A Resolution acknowledging Commissioner Welsh's (Group Seat III) appointment of Stephen McCloskey, Jr., Esq, as the representative of Group Seat III, to serve on the Pension Board for the South Miami Pension Plan for a two-year term ending September 1, 2016. WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that: I 10 * * * When a Board or Committee is comprised of five members, each City 11 Commissioner shall appoint one person to serve as a representative on the 12 Board or Committee. When there are more than five (5) members on a 13 Board or Committee, each City Commissioner shall appoint one person to 14 serve as a representative on the Board or Committee, and all members of 15 such Board or Committee in excess of five (5) shall be appointed by three 16 (3) affirmative votes of the City Commission based on recommendations 17 submitted by any City Commissioner. When a Board or Committee has less 18 than five (5) members, then the selection of all members shall be by three (3) 19 affirmative votes of the City Commission from recommendations submitted 20 by any City Commissioner. (Amended 2-09-10) 21 22 WHEREAS, the Mayor and Commission recognize the important contributions made by 23 those who serve on the various city boards and committees, and wish to have a full complement 24 to each of the active boards and committees; and 25 26 WHEREAS, there is no current representative for City Commission Group Seat III on the 27 Pension Board for the South Miami Pension Plan; and 28 29 WHEREAS, Commissioner Welsh now desires to appoint Stephen McCloskey, Jr., Esq, 30 to serve on the Pension Board for the South Miami Pension Plan, as the representative of Group 31 Seat III. Therefore, Mr. McCloskey's appointment shall expire September 1, 2016, or upon his 32 removal or until a successor is duly appointed and qualified; and 33 34 WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22 35 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2) 36 consecutive two-year terms of membership on a specific commission, board, or committee. 37 After serving a maximum of two (2) consecutive year terms, an appointee shall not be 38 reappointed to the same commission, board or committee unless at least one year has elapsed 39 between the term limited position and the effective date of commencement of the proposed 40 appointment for a new term; and 41 42 WHEREAS, Mr. McCloskey has never served on the Pension Board for the South 43 Miami Pension Plan; and 44 45 WHEREAS, pursuant to Sec. 2-22 "Term Limits" of the Code of Ordinances, this will be 46 considered to be Mr. McCloskey's first two-year term for the purposes of Term Limits. 47 48 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 2 3 Section 1. The City Commission hereby acknowledges Commissioner Welsh's right 4 to appoint Stephen McCloskey, Jr., Esq, to the Pension Board for the South Miami Pension 5 Plan as the representative of Group Seat III pursuant to the terms of the City Charter. 6 7 Section 2. The expiration date of this appointment shall be September 1, 2016 8 until removed or until a successor is duly appointed and qualified. 9 10 Section 3. Effective Date.
