the issuance of any tree removal 23 permit to cut down, remove or otherwise kill any trees: 24 Section 2. 30 The moratorium shall expire on Oct 1, 2014 or the date that the City 26 Commission approves or denies a revision to the tree protection ordinance that provides greater 27 incentive for property owners and developers to responsibly relocate or design around existing 28 native trees listed in Section 1, whichever occurs first. 29 Section 3. 35 City staff is instructed to work with the sponsor of this resolution to draft a 31 revision to the existing Tree Protection Ordinance that provides greater incentive for property 32 owners and developers to responsibly relocate or design around existing native trees of high 33 value or low growth rate. 34 Section 4. 39 If any section clause, sentence, or phrase of this resolution is for any 36 reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not 37 affect the validity of the remaining portions of this resolution. 38 Section 5. 41 This resolution shall take effect immediately upon adoption. 40 Passed and adopted this ___ day of ________ 43 , 2014. 42 44 45 Page 2 of 2 ATTEST: APPROVED: 1 2 3 _________________________ ___________________________ 4 CITY CLERK MAYOR 5 6 COMMISSION VOTE: 7 Mayor Stoddard: 8 Vice Mayor Harris: 9 Commissioner Edmond: 10 Commissioner Liebman: 11 Commissioner Welsh: 12 READ AND APPROVED AS TO FORM 13 AND SUFFICIENCY: 14 15 16 ____________________________ 17 CITY ATTORNEY 18 19
